Завдання моєї презентації включають: По-перше: п оказати актуальність теми сертифікації продуктів харчування з географічним зазначенням в Україні По-друге: Обговорити результати дослідження “Оцінка потенціалу якісних продуктів харчування з прив’язкою до місця походження та попиту на них в Україні” Це дослідження проводилося нашою міжнародною благодійною організацією “Добробут громад” (колишня назва - Міжнародна Благодійна Фундація «Хайфер Проджект Інтернешнл») за підтримки Продовольчої та сільськогосподарської організації ООН - ФАО. Дослідження проводилося в 2010 р. По-третє, нами проведено порівняння українського законодавства та законодавства Євросоюзу, щоб визначити основні напрямки для гармонізації українського законодавства в галузі сертифікації продуктів харчування з географічним зазначенням І нарешті, презентація мала ще одне завдання, а саме - запропонувати наступні кроки щодо вдосконалення державної політики та ширшого запровадження сертифікації продуктів харчування з географічним зазначенням в Україні
Тема сертифікації продуктів харчування з географічним зазначенням є хоч і все ще новою, але досить важливою для розвитку сільських громад України. Це можна обґрунтувати на основі того, що: Важливе значення має запозичення позитивного досвіду зарубіжних країн щодо сертифікації та захисту продуктів харчування з географічним зазначенням. Ці країни успішно проводять таку сертифікацію вже багато років. Перспективність теми було показано нашою організацію в результаті дослідження попиту та пропозиції в Україні на продукти харчування, що мають потенціал бути зареєстрованими як такі, що мають географічне зазначення. Окрім того, в Україні вже є певне правове підґрунтя для подальшого розвитку теми – зокрема, у 1999 р. прийнято закон “Про охорону прав на географічне зазначення товарів”. Даний Закон було розроблено й затверджено в процесі підготовки вступу України до Світової організації торгівлі й повністю відповідає положенням Договору TRIPS (Trade-related Aspects of Intellectual Property Rights), яке регулює міжнародну торгівлю товарами, що захищені інтелектуальною власністю й надає правову охорону кваліфікованим зазначенням походження товарів. Також в Україні діють стандарти якості продуктів харчування, правові норми щодо захисту прав інтелектуальної власності, зокрема на зареєстровані географічні зазначення. Після вступу України до СОТ, однією з вимог цієї організації є забезпечення захисту зареєстрованих географічних зазначень в Україні. А для цього необхідно забезпечити адаптацію в Україні правових норм інших європейських країн, що мають позитивний досвід реєстрації географічних зазначень.
В Україні розвиток продуктів та просування їх на ринок як таких, що мають захищену географічну назву, є дуже повільним, не зважаючи на те, що закон про Захист прийнято ще 10 років тому в рамках гармонізації законодавства України до вступу в СОТ. Зумовлено це цілим рядом факторів: - Низька поінформованість громадського та державного сектору, товаровиробників про можливості розвитку регіональних продуктів, суспільні та економічні переваги - Високий рівень глобалізації та уніфікації виробничих процесів в харчовій промисловості та сільськогосподарському виробництві. - Недосконалість нормативно-правової бази, що регламентує захист географічних зазначень та необхідність її гармонізації відповідно до законодавства Європейського Союзу. Основним напрямком є розробка системи специфікації товарів та контролю за дотриманням умов виробництва відповідно до специфічних властивостей продукту.
Перш ніж, переходити до аналізу результатів дослідження, проведеного нашою організацією, важливо зрозуміти, які переваги дає реєстрація продуктів з географічним зазначенням. Як показує досвід інших Європейських країн, розвиток системи захищених назв походження та географічного маркування дозволяє, окрім підтримання різноманіття харчових продуктів, паралельно досягти цілей: економічного розвитку сільських громад, підвищення доходів сільських товаровиробників, сповільнення трудових міграційних процесів села. Окрім того, ця система сертифікації задовольняє очікування споживачів, котрі все частіше звертають увагу на якість харчових продуктів, та на їхнє розпізнавальне географічне походження. Усе це можливо досягти в Україні, але лише за умови наближення до стандартів та процедур реєстрації та контролю. Ефективним механізмом розвитку сільських територій є створення та тобто підтримка різноманітності сільськогосподарської продукції шляхом виробництва та популяризації продукції зі специфічними рисами. Зумовлено це тим, що система захисту регіональних та традиційних продуктів має на
Отже, враховуючи велике значення реєстрації продуктів харчування з географічним зазначенням та значний інтерес до цієї теми з боку Проект, що виконувався нашою організацією, мав такі етапи: Спочатку було проведено опитування серед споживачів у 9 областях України та АР Крим . Опитування проводилось таким чином, щоб залучити споживачів, різних за віком та місцезнаходженням. Анкета була розроблена таким чином, щоб виявити потенційні продукти, відомі споживачам кожного регіону, а також продукти, що належать до цієї місцевості або мають особливі властивості, що відрізняють їх від продуктів подібного виду з інших регіонів. Загальна кількість опитаних складала близько 1000 осіб. Це дозволило скласти попередній список найбільш популярних потенційних продуктів в Україні. 2. На наступному етапі проводилося опитування серед виробників , що дозволило уточнити складений список та проранжувати потенціал реєстрації. Також була складена так звана профільна картка – тобто структура бази даних для опису потенційних продуктів харчування, що мають високий потенціал для реєстрації з географічним зазначенням. 3. На наступному етапі були підготовлені рекомендації щодо: - Пілотної реєстрації окремих продуктів та - подальших дій зацікавлених сторін, що мають бути спрямовані на реалізацію потенціалу продукції з географічним зазначенням в Україні.
