8. Boiler and Pressure Vessel
Insurance Policy
The following terms, when used in this Policy, shall have the under
mentioned meanings:
Boiler: shall mean any fired closed container or a combined container
piping system in which steam is generated under pressure. When used in the
Schedule, the term “boiler” shall include fittings, built-in Super heaters and
economizers
Vessel: shall mean any unfired closed container under steam or air
pressure.
9. Boiler and Pressure Vessel
Insurance Policy
Explosion” shall mean the sudden and violent rending or tearing
apart of the structure of a boiler or vessel, or any part or parts thereof
by force of internal steam, air or fluid pressure, causing bodily displacement
of said structure accompanied by the forcible ejection of
its contents.
“Collapse” shall mean the sudden and dangerous distortion of any part of
a boiler or vessel caused by the crushing stress of external steam or fluid
pressure, whether attended by rupture or not; it shall not mean any slowly
developing deformation due to any cause.
10. Why Boiler and Pressure Plant Insurance?
To covers damage other than by fire, to boilers & pressure plant,
damage to surrounding property, Third Party legal liability arising due
to explosion and collapse of the boiler/ pressure plant during its
normal course of working.
11. What is Covered?
This Policy covers boiler & pressure vessels owned by you and located at your premise
against explosion, implosion and collapse leading to:
•damage to the boilers & pressure vessels;
•damage to surrounding property, up to fixed limits, arising due to explosion &
collapse of the pressure plant during normal course of working; and
•third party legal liability, up to fixed limits, arising due to:
•death or bodily injury to third parties;
•damage to property of third parties (not held in trust or on commission) caused by
and solely due to explosion or collapse occurring in the course of ordinary working.
12. Covered on Payment of Additional Premium?
You may extend your policy by paying additional premium. Major optional
extensions available are:
•express freight;
•air freight;
•owners surrounding property;
•third party liability; and
•additional custom duty
13. Not Covered (Exclusion)
This policy does not provide coverage for loss or damage resulting from:
•fire, lightning, inundation, flood, storm , earthquake, subsidence, landslide,
chemical explosion, burglary and theft, impact by land borne/water borne craft;
•wear and tear, faults or defects existing at the time of commencement of
insurance which ought to have been or were known to you, faults or defect for
which the supplier is responsible either by law or under contract;
•war or warlike operations, nuclear reaction, radiation or radioactive
contamination;
14. •loss, damage or liability resulting from overload experiments or tests;
•the failure of individual tubes in boilers of the water tube locomotive or other
multi tubular types, in super heaters or in economizers;
•willful acts or gross negligence on the part of you or your representatives;
•loss of use of the Insured's plant or property or any other consequential loss
incurred by the Insured; and
loss or damage for which the manufacturer or supplier or repairer of
the property is responsible either by law or under contracts
Not Covered (Exclusion)
15. Warranties
It is hereby warranted that during the currency of the Policy;
The Boiler and Pressure Plants described in the Schedule are annually
inspected by Inspectors appointed by the appropriate Government
i) The Boilers and Pressure Plants described in the Schedule shall only be
operated by Attendants holding a valid certificate of competency issued
under the appropriate Boiler Act;
ii) The Insured shall be in possession of the unqualified permission in
writing of the competent Inspecting Authority to operate the said Boilers and
Pressure Plants. Other wise Insured shall not be entitled to any
compensation or indemnity under this Policy in respect of such explosion or
collapse.
16. 1. The Insured shall at his own expense take all reasonable precautions To prevent
loss, damage or liability and shall comply with manufacturers’ recommendations.
2. The Insured shall immediately notify the Insurers by telegram and in writing
of any material change in the risk and cause at his own expense such additional
precautions to be taken as circumstances may require
3. In the event of any occurrence which might give rise to a claim under this
Policy, the Insured shall immediately notify the Insurers telephone or
telegram
4. No admission, offer, promise, payment or indemnity shall be made or given
by or on behalf of the Insured without the written consent of the Insurers who
are entitled
Conditions
17. 5. This Policy may be terminated at the request of the Insured at any time,
6. If a claim is in any respect fraudulent, or if any false declaration is Made, all
benefit under this Policy shall be forfeited.
