8. SUMMARY OF EXPERIENCE :
Arul Nathan, has forty (40) years of broad based but "Hands -On " International experience
across three continents, Europe, Asia / Middle East and Africa involving major infrastructure
projects, including 12 years in railway related projects . Most recently over the past 4 years, he
is holding the position of Independent Consulting Engineer’s (ICE) Director of Contracts &
Commercial for KVMRT project, worth RM 23 Billion / USD 6.7 Billion.
A Chartered Civil/Structural Engineer by profession with a strong commercial knowledge in
design and build contract environment (FIDIC) combined with MBA training in Finance. Having
worked for leading international companies in international turnkey contracting, consultancy
and development fraternity, in a fiercely competitive lump sum, fast track environment, he has
firsthand experience and strong knowledge of Design, Construction and Contract
Administration of multibillion US dollars Railway/Metro projects.

Besides, his international experience, has equipped him with the ability to handle and motivate
multi-national work force and liaise closely with clients, at times in challenging environments,
cutting across linguistic and cultural barriers - "People's Skill". He is an effective
communicator, in both, written and spoken English and able to handle complex commercial
and contractual claims and final accounts negotiations.
Broadly categorized discipline by discipline, work experience to date:
Over fifteen (15) years, were spent in railway and highway related projects both in the UK and
Malaysia. In the UK, where he started his career in Eastern Road Construction Unit, he
designed and supervised a section of the M11 Highway, London to Cambridge, which led to
his achieving Chartered Engineer's status.
In Malaysia firstly he started as Senior Consultant on KL Sentral, Transportation Oriented
development, worth over RM1.0 billion (USD300 Million), employing over 3,500 personnel.
This was followed by more senior assignment as Chief Operating Officer and Commercial
Manager of the Project Management Company (PMC) handling brownfield construction of
Electrified Double Track Railway Project between Rawang to Ipoh (180km). The lump sum
awarded price of the contract was RM3 billion and at peak, employing over 6,000 personnel
and nearly 100 main and sub-contractors were deployed.
Apart from day to day commercial management and execution, he successfully
formulated and pursued, Circa RM700 million worth of EOT/ Prolongation Claim with a
final settlement of RM425 million.
Currently as Director of Contracts and Commercial, Design & Build in the Independent
Consultant Engineer’s (ICE) team, he has the crucial oversight role and responsibility for
reviewing contract documentation, progress payment, and variations / EOT claims verification,
commercial risk assessment, mitigation and final account for RM 23 Billion (USD6.7 Billion)
worth Klang Valley MRT project (Line 1).
Prior to this, he had spent fifteen (15) years in urban infrastructure development works in
Malaysia, South Africa, India, UAE and Libya, involving Roads and Drainage, Integrated
Township, complete with a Golf course and Modern Technology Park. As Director of Projects,
based in UAE, he was leading multi-disciplinary design and construction management teams,
(over 150 Professionals), involving AED 6 Billion worth of projects for clients such as: Dubai
World Group of Companies (Nakheel, Technopark, JAFZA Properties), Al Harty Group in
Muscat, Oman and Alekleel Group in Benghazi, Libya. All these projects were administered
under FIDIC form of contract.
His initial ten (10) years, were spent in the oil and gas industry involving design, fabrication and
installation of heavy offshore steel topsides /platforms in the UK, Middle East and South East
Asia, mainly working for leading Turnkey Design and Build Contractors in the fortune 500
league.

His responsibility, include reviewing procurement and pre-tender documentation, post award
progress payments and claims verifications, leading up to final account, all under JCT / FIDIC
forms of contract. Of the 80 work packages, some packages involve build only local
contractors, while others are for design and build international contractors for systems related
works.
Participated in preparing proactive mitigation plans, which makes a significant and valuable
contribution to the project, both in terms of physical progress and minimizing contractual
claims.
To date the project is on schedule and well within the budget, with manageable EOT / VO and
acceleration related claims. This is due in no small measure to the spirit of collaborative team
effort, with ICE playing a crucial “check and balance” role.

