SUMMARY
 Provides additional requirements for permitting and
contractor registration to address issues associated
with residential construction projects
 Limited number of projects taking too long or
abandoned, negatively impacting neighborhoods
 Policies seek to encourage timely completion of
projects & limit impact of non-performing
contractors
BACKGROUND
 Neighborhoods experiencing abandoned
construction projects or projects progressing too
slowly
 Partially-built projects may pose health &
safety hazards, public nuisance
 Building code limited in how to address issues
or prevent from occurring in future
POTENTIAL AMENDMENTS – INTENT
 Encourage timely completion of residential
projects
 Enhance enforcement efforts relating to
residential construction in City
 Limit beginning other major residential
construction if previous project(s) a public
nuisance
BACKGROUND
 Chapter 5 – Building & Building Regulations
includes
 Adopted building code standards
 Building-related requirements involving
contractors, permits & inspections
AMENDMENT – CONTRACTOR REGISTRATION
 Additional contractor & permitting registration
requirements
 Insurance requirements for contractors
 Affidavit submitted in permit application
 Proof of contractor registration on site
AMENDMENT – ENFORCEMENT TOOLS
 Additional enforcement tools
 Suspend permits or contractor’s registration for set
time period
 Person/entity ineligible to receive new residential
construction permits
POTENTIAL AMENDMENT – ENFORCEMENT
TOOLS
 Person/entity ineligible to receive any new permit relating to
residential construction until followed remedied
 Unresolved notice of violation
 2 or more stop work orders or notices of violation (w/in past 24 months)
 Open or unresolved permits for other residential projects
 3 or more – general contractor permits & 6 or more – tradesman permits
 Currently indebted to City
 Entered guilty or no contest plea or convicted of felony or misdemeanor for
violation of building code or local amendment
 Convicted for penal offense or suffered civil action judgement for fraud
relating to performance of residential building contract
 Violation of contractor registration requirements (w/in past 24 months)
 Created public nuisance or substandard/dangerous structure
POTENTIAL AMENDMENT – ENFORCEMENT
TOOLS
 Appeal of enforcement action
 Impacted contractor/permit holder may appeal
enforcement action to Board of Adjustment
 Decision is final
 Potential changes not intended to prevent permits
for minor construction, to make project/residence
safe or secure, or abate a nuisance

  • 2. SUMMARY  Provides additional requirements for permitting and contractor registration to address issues associated with residential construction projects  Limited number of projects taking too long or abandoned, negatively impacting neighborhoods  Policies seek to encourage timely completion of projects & limit impact of non-performing contractors
  • 3. BACKGROUND  Neighborhoods experiencing abandoned construction projects or projects progressing too slowly  Partially-built projects may pose health & safety hazards, public nuisance  Building code limited in how to address issues or prevent from occurring in future
  • 4. POTENTIAL AMENDMENTS – INTENT  Encourage timely completion of residential projects  Enhance enforcement efforts relating to residential construction in City  Limit beginning other major residential construction if previous project(s) a public nuisance
  • 5. BACKGROUND  Chapter 5 – Building & Building Regulations includes  Adopted building code standards  Building-related requirements involving contractors, permits & inspections
  • 6. AMENDMENT – CONTRACTOR REGISTRATION  Additional contractor & permitting registration requirements  Insurance requirements for contractors  Affidavit submitted in permit application  Proof of contractor registration on site
  • 7. AMENDMENT – ENFORCEMENT TOOLS  Additional enforcement tools  Suspend permits or contractor’s registration for set time period  Person/entity ineligible to receive new residential construction permits
  • 8. POTENTIAL AMENDMENT – ENFORCEMENT TOOLS  Person/entity ineligible to receive any new permit relating to residential construction until followed remedied  Unresolved notice of violation  2 or more stop work orders or notices of violation (w/in past 24 months)  Open or unresolved permits for other residential projects  3 or more – general contractor permits & 6 or more – tradesman permits  Currently indebted to City  Entered guilty or no contest plea or convicted of felony or misdemeanor for violation of building code or local amendment  Convicted for penal offense or suffered civil action judgement for fraud relating to performance of residential building contract  Violation of contractor registration requirements (w/in past 24 months)  Created public nuisance or substandard/dangerous structure
  • 9. POTENTIAL AMENDMENT – ENFORCEMENT TOOLS  Appeal of enforcement action  Impacted contractor/permit holder may appeal enforcement action to Board of Adjustment  Decision is final  Potential changes not intended to prevent permits for minor construction, to make project/residence safe or secure, or abate a nuisance
  • 10. POLICY ANALYSIS Updating registration requirements and enforcement tools strengthens city’s ability to mitigate likelihood of construction-related issues  Safeguard public’s health, safety & general welfare
