Introduction to HSE
What is Safety :
 The condition of being safe. Free from danger, risk, injury and damage to property.
What could go wrong:
If you are not thinking about what could go wrong every day, all day, while you work, you are not going to be
completely safe.
Always take a moment and think of this and ask yourself:

Section 31. Functions of safety and health committee.
What does Section 30 says:
Every employer shall establish a Safety & Health Committee (SHC) at the place of work in accordance with
this section if :-
 40 or more persons employed at the place of work or
 The Director General directs the establishment of such a committee at the place of work
OSHA 1994 – with regards to Safety and Health Committee
Section 30. Establishment of safety and health committee at place of work.
(1) Every employer shall establish a safety and health committee at the place of work in accordance with this section if-
(a) there are forty or more persons employed at the place of work; or
(b) the Director General directs the establishment of such a committee at the place of work.
(2) The composition of a safety and health committee established under subsection (1), the election or appointment of
persons to the committee, the powers of the members of the committee and any other matter relating to the
establishment or procedure of the committee shall be as prescribed.
(3) Every employer shall consult the safety and health committee with a view to the making and maintenance of
arrangements which will enable him and his employees to co-operate effectively in promoting and developing measures
to ensure the safety and health at the place of work of the employees, and in checking the effectiveness of such
measures.
(4) A person who contravenes the provisions of this section shall be guilty of an offence and shall, on conviction, be
liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding six months or to both.
OSHA 1994 – with regards to Safety and Health Committee
Section 31. Functions of safety and health committee. The safety and health committee established at a place of work
pursuant to section 30-
(a) shall keep under review the measures taken to ensure the safety and health of persons at the place of work;
(b) shall investigate any matter at the place of work-
(i) which a member of the committee or a person employed thereat considers is not safe or is a risk to
health; and
(ii) which has been brought to the attention of the employer;
(c) shall attempt to resolve any matter referred to in paragraph (b) and, if it is unable to do so, shall request the Director
General to undertake an inspection of the place of work for that purpose; and
(d) shall have such other functions as may be prescribed.
OSHA 1994 – with regards to Safety and Health Committee
The “Occupational Safety and Health Act amendment 2022” has made it mandatory for workplaces with forty or more
employees to have a Safety and Health Committee. Following that and in order to ensure a clear understanding of the
section 30 and 31 , Occupational Safety and Health (Safety and Health Committee) Regulations 1996 was promulgated
and these had been enforced effective January 1, 1997.
Occupational Safety and Health (Safety and Health Committee) Regulations 1996
Safety and health committees provide a way for management and workers to
meet regularly to discuss workplace health and safety issues. They are an
important way to bring together worker’s practical knowledge of jobs and
management’s overview of the workplace and work organization.
WHY do we need a Safety and Health Committee.
To bring workers and management together in a non-adversarial,
cooperative effort to promote safe and healthy environment in
the workplace

Safety and Health Committee membership
 Assist in the development of safety and health rules and safe system of work
 Review the effectiveness of safety and health programs
 Carry out studies on the trends of accident, near-miss accident, dangerous occurrence, occupational
poisoning/disease which occurs at workplace and shall report to the employer of any unsafe or unhealthy
condition/practices at the workplace together with recommendation for corrective actions
FUNCTION OF SAFETY AND HEALTH COMMITTEE
 Review the safety and health policies at the workplace and make recommendations
to employer for any revision of such policies
 Inspect the work place at least once in every three months and recommend
preventive and corrective measures
 Discuss report and matters from safety officer, enforcement officers, etc.
 Practices and recommend corrective actions
 Assist to organize promotional activities

 Regularity and frequency of meetings

FUNCTION OF SAFETY AND HEALTH COMMITTEE

Most accidents are caused by unsafe acts.
WE work hard to create a safe workplace and a holiday destination for all.
• BUT what about our employees' own unsafe behavior?
• If you examined all the accident records in any organization, you will find that the root-cause of 98%
of the accidents was due unsafe acts rather than unsafe conditions.
• If you read between the lines of the accident reports, you might find that the workers involved in the
incidents had become complacent about safety.
• They have gone on "autopilot" and stopped paying attention to what they were doing or
suppose to do.
• They have taken shortcuts.
• They have taken risks.
They have developed an "It won't happen to me" attitude.