This is a self-contained township of 3,200 dwellings, with India’s IT corridor. As Head of
Construction, he lead a team on 500 men, building, twenty (20) story high, ten (10) high-rise
apartment blocks, using in parallel. Two-streams of proprietary Mivan formwork system. He
achieved a nine (9) days cycle per floor, consisting of eight (8) number apartments, complete
with walls, slabs and lift core.

As the Director he was responsible for overall technical and commercial matters of the
development of 1,250 hector land, along the River Vaal, North West Province. The
development consisted of an integrated Golf Estate with USPGA standard golf course, 350
Luxury Villas on 350 hectares of land along the waterfront and exclusive private lodges
located across the other side of the Games Reserve property.
Under his leadership, the team achieved design and construction of roads, infrastructure and
utilities installation on a fast tract basis within a limited budget.

Main features of the project included value engineering, design, procurement, construction
and commissioning on a fast track basis to handle high-speed trains on a metre gauge track,
built on a brown field, right next to operational tracks. This was a “first” of its kind in Malaysia
and in South East Asia, executed under a lump sum contract.

- On secondment as Senior Project Consultant for MRCB Group, one of the leading
Government linked property and infrastructure development companies.
- In-charge of technical & commercial matters related to civil/structural and associated
Railway infrastructure works for the prestigious fully integrated transportation hub cum
commercial precinct in the heart of KL City. The project is situated in a 75-acre land. At
peak, deployed a workforce of 3,500 and more than 50 specialist sub-contractors, all
under the Design and Build (D&C) umbrella, FIDIC form of contract.
- Initially, he was responsible for vetting D&C Contractor’s proposal for consultants and
sub-contractors and verifying design in terms of temporary works, safety, permanent
works and constructability in a high congested area and over electrified operational
tracks.
- During the construction phase he was responsible for monitoring, tracking and
troubleshooting in order to ensure timely completion of the works. He has been
successful in meeting target deliverables, on behalf of KL Sentral, the developer of ERL,
PUTRA & KTMB, the rail operators.
- He was also responsible for monthly valuation, evaluation of variations and
contractual claims, including EOT for infrastructure works.

Being an international turnkey contractor, AMEC had diversified interest.
- Responsible for design supervision and construction coordination of multi-disciplinary
teams, involving other AMEC group of companies, both in the UK and abroad.
- Responsibilities included detailed design and supervision of off-shore topsides and
specialist structure, engineering co-ordination, fabrication and bid preparation.
- Projects involved range from the relatively shallow water wellhead steel platform of the
2,200 South Asian fields to over 38,000 fully integrated gas production platforms in the
North Sea’s hostile deep waters.
- Involved in chairing AMEC study groups to cut down capital investment cost of O&G on
future and existing off shore platforms.
- Led a Team of Engineers to convince Health & Safety inspectorate of UK that integrated
Platforms can be safe, by analyzing progressive collapse of the entire structure, under
extreme operational conditions (Fire & Explosion), ensuring the survival of the structure
for 1hr.20minutes, such that operational personnel can be safely evacuated. First of its
kind in The UK.
Hong Kong International Airport
- Responsible for the design fabrication and supervision of alternate “super modules” of
steel structures.
- Carried out feasibility study for the implementation, involving detailed study of
modularized construction and shipment of prefabricated concourse building in steel, from
various Far Eastern fabrication yards to Hong Kong. With minimum on-site hook up in
mind for a fast tract project.
ONGC Project, India:
NQP & Neelam Platforms Compression Modules, Arabian Seas, India.
In this fast tract design assignment, he was responsible for preliminary to detailed engineering
design and co-ordination with fabrication yard, in Korea and internationally based suppliers
such as Hyundai & Nameshmann.
Total Dunbar Topsides Integrated Deck, North Sea:
Responsible for detailed to detailed engineering analyses of various secondary structures,
such as, life safety boat launching platform, flare tower and helideck and support frame.
ELF Claymore Accommodation Platform, North Sea: Responsible for preliminary pre
tender engineering followed by lump sum bid preparation for an EPIC contract involving
procurement, fabrication and installation aspects of construction.

and build basis.

