Segregating students based on race, gender, ethnicity is no different than segregating
students based on a disability. Two other cases laid the way for developing rights for
students with disabilities: Pennsylvania Association for Retarded Children v.
Pennsylvania and Mills v. Board of Education. Both cases ruled in favor of the
student not being excluded from public education. From here the Education for All
Handicapped Children Act of 1975 (EAHCA) was enacted. This was to guarantee
access to public education with federal funding being given to states that assured all