7.Whenever a claim arises under this Policy and the same loss, damage or
liability is covered by any other insurance, the Insurers shall not be liable to pay
or contribute more than their rate able proportion of any claim for such loss,
damage or liability. The Insured shall be obliged to inform the Insurers of any
other insurance covering the same insured property.
Conditions
18. Claims Handling
It shall be a requirement of this Policy that the sum insured for each boiler and
pressure vessel is equal to the cost of replacement by a new item of the same
kind and capacity,
which means its cost of replacement including, e.g., freight, dues and custom
duties,
If the sum insured is less than the amount required to be insured, the Insurers
shall pay only in such proportion as the sum insured bears to the amount
required to be insured. Every item if more than one shall be subject to this
condition separately.
19. a) In cases where damage to an item can be repaired - the Insurers shall pay
expenses necessarily incurred to restore the damaged machine to its former
state of serviceability plus the cost of dismantling and re-erection incurred for
the purpose of effecting the repairs, as well as ordinary freight to and from a
repair shop, customs duties and dues.
b) No deduction shall be made for depreciation in respect of parts replaced,
but the value of any salvage shall be taken into account.
Basis of Indemnity
c)In cases where an insured item is destroyed - the Insurers shall pay the actual
value of the item immediately.
20. d) Any extra charges incurred for overtime, night work, work on public holidays,
and express freight shall be covered by this Policy only if especially agreed in
writing.
Basis of Indemnity
e)The cost of any provisional repairs shall be borne by the Insurers The
Insurers shall make payments only after being satisfied by production of the
necessary bills and documents that the repairs have been effected or
replacement has taken place.
f) The cost of any alterations, additions, improvements or overhauls shall not
be recoverable under this Policy.
21. Inspections
All the plant described in the Schedule shall be inspected within the statutory
periods by inspectors authorized by the appropriate authorities.
Boiler Attendant
The said boilers shall only be operated by attendants holding a valid certificate of
competency issued under the appropriate Boiler Act.
22. DUTIES of an insured
In the event of any occurrence which might give rise to a claim under this Policy
the Insured shall -
a) Immediately notify the Company by telephone or telegram as well as writing
giving an indication as to the nature and extent of loss or damage.
b) take all reasonable steps within his power to minimize the extent of the loss or
damage or liability.
c) preserve the damage or defective parts and make them available for inspection
by an official or surveyor of the Company.
d) Furnish all such information and documentary evidence as the Company may
require.
23. DUTIES of an insured
The company shall not be liable for any loss or damage of which notice and
completed form has been received by the Company within Fourteen days of its
occurrence
Upon notification of a claim being given to the company the Insured may
proceed with the repair of any minor damage not exceeding Rs. 2,500/-
The liability of the Company under the Policy in respect of any item of property
sustaining damages, for which indemnity is provided, shall cease if the said
item is kept in operation without being repaired to the satisfaction of the
Company.
24. OTHER INSURANCE –
If at the time any claim arises under this Policy there is any other insurance
covering the same loss, damage or liability, the Company shall not be liable to
pay or contribute more than its rate able proportion of such loss, damage or
liability.
TRANSFER OF INTEREST –
The Insurance granted by this Policy shall cease to attach to any items described
in the Schedule the interest in which shall pass from the Insured otherwise than
by will or operation of law unless the consent of the Company for the
continuance of the insurance shall be obtained and signified by endorsement
hereon
25. TERMINATION OF INSURANCE –
This insurance may be terminated at any time at the request of the Insured in
which case the Company will retain the premium calculated at the customary
short period rate for the time the Policy has been in force. This insurance may
also at any time be terminated at the option of the Company by 15 days notice to
that effect being given to the Insured, in which case the Company shall be liable
to repay on demand a rate able proportion of the premium for the unexpired
term from the date of the cancellation.
26. Arbitration
If any dispute or difference shall arise as to the quantum to be paid under
the Policy (liability being otherwise admitted) such difference shall
independently of all other questions be referred to the decision of a sole
arbitrator to be appointed in writing by the parties thereto or if they
cannot agree upon a single arbitrator within 30 days of any party invoking
arbitration the same shall be referred to a panel of three arbitrators,
comprising of two arbitrators, one to be appointed by each of the parties
to the dispute/ difference and the third arbitrator to be appointed by such
two arbitrators and arbitration shall be conducted under and in
accordance with the provisions of The Arbitration and Conciliation
Act,1996.
