 The applicant is seeking to close,
vacate and abandon a portion of Argyle
Avenue right-of-way.

 Argyle Ave., between Patterson and the
dead end cul-de-sac (west of Patterson).

POLICY ANALYSIS
 2,417 square feet of area is being
requested for abandonment.
 Public utilities are located in the area and
an easement for these will need to be
established during the platting process.

 The Fire Department has determined that
while there is an existing reduction in the
street width (from 26’ to 21’ around an
existing tree) they recommend that no
improvements or right-of-way abandonment
result in the reduction of the street width
(curb to curb) to less than 26’ in width.

 Based on the average land values, from the
appraisal district, the average price per sq. ft.
for unimproved land is $19.67.
 The total value based on these
averages is $47,534.33.
 The applicant has provided an appraisal
consultation letter.

 Appraisal Consultation Findings
 The property is not an individual economic
unit and would have a very limited market
of potential buyers to only include the
neighboring property owner.
 The property is encumbered by utility lines and
poles running the entire length of the strip from east
to west.

 Appraisal Consultation Findings
 Based on these physical attributes, the
subject property is considered typical
right-of-way strip and should be valued as
such, with a 90% reduction in the value of
the land.
 Based on these calculations, the total
price to be payed to the city is $4,754.24

PLANNING & ZONING RECOMMENDATION
 P&Z held a public hearing on December 4,
2017.
 Approved of the requested abandonment
with the following additions to their
recommendations:
 Abandonment or a right-of-way license
agreement be approved by City
Council.

PLANNING & ZONING RECOMMENDATION
 Recommendations continued:
 That the request be contingent on the
approval of City Staff (Community
Development, Fire Department, Public
Works, and Police Department regarding
life safety issues, such as access, fire
codes, building/zoning codes, and
vision/sight clearance.
 No one from the public spoke against the
request.

PUBLIC NOTIFICATION
 Postcards were mailed to property owners
within a 200-foot radius of the property,
appropriate notice was posted on the City
website, and a legal notice was printed in
the official newspaper of the City of Alamo
Heights.