SUMMARY OF EXPERIENCE : Arul Nathan, has forty (40) years of broad based but "Hands -On " International experience across three continents, Europe, Asia / Middle East and Africa involving major infrastructure projects, including 12 years in railway related projects . Most recently over the past 4 years, he is holding the position of Independent Consulting Engineer’s (ICE) Director of Contracts & Commercial for KVMRT project, worth RM 23 Billion / USD 6.7 Billion. A Chartered Civil/Structural Engineer by profession with a strong commercial knowledge in design and build contract environment (FIDIC) combined with MBA training in Finance. Having worked for leading international companies in international turnkey contracting, consultancy and development fraternity, in a fiercely competitive lump sum, fast track environment, he has firsthand experience and strong knowledge of Design, Construction and Contract Administration of multibillion US dollars Railway/Metro projects.

Page 2 Besides, his international experience, has equipped him with the ability to handle and motivate multi-national work force and liaise closely with clients, at times in challenging environments, cutting across linguistic and cultural barriers - "People's Skill". He is an effective communicator, in both, written and spoken English and able to handle complex commercial and contractual claims and final accounts negotiations. Broadly categorized discipline by discipline, work experience to date: Over fifteen (15) years, were spent in railway and highway related projects both in the UK and Malaysia. In the UK, where he started his career in Eastern Road Construction Unit, he designed and supervised a section of the M11 Highway, London to Cambridge, which led to his achieving Chartered Engineer's status. In Malaysia firstly he started as Senior Consultant on KL Sentral, Transportation Oriented development, worth over RM1.0 billion (USD300 Million), employing over 3,500 personnel. This was followed by more senior assignment as Chief Operating Officer and Commercial Manager of the Project Management Company (PMC) handling brownfield construction of Electrified Double Track Railway Project between Rawang to Ipoh (180km). The lump sum awarded price of the contract was RM3 billion and at peak, employing over 6,000 personnel and nearly 100 main and sub-contractors were deployed. Apart from day to day commercial management and execution, he successfully formulated and pursued, Circa RM700 million worth of EOT/ Prolongation Claim with a final settlement of RM425 million. Currently as Director of Contracts and Commercial, Design & Build in the Independent Consultant Engineer’s (ICE) team, he has the crucial oversight role and responsibility for reviewing contract documentation, progress payment, and variations / EOT claims verification, commercial risk assessment, mitigation and final account for RM 23 Billion (USD6.7 Billion) worth Klang Valley MRT project (Line 1). Prior to this, he had spent fifteen (15) years in urban infrastructure development works in Malaysia, South Africa, India, UAE and Libya, involving Roads and Drainage, Integrated Township, complete with a Golf course and Modern Technology Park. As Director of Projects, based in UAE, he was leading multi-disciplinary design and construction management teams, (over 150 Professionals), involving AED 6 Billion worth of projects for clients such as: Dubai World Group of Companies (Nakheel, Technopark, JAFZA Properties), Al Harty Group in Muscat, Oman and Alekleel Group in Benghazi, Libya. All these projects were administered under FIDIC form of contract. His initial ten (10) years, were spent in the oil and gas industry involving design, fabrication and installation of heavy offshore steel topsides /platforms in the UK, Middle East and South East Asia, mainly working for leading Turnkey Design and Build Contractors in the fortune 500 league.

EMPLOYMENT RECORD : 9.1 Period Employment Organization/ Position Summary of Project May 2011 Till date HSS Engineering Sdn Bhd Position: Commercial / Contracts Director Mass Rapid Transit Lembah Klang – Kuala Lumpur (RM23 Billion/USD6.7 Billion). Currently, as Director of Contracts and Commercial, in the Independent Consultant Engineer (ICE) team, he has the crucial oversight role and responsibility for reviewing contract documentation, progress payment, variation /EOT claims verification, risk assessment and mitigation for RM 23 Billion worth Klang Valley MRT project (Line 1). His responsibility, include reviewing procurement and pre-tender documentation, post award progress payments and claims verifications, leading up to final account, all under JCT / FIDIC forms of contract. Of the 80 work packages, some packages involve build only local contractors, while others are for design and build international contractors for systems related works. Participated in preparing proactive mitigation plans, which makes a significant and valuable contribution to the project, both in terms of physical progress and minimizing contractual claims. To date the project is on schedule and well within the budget, with manageable EOT / VO and acceleration related claims. This is due in no small measure to the spirit of collaborative team effort, with ICE playing a crucial “check and balance” role.

