Overall, “healthcare professionals are held to the prevailing standard of care required in their profession, which include proper assessments, reassessments, diagnosis, treatment, and follow-up care” (Pozgar, 2016, p. 292). Due to high standards and expectations such as this, hospital administrators must be ready to assume responsibility when necessary, and work diligently to educate staff. Overall, there are many legal and ethical issues within this spectrum. A current legal issues faced by hospital systems is HIPAA and data breaches (Becker’s Hospital Review, 2011). Due to the shift from hard copies of records to electronic record, there is a rise in the breach of personal data. Sharing electronic information between systems also increases the potential for more security breaches, directly impacting the patients served by hospitals and health systems (Becker’s Hospital Review, 2011). As a result of data breaches, lawsuits inevitably occur costing hospitals millions of dollars. One such case occurred in Maryland in 2011, and cost Cignet Health $4.3 million (Becker’s Hospital Review, 2011). While many benefits exist to using electronic sharing, there are also great risks and legal issues that can derive from it as well. Another legal issue, and potentially the most common, is medical malpractice. When a patient feels they have been injured by their physician, they have the right to sue (Sabatino, 2017). While this may seem like a legal issues for the physician, and not the hospital, it can quickly become the hospital’s issue. Many cases like this result in a lawsuit against a hospital or health care system, who back their physician. Malpractice can include inappropriate treatments, unnecessary mistakes in surgeries, inappropriate transfers, and inappropriate discharge (Pozgar, 2016). These mistakes can directly cause or lead to the causation of personal injury in the patient, therefore resulting in legal issues. Many cases of medical malpractice are dismissed or found to be erroneous; however, as a hospital administrator there is the added pressure of protecting the image and reputation of the hospital or health care system. The normative ethical theory for each profession arises from the purpose of the profession. The values and norms of the nursing profession, therefore, provide the foundation and filter from which ethical decisions are made. The nurse-manager, however, has a different ethical responsibility than the clinical nurse and does not have as clearly defined a foundation to use as a base for ethical reasoning. In addition, because management is a discipline and not a profession, its purpose is not as clearly defined as medicine or law; therefore, the norms that guide ethical decision making are less clear. Instead, the organization reflects norms and values to the manager, and the personal values of managers are reflected through the organization. The manager’s ethical obligation is tied to the organization’s purpose, and the purpose of the organization is linked to the function that it fills in society and the constraints society places on it. So, the responsibilities of the nurse-manager emerge from a complex set of interactions. Society helps define the purposes of various institutions, and the purposes, in turn, help ensure that the institution fulfills specific functions. Healthcare administrators have a responsibility to always conduct business with ethical integrity (Morrison & Furlong, 2014). A vast majority of ethical issues within the healthcare delivery system occur at the clinical level. The clinical level is where healthcare products and services are provided to individuals who are in need. Areas of ethical concern that result at the clinical level include treatment termination, patient autonomy, informed consent, confidentiality, and advance consent (Morrison & Furlong, 2014). There are guidelines for treatment termination that exist and are based on case law. Such guidelines are derived from clinical and legal practices and other ethical decision-making principles. Patient autonomy is the rejection of recommended medical treatment. Patients have the right to choose other alternatives that are medically appropriate but may be against medical advice. However, issues arise when inappropriate treatment is demanded by patients and/or their representatives. Healthcare providers are responsible for obtaining informed consent prior to providing patients with healthcare services. In essence, informed consent is the treatment permission that providers must obtain from their patients before they can treat them. There have been several cases where providers have neglected to obtain the necessary treatment consent, which raises ethical concerns. Adherence to patient confidentially is a major ethical concern in clinical practice. Although patient health information should remain private at all times, inappropriate disclosure of private health information has been released without patients’ consent. As a result, in 1996, the federal government implemented the Health Insurance Portability and Accountability Act (HIPPA), a law designed to restrict access to patients’ health records. Advance directives, also known as living wills, can create ethical concerns when they are not adhered to by providers or patient representatives. They are considered legal documents that contain information regarding patients’ medical treatment when they are unable to communicate their desires due to a medical condition.
