Procures insurance for buyer 
Legal duty to represent buyer’s best interest 
Must disclose commissions to buyer 
Marsh (broker) was steering clients to favorite insurers (especially AIG and ACE) 
Evidence of bid rigging 
Broker also received “service fee” for creating customized policies, handling premiums, etc. 
Spitzer felt this was misleading the client, since broker already received a commission for service 
Broker also got, after year end, a bonus override commission from the insurer that was not disclosed to client

38 year old woman with Stage IV breast cancer 
Denied a high-dose chemo/bone marrow transplant procedure by her HMO, Health Net 
Said it was experimental and not a proven treatment 
Raised $212,000 and got treatment, but died at 40 
Trial showed 
Health Net had end-of-year profit sharing for doctors to avoid high-dollar procedures 
Health Net had approved the procedure for two other women previously, both of whom survived (and testified) 
Jury awarded $89 million verdict (not really a lot for a $2 billion company 
Settled for undisclosed amount, estimated to be $5 million