Multipurpose Shopping Mall & Residential Complex, Oman ii. Mass Housing, Libya iii. JAFZA Properties & Technopark, Dubai 9.2a AL HARTY, Muscat, Oman (Project Value AED 850 Million) Multipurpose Shopping Mall and Residential Complex Leading a team of Designers, Construction Supervisors and Contract Administrators to design, value engineer, estimate, procure and execute this multiple-use shopping / residential complex, along with contracts and claim Management. 9.2b ALEKLEEL CONSTRUCTION COMPANY Benghazi, Libya. (Project Value – LD 380 Million). Mass housing projects - Leading a Construction Management Team, executing multimillion Libyan Dinar, Mass Housing Project consisting of 1,262 Villas and associated infrastructure Works in Benghazi, as part of the Libyan Government Housing Board initiative. 9.2c DUBAI WORLD GROUP OF COMPANIES NAKHEEL, JAFZA properties & Technopark – MPW (Project Value – AED 4.0 Billion). Leading a team of Designers, Construction Supervisors and Contract Administrators to design, value engineer, estimate, procure and execute:- a. Vast infrastructure, roads and utilities, work (including district cooling) for the Technopark of approximately 4,400 square acres. b. 775 High end Villas and associated services for Waterfront, Plam Jabel Ali; c. 500 Fully integrated Factories and Office Premises. Ras Al Khaimah, Gateway City Development – Infrastructure Detail Design for a total development area of 1,150 hectors, inclusive of design of roads, earthworks and utilities. 9.3 Period Employment Organization/ Position Summary of Project Jan 2004 Apr 2007 Prestige Shanthi Niketan. Position: Project Director Mass Housing Developments Prestige Shanthi Niketan Bangalore, India. This is a self-contained township of 3,200 dwellings, with India’s IT corridor. As Head of Construction, he lead a team on 500 men, building, twenty (20) story high, ten (10) high-rise apartment blocks, using in parallel. Two-streams of proprietary Mivan formwork system. He achieved a nine (9) days cycle per floor, consisting of eight (8) number apartments, complete with walls, slabs and lift core.
  • 5. Page 5 9.4 Period Employment Organization/ Position Summary of Projects Jan 2000 Dec 2003 Rockridge Golf Estate Parys. Position: Director Golf course, Luxury Villas and related infrastructures. Rockridge Golf Estate. Parys, North West Province, South Africa. As the Director he was responsible for overall technical and commercial matters of the development of 1,250 hector land, along the River Vaal, North West Province. The development consisted of an integrated Golf Estate with USPGA standard golf course, 350 Luxury Villas on 350 hectares of land along the waterfront and exclusive private lodges located across the other side of the Games Reserve property. Under his leadership, the team achieved design and construction of roads, infrastructure and utilities installation on a fast tract basis within a limited budget. 9.5 Period Employment Organization/ Position Summary of Projects Sep 2000 2003 HSS Integrated Sdn Bhd. Position: Chief Operating Officer / Commercial Director for PMC (Special Project) Electrified Double Track – Rawang to Ipoh Railway Track Rawang to Ipoh (RM 2.6 Billion + RM 425 Million / USD1.0 Billion). Main features of the project included value engineering, design, procurement, construction and commissioning on a fast track basis to handle high-speed trains on a metre gauge track, built on a brown field, right next to operational tracks. This was a “first” of its kind in Malaysia and in South East Asia, executed under a lump sum contract. - Project Management, Commercial & Contract Administration - Value Engineering - Contract Management, Commercial & Sub contract negotiations. - Project risk assessment and management - Establishing of variation tracking systems to assess potential opportunity and exposure for claims - Setting up and implementation of overall budgetary and quality controls - Accountabilities include the proactive management of all contractual, commercial and technical aspects of the Agreement. - Responsible for complete project Management for Electrified Double Track project. - Successfully managed and controlled all aspects of Project Contract management and administration, legal affairs, program development, deeds of variation, claims, Project payments, formal correspondence and disputes. - Successfully formulated and pursued, Circa RM 700 Million EOT / Prolongation claims with as final award of RM 425 Million.

