Each law tries to overtake other law, when they relate to the same subject. Sometimes there exists lot of overlapping and contradictions in the legal framework. Since India legal system remain bureaucratic and institutional focused under each law, focus of bureaucracy remains to create more laws and more space number for creating institutions and jobs for the bureaucracy. Despite India , as a nation accepting the role and importance of Urban local Bodies in 1972, when 74th Constitutional Amendment Act, was enacted, still states were passing laws in 1996 to create separate/additional/ independent agencies operating in the domain of urban planning, development and management, ignoring to empower urban local bodies to take up that role. Accordingly, state scenario in urban development in the country remains multi-faceted with existence of large number of departments and agencies operating in the urban development, which dilutes the intent of planned and orderly development in human settlements.Prevailing urban development scenario indicates existence of not only large number of urban laws but also large number of urban development agencies. However, there exists concentration of development agencies operating in the large urban areas but these agencies are conspicuous by their absence in the small urban settlements. Our capacity to create rational, effective, efficient, compact planning framework and agencies for effectively implementing of planning framework, will hold the key for future planned growth of urban settlements .Write-up focuses on the State of Punjab which has put in place a legal regime providing for promoting comprehensive and integrated development of urban and rural area through the preparation of Regional Plans and Master Plans in 1996 . In the year 2006, the entire set of provisions regulating the preparation of Regional Plans and Master Plans were critically reviewed, rationalized, simplified and modified drastically to streamline the procedure by making amendments eliminating/ minimizing number of vital steps involving public participation, involving urban local bodies; printing existing landuse plans etc. First master plan came into operation in 2006, after a decade of launching the Act. Till now more than 35 cities have bbeen covered unde such plans out of 216 urban settlements recorded in 2011 census.

A Slum, for the purpose of Census, has been defined as residential areas where dwellings are unfit for human habitation by reasons of dilapidation, overcrowding, faulty arrangements and design of such buildings, narrowness or faulty arrangement of street, lack of ventilation, light, or sanitation facilities or any combination of these factors which are detrimental to the safety and health.

Smart Cities: Smarter Solutions for better tomorrowResurgent India
It is estimated that by 2030, 40% of India’s population will be living in urban areas and contributing 75% of GDP. On account of the ongoing rural-to-urban migration, an estimated 400 million people are expected to migrate to cities over the next 15 years.

The 35-page blue print includes various suggestions on operational procedures, approval process for proposals, nature and extent of Central Government support on financing, capacity building, which would be useful for further discussions.
It outlines in detail about the several facilities that would be developed in smart cities including reliable utility services,efficient social infrastructure and a smart transport system, which would restrict the travel time within the city to 30 to 45 minutes, 100 per cent coverage of road network with storm water drainage network and 100 per cent access to toilets.
All smart cities will need to have a master plan valid for the next 10 years in addition to having digitised spatial maps, regularly updated open data platforms, amongst other benchmarks specified in the Annexures of the concept note.
Physical infrastructure such as the urban mobility system, the housing stock, energy system, water supply system, drainage system, solid waste management and sewerage system etc will have to be integrated through the use of geospatial technology.
Universal access to electricity and water 24 X 7 will be a given.
The municipal offices will have to be fully automated so that citizens have the ability to seek and the municipal offices the ability to deliver services in real time, through IT based facilities.
In terms of social infrastructure, good and high quality education, healthcare and entertainment services are essential.
Adoption of energy-efficient and environmentally benign practices in the use of building material, transport system, sewerage and water supply systems, street lighting, air-conditioning systems and energy consumption in buildings will be non-negotiable.
The document also states that a city having a population of up to 40 lakh or more, cities of tourist and religious importance and select cities which have a population of less than 10 lakh and all state and union territory capitals will get an opportunity to nominate a satellite city for the “Smart City” project.
“In Delhi, it is being proposed that DDA will develop a new smart city through the land pooling scheme as a demonstratively and the NDMC area may be considered for demonstrating all the components of smart cities,” the note says.
While a strong citizen participation in decision-making will be crucial for smart cities, a principle of ‘governance by incentives rather than governance by enforcement’ has to be adopted.
A national urbanization policy would be crucial for guiding the national government financial support to smart cities.
The release of concept note is followed by a National Conclave of States and Union Territories, which is being held on Friday, September 12 to invite suggestions on the blue print.

Accordingly, cities are being misused, abused and manipulated, to serve the personal interests, ignoring the larger public interests and interests of the stakeholders / residents. Indian cities galore with multiplicity of laws and multiplicity of agencies operating , working invariably at cross purposes . Quality leadership is conspicuous by its absence. Manpower involved with the management of the cities has little capacity, understanding and expertise in dealing with the challenges faced by cities. The administrative, planning and development capacity is totally lacking in manpower / resources. So cities and residents are suffering . There exists little commitment to put urban governance on higher pedestal of quality, performance, effectiveness and efficiency. McKinsey Global report has outlined three- pronged strategy to make cities great places to live and work involving Achieving Smart Growth; Doing More with Less and Winning Support for a Change. Despite the fact that role of urban local bodies remains vital in urban governance and 74th Constitution Amendment have put them on the pedestals of government in their own right ,but their structure ,resources ,culture/capacity in the area of urban governance remains marginalised. Growing size, population and complexities of the problems and challenges make the task all the more difficult/challenging .Good urban governance should involve; improving capacity to govern ; improving institutional, technical, administrative and political capacities; making available skilled manpower; providing Sufficient resources and quality manpower; incentivising good performance ; reviewing/rationalising legal framework ; defining Unified law; promoting fruitful partnership between state/ local bodies; creating grievances redressal cells ; involving communities ; disseminating examples of good governance; to fulfil the vision of a planned, healthy, productive, sustainable, liveable and efficient urban settlement in years to come.

