INTRODUCTION: In this reflection paper, I will be discussing the R v Mann case.
In this case, the specific issue from that judgement I wish to address is whether race
is necessary to acknowledge in the dimensions regarding the police detention
practices. This reflection paper will first acknowledge how the Supreme Court of
Canada could have factored in raceinto its analysis in R v Mann. Next, the paper
will examine the case through the lens of the Critical Race Theory (CRT) and
cultural competence to help better understand the issue of race. I will then conclude
my paper with a brief discussion of the next steps to address where to go from here
regarding the issue of race.
REFLECTION:
This topic is of great interest to me because I was fortunate enough to grow up in a
community, surrounded by five First Nations reserves. I chose this case because in
my community, an RCMP officer pled guilty to assault causing bodily harm to an
Indigenous man and abandoning him 10 kilometres outside of town. Similar to the R
v Mann case, race was also neglected from the case in my community.
R v Mann established that a police officer must have reasonable grounds when
stopping and detaining a particular individual for investigation. However, I disagree
with the court failing to adequately address the racial dimensions as I believe the
Supreme Court of Canada could have used systematic racism to explain why the
officer reacted in such a manner into its analysis in this case. Race was prevalent to
the arrest of Mann because Mann was stopped based on the fact that he had matched
the race of the known suspect. Significantly, race was a dominant part of the
description, mostly since the clothing he was wearing was inconsistent with that part
of the suspect s description. Though, the problem is that given our history of overt
and systemic racism, race often unconsciously becomes the dominant part of the
description used by police. Whether or not the police officers are heavily relying on
their intuition, does not negate that those intuitions can be influenced or distorted by
unconscious racism.

At an early age many children are oblivious to issues in society like race relations,
and they are easily influenced by their parents. The book Coming of Age by Anne
Moody, takes place during the civil rights era in the United States. All of the white
children stop playing with Anne after an incident in at the movie theater. These kids
were influenced by their parents who didn t want them interacting with African
Americans. Anne Moody s learns about the significance of racein American social life
as well as the differences between the lives of blacks and whites through her
experiences at home, school and work. These experiences help prepare Anne to
join the civil rights movement. At home, Anne experienced firsthand the poverty
many African Americans faced, she experienced discrimination and intimidation
in the work employer Mrs. Burke and at the diner by white customers, and she also
dealt with segregated schooling. Through her life at home Anne Moody
experienced poverty and understood the differences between the lives of blacks
and whites. Anne spent a large majority of her child in extreme poverty, having to
work after school to help provide for her family her mother was a maid for white
women, but her income was not enough to buy food and clothes for Anne and her
sister. Food in the book was a key distinction in status of whites and blacks. On
most days they would only eat bread and beans and on a good day they thrived off
of milk, peanut butter or table scraps from the white families they worked for.

problems in relationships, so esteem has little to do with who stays together or

Sweatshops benefit many developing countries as they provide opportunities of
employment to the people living in poverty and benefit the community at large by

their tax base. These institutions first came into existence in the early 1800 s and
were referred to as dwelling houses, which were local factories that generally had the

Lowell Mills was a company that used this ideology to it s full potential. The