Як зазначено на карті цього слайду, Дослідження проводилось шляхом анкетування інтерв’юерами в 10 регіонах України: Автономна республіка Крим Вінницька область Донецька область Закарпатська область Київська область Полтавська область Одеська область Львівська область Чернівецька область Херсонська область В цілому в кожному регіоні було опитано 100 чоловік. Анкетування проводилось таким чином, щоб максимально охопити різних споживачів як за віковим складом так і за місцем проживання. Опитування споживачів проходило не в одному місті – обласному центрі, а чотирьох-п’яти районах області, включаючи сільську місцевість
Анкета для опитування споживачів була розроблена таким чином, щоб виявити потенційні продукти, що відомі споживачам кожного з регіонів, як такі що асоціюються з даною місцевістю, або ж мають специфічні властивості що вирізняє їх на фоні аналогічних продуктів. Перелік питань анкети включав в себе відомості не тільки про конкретні продукти, а й визначав рівень обізнаності щодо державного регулювання, репутації таких продуктів, виявлення механізмів які б сприяли популяризації їх в майбутньому, відношення до таких продуктів, рівень сприйняття тощо. Далі було визначено потенційні продукти, в першу чергу ті, що були ідентифіковані споживачами, а також ті, що були визначені інтерв’юерами з другорядних джерел – літератури, представників державних структур та громадського сектору області, а також з власного досвіду. Що стосується опитування виробників , то по кожному з регіонів було опитано від 20 до 40 виробників різних виробників. При цьому до уваги брали не тільки малі та середні виробники, а в деяких випадках і потужні національні компанії. Анкети для виробників мали дати інформацію про продукт та місцевість його походження, його позиціонування на ринку, загальну уяву про поінформованість виробників та виділити проблеми та перспективи у виробництві продукції з географічним маркування.
У результаті опитування споживачів було виявлено, що в цілому, споживачі погано обізнані про географічне походження продуктів харчування, хоча все ж більшість з них : віддають перевагу продуктам зі своєї місцевості; Звертають увагу на якість продуктів та інформацію на етикетках . Усе це відкриває значні перспективи для проведення успішних інформаційних кампаній, орієнтованих на споживачів. Та на активніше просування на ринку продуктів з географічним зазначенням.
Опитування виробників показало, рівень їх обізнаності про реєстрацію географічного зазначення та її переваги є не досить високим. Тільки 7% респондентів-виробників вбачають сприятливу можливість у реєстрації продуктів з географічним зазначенням. 17% виробників готові реєструвати географічне походження свого продукту та маркувати його відповідно до законодавства. Маленька кількість виробників була обізнана з історією традиційних продуктів, які вони виробляють – тільки 1% з них мав хоча б якусь інформацію про історію своїх продуктів. У ході опитування виробників були також виявлені інші тенденції: Регіональні/ місцеві продукти виробляються переважно малими партіями дрібними виробниками. Специфічність регіональних продуктів у більшості випадків залежить від природних умов, які впливають на самобутність та особливі властивості продукту. Більшість місцевих харчових продуктів популярні у місцевості, з якої вони походять і де виробляються. У той же час, більше 28% продуктів вважаються популярними в усій країні. Окрім оригінального смаку, визначальним фактором популярності своїх продуктів виробники вважають високу якість.
