Health and safety
• The Health and Safety in Employment (HSE) Act
1992 is a law designed to prevent people at work
from being harmed.
• It applies to everyone in almost all places of
work; inside, outside, public or private even
underwater or underground.
• Employees, employers, contractors, owners of
building or plant and visitors to workplaces all
have responsibilities and obligations under the
HSE Act.
your health & safety rights as an employee
• Under the HSE Act, your employer must take “all
practicable steps” to:
• Provide and maintain a safe working environment,
including facilities for your safety and health;
• Ensure that any plant, equipment, appliances, fittings,
furniture and tools are safe for you to use;
• Ensure that while you are at work you are not exposed
to any hazards in or near your place of work; and
• Have procedures for dealing with emergencies that
may arise at work.
Training to do the job safely
The law also says your employer has a duty to
provide training so you can do your job safely. This
means your employer must:
• Tell and show you any hazards you will be exposed to in your
job and how to avoid being injured by them.
• Show you how to minimise your exposure to hazards.
• Ensure that you have the skills and experience to do the job.
• Show you what to do in an emergency.
• Make sure you are properly supervised when doing your job.
Refusing work
• You have the right to refuse to do work if you
believe (on reasonable grounds) that it is likely to
cause you serious harm.
• You need to try and resolve the situation as soon
as possible, but if it isn’t resolved then you can
continue to refuse to do the work.
• You can also refuse to do the work if a health and
safety representative in your workplace advises
you that it is likely to cause you serious harm.
What do I do if I get hurt?
• If you are injured at work or you think your work is affecting
your health:
• Tell your employer at once.
• your employer should arrange first aid and any other
medical treatment that you need.
• your employer should make sure that the hazard that
affected you is controlled so nobody else is injured.
• Make sure your accident is recorded in your workplace's
accident register. The law says all employers must keep a
record of any workplace accidents that happen.
• If your injury is serious, your employer must report it to the
Department of LabThe.
Accident Compensation
• If you are unable to work because of a serious work injury,
you may need some time off work.
• You may also be entitled to be paid accident compensation
while you are away from work.
• Ask your doctor if you need to fill out an ACC form
(remember what might seem a minor injury now may have
long term implications for your future health and career). If
your claim is accepted, you will be paid 80% of your
earnings until you are able to return.
• your employer will pay the first week and ACC will pay the
weeks that follow. You may also be entitled to a partial
refund on doctor’s visits and any physiotherapy you have.
Specific Health and Safety laws for young
people
• If you are younger than 15:
• you can’t be employed to do any work that is likely to harm you,
such as using machinery or lifting heavy loads
• you can’t work on-site in logging, manufacturing or construction
• you can’t drive tractors or other vehicles, or ride on them while
they are towing or attached to anything. There is an exemption if
you are not an employee, but live on the farm or work as an
independent contractor. This lets you drive or ride tractors for
agricultural work if you're over the age of 12, but only if you're fully
trained or are being trained in the safe operation of the tractor.
If you are younger than 16, you can’t work at night (10pm-6am),
except in special cases.

Strategy to consider when you develop and implement
a safety and health policy:
 Involve top management, safety committee or safety
team
 Review existing policies (business or environmental)
that have a standard template that can be used
 Develop policy content based on required elements
 Document the policy according to your current
document control system
 Communicate the policy to all employees in an
accessible format

  • 2. What is a S & H Management system? The S&H Management system is the employer’s method for preventing injuries and illnesses to employees 2
  • 3. Health and safety • The Health and Safety in Employment (HSE) Act 1992 is a law designed to prevent people at work from being harmed. • It applies to everyone in almost all places of work; inside, outside, public or private even underwater or underground. • Employees, employers, contractors, owners of building or plant and visitors to workplaces all have responsibilities and obligations under the HSE Act.
  • 4. your health & safety rights as an employee • Under the HSE Act, your employer must take “all practicable steps” to: • Provide and maintain a safe working environment, including facilities for your safety and health; • Ensure that any plant, equipment, appliances, fittings, furniture and tools are safe for you to use; • Ensure that while you are at work you are not exposed to any hazards in or near your place of work; and • Have procedures for dealing with emergencies that may arise at work.
  • 5. Training to do the job safely The law also says your employer has a duty to provide training so you can do your job safely. This means your employer must: • Tell and show you any hazards you will be exposed to in your job and how to avoid being injured by them. • Show you how to minimise your exposure to hazards. • Ensure that you have the skills and experience to do the job. • Show you what to do in an emergency. • Make sure you are properly supervised when doing your job.
  • 6. Refusing work • You have the right to refuse to do work if you believe (on reasonable grounds) that it is likely to cause you serious harm. • You need to try and resolve the situation as soon as possible, but if it isn’t resolved then you can continue to refuse to do the work. • You can also refuse to do the work if a health and safety representative in your workplace advises you that it is likely to cause you serious harm.
  • 7. What do I do if I get hurt? • If you are injured at work or you think your work is affecting your health: • Tell your employer at once. • your employer should arrange first aid and any other medical treatment that you need. • your employer should make sure that the hazard that affected you is controlled so nobody else is injured. • Make sure your accident is recorded in your workplace's accident register. The law says all employers must keep a record of any workplace accidents that happen. • If your injury is serious, your employer must report it to the Department of LabThe.
  • 8. Accident Compensation • If you are unable to work because of a serious work injury, you may need some time off work. • You may also be entitled to be paid accident compensation while you are away from work. • Ask your doctor if you need to fill out an ACC form (remember what might seem a minor injury now may have long term implications for your future health and career). If your claim is accepted, you will be paid 80% of your earnings until you are able to return. • your employer will pay the first week and ACC will pay the weeks that follow. You may also be entitled to a partial refund on doctor’s visits and any physiotherapy you have.
  • 9. Specific Health and Safety laws for young people • If you are younger than 15: • you can’t be employed to do any work that is likely to harm you, such as using machinery or lifting heavy loads • you can’t work on-site in logging, manufacturing or construction • you can’t drive tractors or other vehicles, or ride on them while they are towing or attached to anything. There is an exemption if you are not an employee, but live on the farm or work as an independent contractor. This lets you drive or ride tractors for agricultural work if you're over the age of 12, but only if you're fully trained or are being trained in the safe operation of the tractor. If you are younger than 16, you can’t work at night (10pm-6am), except in special cases.