Page 6 9.6 Period Employment Organization/ Position Summary of Projects 1997 – Aug 2000 T Y LIN (SEA) Sdn Bhd (Part of T Y Lin International leading Structural Solution providers, San Francisco, USA. Position: Senior Consultant for Special Projects (Senior Commercial Manager – KL Sentral) Transportation Hub and associated Railway and Development Works - KL Sentral Project Value RM 1.00 Billion - On secondment as Senior Project Consultant for MRCB Group, one of the leading Government linked property and infrastructure development companies. - In-charge of technical & commercial matters related to civil/structural and associated Railway infrastructure works for the prestigious fully integrated transportation hub cum commercial precinct in the heart of KL City. The project is situated in a 75-acre land. At peak, deployed a workforce of 3,500 and more than 50 specialist sub-contractors, all under the Design and Build (D&C) umbrella, FIDIC form of contract. - Initially, he was responsible for vetting D&C Contractor’s proposal for consultants and sub-contractors and verifying design in terms of temporary works, safety, permanent works and constructability in a high congested area and over electrified operational tracks. - During the construction phase he was responsible for monitoring, tracking and troubleshooting in order to ensure timely completion of the works. He has been successful in meeting target deliverables, on behalf of KL Sentral, the developer of ERL, PUTRA & KTMB, the rail operators. - He was also responsible for monthly valuation, evaluation of variations and contractual claims, including EOT for infrastructure works. 9.7 Period Employment Organization/ Position Summary of Projects 1995- 1997 MIVAN International Ltd UK. Position: Country Manager, responsibility for Commercial & operational matters in Indian Sub-Continent, a system build technology provider out of UK. Urban & Residential Development. - Responsible for setting up a new operational base in India, which included in terms of coverage, a wide range of South Asian countries, developing business plans and strategies,- - Bidding and securing new contracts worth over £5 Million, - Implementing the same for the rapid erection of multi-storey residential complexes. - Responsible for more than 500 construction workers, as different sites throughout India, while working closely with established local property developers. - Delivered over 1,500 units of high-rise apartments