Після опитування споживачів та виробників, було проведено остаточний відбір продуктів відповідно до списку встановлених критеріїв. Серед критеріїв: властивості продуктів, їх репутація, територія походження, виробництво (технологія), вплив природних умов на властивості продукту, вплив людського фактору, згадування про продукт у стародруках. Аналіз відповідності критеріям відбору продуктів дозволив визначити найбільш перспективні продукти , що відповідають вимогам щодо специфіки, зумовленої природними чи людськими факторами, притаманним території походження.
Окрім того, важливими критеріями стали такі: вплив природних умов на властивості продукту, вплив людського фактору, Можливості спільних дій груп виробників щодо реєстрації. Аналіз відповідності критеріям відбору продуктів дозволив визначити найбільш перспективні продукти , що відповідають вимогам щодо специфіки, зумовленої природними чи людськими факторами, притаманним території походження.

Наведемо деякі приклади продуктів, які можуть бути в подальшому зареєстровані в Україні з географічним зазначенням . Це зокрема рахівська бринза, ялтинська цибуля, херсонський кавун, яблучний джем з Вінницької області . Ці продукти, крім яскраво вираженої специфіки, що зумовлена природним або ж людськими факторами, мають досить високий потенціал до спільних дій виробників. Вони виробляються дрібними товаровиробниками, зокрема власниками особистих селянських господарств та фермерами, що за відповідних дій могли б консолідувати свої зусилля щодо просування та захисту власного продукту.
Продукти, відібрані згідно з критеріями відбору, були детально проаналізовані на предмет їх придатності для сертифікації з географічним зазначенням ві дповідно до попередньо узгоджених критеріїв . Для опису продукту і складання їх бази даних була розроблена так звана профільна картка, в якій міститься перелік основних характеристик відібраних продуктів. Профільні картки та категорії: Сільськогосподарські харчові продукти, що виробляються дрібними виробниками у малих кількостях; Харчові продукти, що виробляються середніми та великими виробниками (промисловий масштаб виробництва); Традиційні страви. Перш за все рекомендується розробити пілотні проекти для першої категорії продуктів. Згідно з остаточно відібраним списком продуктів, ця категорія може бути представлена рахівською бринзою (сир) та ялтинською цибулею, які мають найвищі показники відповідності критеріям відбору (82%). Якщо їх виробники будуть мати бажання, вони можуть подати заявку на реєстрацію географічних зазначень цих продуктів. Ці продукти не тільки мають особливі якості, обумовлені природними та людським факторами, пов’язаним з географічною місцевістю, де вони виробляються, але також добрі перспективи для колективної діяльності їх виробників. Ці продукти виготовляються головним чином дрібними виробниками, готовими об’єднати свої зусилля для просування та захисту своїх продуктів. Іншими прикладами продуктів, відібраних для остаточного списку, є Київський торт (відповідність критеріям відбору – 55%) та полтавський хлібний квас (відповідність критеріям відбору – 68%). Це класичні приклади продуктів, що виробляються у промисловому масштабі великими промисловими підприємствами, але мають можливість бути визнаними та зареєстрованими як продукти із географічними зазначеннями. У багатьох випадках, ці продукти виготовляються не тільки великими, але і малими виробниками, що прагнуть виробляти популярні регіональні продукти. Згідно з українським законодавством, ці виробники можуть реєструвати географічні зазначення своїх продуктів в індивідуальному порядку або об’єднуючись у спілки. Однак, не рекомендується брати такі продукти, як Київський торт, для пілотних проектів, так як вони стосуються великих (промислових) виробників, а отже: це не принесе зиску для сільських місцевостей; буде важко переконати великого виробника зробити це. Третім прикладом потенційних продуктів із географічними зазначеннями є продукти, що належать швидше до готових страв. Вони вимагають окремої сертифікації в якості регіональних страв. Вони мають досить давню історію виробництва і можуть стимулювати сільський туризм та розвиток відповідних регіонів. Деякими прикладами є молочний продукт колотуха, варення з яблук сорту Донешта, комаровецький малай.
В цілому, профільні картки описують такі категорії продуктів: Сільськогосподарські харчові продукти, що виробляються дрібними виробниками у малих кількостях; Харчові продукти, що виробляються середніми та великими виробниками (промисловий масштаб виробництва); Традиційні страви. Ми вже навели приклади продуктів першої категорії – вони є найбільш перспективними для пілотних реєстрацій та розвитку сільських територій. Проте друга група також може бути цікавою для реєстрації з географічним зазначенн я м, враховуючи їх масштаби виробництва та інтрес дрібніших виробників у регіоні до виготовлення таких продуктів. Прикладом продуктів другої групи є торт київський та Квас хлібний полтавський .