Standing in for Mr Arun Jaitley, Finance Minister (FM), Piyush Goyal presented the Union Budget of India earlier today. Highlighting achievements of various Government schemes, Mr Goyal stated that the Government led by Prime Minister Modi has been the most decisive and transformational in executing structural reforms.
Focused on rural and inclusive development over the next 5-10 years, the Budget included significant announcements ahead of the General Elections while also outlining ten dimensions of the Government’s Vision for India’s development by 2030. The launch of, “Pradhan Mantri Kisan Samman Nidhi (PM-KISAN),” which aims to supplement rural income, captured the limelight of this year’s budget. The middle class has also benefited with higher gratuity, broadening of the tax-exempt bracket and waivers on income tax on notional rent. A mega pension scheme for workers in the unorganised sector was also announced along with health coverage under the ‘Ayushman Bharat’ scheme.
The Government has budgeted for overall expenditure of INR 27.8 trillion in 2019-20, an increase of 13% over the previous year’s estimates, while targeting a fiscal deficit of 3.4% in 2019-20 and 3% in 2020-21.

2. WHAT GOVERNMENT BELIEVES ?
Recognizing the fact that by 2050, 49.7 crores
people will migrate to urban areas, the Central
government launched the Jawaharlal Nehru Urban
Renewal Mission to provide basic civic facilities in
63 cities. The government has also approved a
master plan to build seven new cities, in addition
to the ongoing Delhi – Mumbai Corridor project.

7. HOW THEY IMPLEMENTED?
• India will have to ensure that cities have the financial capacity to fund their
needs. Currently India’s urban spending lags behind international standards
by a huge margin. Over the next 20 years, India needs to allocate $1 trillion
to operating expenditure and $1.2 trillion) to capital expenditure. While the
former can be covered by increasing property tax and user charges, a mix of
three additional revenue streams is recommended to fund capital
investments (a) monetizing land assets (b) formula-based government
funding (c) tapping into debt markets and PPPs. The potential contribution of
each source is estimated at $58, $43, $26 (=$127) pc pa respectively.
Funding
• India will need a system of governance customized for the metropolitan level
to manage cities larger than some countries. The only G20 country without
an elected or empowered mayor, India must encourage substantial
devolution of powers from the state. Although the 74th Amendment has
given the green signal, it still needs to be implemented. As cities encroach
upon multiple municipalities, a single authority is needed for greater
accountability. A first step is the modified mayor-commissioner system built
on the Kolkata model. The quality of city leadership must be improved and
governance must be separated from service delivery. This can be achieved
through outsourcing key services (housing, transportation, water and
sewage) to corporatized agencies such as BEST in Mumbai.

• India will have to build planning capacity and introduce modern planning
technologies such as GIS mapping and traffic modeling. To delineate the roles
of the various government institutions involved in the planning process,
Metropolitan Planning Committees (MPCs) should be empowered to create
statutory metropolitan plans binding on municipalities. Cascaded time plans
with appropriate content can be developed by basing land-use, infrastructure
and social planning on 20-40 year econometric forecasts. Finally, enforcement
mechanisms must be tightened and project exemptions be made transparent.

•India will have to target policies for the development of key urban sectors
including transportation, affordable housing, employment and environment
sustainability. Failure to do so would result in further deterioration in quality of
urban life from present levels. The approach to developing a comprehensive
set of sectoral policies is illustrated through two examples: creating a stock of
affordable housing to prevent slum proliferation and reducing GHG emissions
to mitigate climate-change. The role of the government is highlighted in
correcting market failures, for instance, in recommending that the state
subsidize housing for the estimated 38 million who will not be able to afford a
house at market price in 2030.
Sectorial
politics
•Finally, India should actively try to ‘shape’ its future cities in line with its
diversified economic portfolio. The report recommends a distributed model so
that a large number of cities with a variety of size and type can develop
simultaneously. For instance the largest Tier 1 cities should be renewed to
drive sustained growth in high value added sectors like finance and real estate.
New world class cities can be built but will be viable only if built in their
proximity. Tier 2 cities should be developed with a view to avoid the mistakes
of Tier 1 cities. Tier 3 and 4 cities should be developed as specialist cities
specializing in an anchor sector like tourism, mining etc. Good connectivity
between inter-regional clusters will encourage future urbanization along the
transport corridors.

9. SOLUTIONS
Following the above recommendations will not only improve the quality of urban
services but also boost India’s GDP by 1-1.5%. Effective planning will save over 6
million hectares of potentially arable land. GHG emissions can be abated by 28%. On
the other hand, if India leaves its cities to their organic fate, consequences can be
disastrous. Water supply (basic standard 150L per capita per day) will drop from 105L
to 65L; 70-80% of sewage will be left untreated; private cars will increase six fold and
the average journey could last five hours in peak traffic.
However, even in such an ambitious financial model, Tier 3 and 4 cities will still need
additional assistance, a policy measure that government programmes like JNNURM
should incorporate immediately.
However the impact of the recommendations is ambiguous on some issues. Although
the report estimates that 200 million rural inhabitants living near cities will benefit, it
does not provide numbers of those who will be displaced. The report claims that
incomes will rise but whether this will be a real increase in income depends on the
corresponding rise in cost of urban living. The real increase in wages may not be as
substantial given the significant proportion of property tax, user charges and debt
financing in the funding model. Although the economic costs of service delivery are
lower in cities, the environment costs are significantly higher. Apart from an
incomplete cost-benefit analysis on such issues, the report is extremely rich in data
which is no less proficiently presented.