Page 7 9.8 Period Employment Organization/ Position Summary of Projects 1990- 1995 AMEC Engineering Ltd UK Position: Lead Structural Engineer Principal Structural Engineer Off-Shore Oil & Gas Airport Concourse steel roof Project Value Euro 1.5 Billion Being an international turnkey contractor, AMEC had diversified interest. - Responsible for design supervision and construction coordination of multi-disciplinary teams, involving other AMEC group of companies, both in the UK and abroad. - Responsibilities included detailed design and supervision of off-shore topsides and specialist structure, engineering co-ordination, fabrication and bid preparation. - Projects involved range from the relatively shallow water wellhead steel platform of the 2,200 South Asian fields to over 38,000 fully integrated gas production platforms in the North Sea’s hostile deep waters. - Involved in chairing AMEC study groups to cut down capital investment cost of O&G on future and existing off shore platforms. - Led a Team of Engineers to convince Health & Safety inspectorate of UK that integrated Platforms can be safe, by analyzing progressive collapse of the entire structure, under extreme operational conditions (Fire & Explosion), ensuring the survival of the structure for 1hr.20minutes, such that operational personnel can be safely evacuated. First of its kind in The UK. Hong Kong International Airport - Responsible for the design fabrication and supervision of alternate “super modules” of steel structures. - Carried out feasibility study for the implementation, involving detailed study of modularized construction and shipment of prefabricated concourse building in steel, from various Far Eastern fabrication yards to Hong Kong. With minimum on-site hook up in mind for a fast tract project. ONGC Project, India: NQP & Neelam Platforms Compression Modules, Arabian Seas, India. In this fast tract design assignment, he was responsible for preliminary to detailed engineering design and co-ordination with fabrication yard, in Korea and internationally based suppliers such as Hyundai & Nameshmann. Total Dunbar Topsides Integrated Deck, North Sea: Responsible for detailed to detailed engineering analyses of various secondary structures, such as, life safety boat launching platform, flare tower and helideck and support frame. ELF Claymore Accommodation Platform, North Sea: Responsible for preliminary pre tender engineering followed by lump sum bid preparation for an EPIC contract involving procurement, fabrication and installation aspects of construction.
  • 8. Page 8 9.9 Period Employment Organization/ Position Summary of Project 1985 – 1990 SOMEC (Building Contractors) Ltd. India. Position: Country Manager / CEO Urban Buildings Project value RM 28 Million. Mainly responsible for setting up new offices in Singapore, Malaysia and Sri Lanka, business development, tendering and negotiation of contracts with clients and sub-contractors, up to the point of award. Upon award of contract, organizing and deploying task force based construction teams, monitoring progress and negotiating facilities with banks and suppliers, serving contractual notices, concluding contractual claims and final accounts and finally was responsible for bottom line profit. Among the leading projects secured and executed were:- - 28 storey Headquarters Building for NLFCS – Kuala Lumpur. Built on a design, finance and build basis. - AGIO Cigar Factory with associated infrastructure in Colombo, Sri Lanka. - Multi-purpose Hall, Katong, Singapore. 9.10 Period Employment Organization/ Position Summary of Project 1981 – 1984 MCDERMOTT Engineering, Singapore Position: Senior Structural Engineer / Project Engineer Offshore Oil & Gas Working for leading Oil & Gas Contractor, he was involved initially in the conceptual to detailed design, followed by Project Engineer's role, co-coordinating with clients and in-house multi-disciplinary teams as well as outside sub-contractors and vendors. Responsibilities included preparation of preliminary to detailed design, budget planning and scheduling, bid preparation and review of bids, fabrication and offshore installation support services. Project value ranged from US$300 Million to US$100 Million for clients from Indonesia’s Pertamina to Kuwait Oil. 9.11 Period Employment Organization/ Position Summary of Project 1980- 1981 MCDERMOTT Engineering, London Position: Structural Engineer Offshore Oil & Gas Responsible for the detailed design and preparation of technical specification for bidding packages relating to Port of Yanbu Development, Saudi Arabia. Structures designed included steel industrial buildings and concrete bridges, viaducts, culverts and roads, all to US codes of practice, including earthquake design. STRUDL and other proprietary space frame analysis software packages were used.

Page 9 9.12 Period Employment Organization/ Position Summary of Project 1979- 1980 PRC Harris International Consultants, London Position: Senior Civil / Structural Engineer (Bridges) Port Development He was responsible for the detailed design and preparation of technical specification for the bid packages relating to Port of Yanbu Development, Saudi Arabia. Structures designed included steel industrial buildings and concrete bridges, viaducts, culverts and roads, all to US codes of practice, including earthquake design. STRUDL and other proprietary space frame analysis software packages were used. 9.13 Period Employment Organization/ Position Summary of Project 1975 - 1978 Eastern Road Construction Unit of Transport, Bedford Position: Graduate Engineer / Chartered Engineer Highways & Bridges Started career under a structured professional training program, leading to Chartered Civil Engineer status. Experience included design and site supervision of national highways, drainage, culverts and bridges with specific responsibility for the design and construction of Duxford Airfield Section of M11 Motorway. Computer software, 'Grid Analysis' were used for structural analyses of the bridge superstructure along with department of transport (UK) design guidelines on bridges, while for Moss Suite of programs were used for Highway Alignment Design.