Іншим прикладом є продукти третьої групи – ті, що можна більше віднести до традиційних страв, які мають досить тривалу історію виробництва. На даний час їх виготовлення є дуже обмеженим, можна сказати, лише для домашнього вжитку, або ж із нагоди не чисельних туристичних атракцій власниками садиб зеленого туризму. Проте, на наш погляд, такі продукти за належної промоції могли б із часом бути цікавим прикладом розвитку сільських територій через розвиток зеленого туризму та об’єднання товаровиробників. Як приклад, це Кисломолочний продукт – колотуха , Повидло Донештове та пиріг - Комаровецький малай. Ці продукти вирізняються специфічною рецептурою виготовлення, сировиною (у випадку з повидлом донештовим), а також тривалою історією виготовлення.
Реєстрація продуктів з географічним зазначенням, які виробляються дрібними сільськогосподарськими виробниками, є ключовим напрямком роботи, який дозволяє досягти також цілей розвитку сільських територій через створення робочих місць, збільшення прибутків виробників, збільшення потоку туристів. Окрім того, важливе значення тут матиме об'єднання дрібних сільськогосподарських виробників та планування ними спільних дій. Саме це має стати основою для пілотних сертифікацій.
Як показує досвід нашої організації з розробки та впровадження проектів у сільських громадах, в Україні є громади, що успішно переробляють та просувають місцеві продукти через об’єднання дрібних сільськогосподарських виробників. Наша організація зокрема працює через об'єднання людей в сільськогосподарські обслуговуючі кооперативи, які можуть надавати послуги з переробки та реалізації продукції. Цікавим прикладом Нижнє Селище Хустівського району Закарпатської області. Тут випускається місцева продукція, що має географічну прив'язку, проводяться етнофестивалі для просування продукції.
Не зважаючи на те, що в Україні є певні законодавчі основи для реєстрації продуктів з географічним зазначенням, українське законодавство має ряд суттєвих недоліків та відмінностей від законодавства Євросоюзу. Ці недоліки стоять на заваді широкої реєстрації. Так, в Україні одна особа може подавати на реєстрацію і таким чином реєстрація може належати не території, а окремому виробнику, що корінним чином змінює ідею реєстрації географічних зазначень. Окрім того, в Україні є вимоги попередньої державної експертизи, що ускладнюють процедуру реєстрації. В Україні немає вимоги, щоб виробники розробляли протоколи/ кодекси практики з виробництва конкретного продукту – це могло б стати в нагоді при наступній реєстрації та в процесі контролю Сама система контролю після реєстрації в нашій країні відсутня Виробник отримує реєстрацію на 10 років і ніякого контролю протягом цього періоду не відбувається. Окрім того, сама реєстрація можлива лише державними органами і роль виробників у цьому3 процесі лише як заявників. В українському законодавстві також не чітко визначено окремі терміни, зокрема опис характеристик та репутація.
Наступні кроки нашої держави на шляху розбудови системи реєстрації продуктів харчування з географічним зазначенням мають базуватися на всіх наявних позитивних напрацюваннях та передумовах. Так, існує с истема контролю д ля національних стандартів якості. Державний департамент з питань інтелектуальної власності в Україні має повноваження сертифікації продуктів з географічним зазначенням. Окрім того, на окремих сільських територіях активною є роль місцевих дрібних виробників, які об'єднуються, спільно захищають свої інтереси, проводять спільну переробку та/ або реалізацію. Це створює можливості для розвитку сільських територій.
На шляху просування продуктів з географічним зазначенням є також інші бар'єри, окрім законодавчих недоліків, подолання яких має лягти в основу наступних планів дій. Серед цих бар'єрів – низька обізнаність як виробників, так і споживачів із концепцією географічного маркування, відсутність ланцюгів постачання традиційних місцевих продуктів, висока вартість просування свої продукції дрібними виробниками. Ці проблеми можуть вирішуватися через об'єднання виробників та інформаційні кампанії.
Загалом наразі розвиток географічного маркування в Україні має також передбачити активнішу передачу окремих функцій в цьому процесі об'єднанням виробників. Актуальним також є вдосконалення та гармонізація нормативно-правової бази щодо захисту географічних зазначень із законодавством Європейського Союзу, а також розробка системи специфікації товарів та періодичного контролю (сертифікації) за дотриманням умов виробництва відповідно до специфічних властивостей продукту. Практична значимість проблеми розвитку продуктів із географічною індикацією обумовлює актуальність подальшого дослідження всієї сукупності складових і потенціалу сільських територіальних громад у контексті виконання національних програм із питань розвитку села й підвищення прибутковості аграрного виробництва.
