 Two Stages contract strategy in practice (Summary)
• Employer invites (4-6) of qualified contractors for RFP based on concept design & employer requirement
• Employer selects the suitable proposals and negotiates with the potential contractors for a design and
build contract based on the contractor's screened proposal.
• Hence, employer enters with the selected contractor into an agreement for the design and build (or else
other) contract in two stages:

 Two Stages contract strategy (continued).
• 1st stage (cost plus agreement) is to provide descriptive Lump-sum priced proposal with a D&B
contract document and sufficient illustrative design that enables the employer for informed decision
based on their project perspective and needs, this stage is ECI.
• Further to the employer acceptance for the proposal and after due technical and commercial
negotiations, the employer may decide to enter an agreement for the second stage which
incorporates a LS- DB contract based on agreed contract document and the illustrative design where:
o the contractor develops the detailed design and construction drawings and BIM model (4D
– 5D- or else agreed).

 Challenges in applying ECI
1. How to comply with Public Tender Law.
2. No exceptions in tendering procedure (apply equity with all contractors).
3. No consideration for the trustworthy- previous engagement- unique experience.
4. The starting point is the same for all (prequalification/short list) system.
5. However, the public authority can still implement the ECI through:
5.1 direct purchase order with a contractor of unique or specific experience.
5.2 Competition for Seeking a concept design solution.
6. Employer general challenges as ECI is not practical for small projects as the C/B ratio is not attractive.
7. Contractor interest may decline after stage 1 or some of his team leaves and learning curve restarts.

1. Identify Cut-Off Date for Alternative Design proposals.
2. Maintain design intent in alternative designs. (Brief narrative).
3. Differentiate: Alternative Design : Scope Reduction : material differences

9. Conclusion
• The ECI approach is used either with the stander forms of contracts like the “FIDIC” forms of contracts,
Yellow Book for the Plant and design built and the X22 NEC4 or in tailored contracts.
• The ECI contract may be applied in two stages and for one contractor or it may engage different
contractors one for every stage.
• The ECI approach can be used for the improvement of the project success certainty and mitigation of the
most potential construction claims.
• The influence of ECI proved to mitigate different types of claims like design claims, an extension of time
claim, scope claim, liability claims, termination claims.
