LEGAL AND ETHICAL REPORT
REGULATORY BODIES IN THE MUSIC INDUSTRY
LEGAL AND ETHICAL REPORT
• COPYRIGHT - the exclusive and assignable legal right, given to the
originator for a fixed number of years, to print, publish, perform,
film, or record literary, artistic, or musical material.
How could this affect my print product?
If I were to copyright my print product, it
would mean I would have complete rights
over the product. If anyone would want to
use my product, permission is required. If
someone were to send a request to use my
work (and their reasons don’t fall under Fair
Use laws), then I could ask for fees.
On the other hand, if I wanted to use
copyrighted work for my product without
permission, I may have to pay them monetary
damages as I have commercially profited
from it, as well as being prohibited from
SLANDER / LIBEL
• SLANDER - The action or crime of making a false spoken statement damaging
to a person's reputation.
• LIBEL - a published false statement that is damaging to a person's reputation;
a written defamation.
How could this affect my print product?
If I were to say slander against someone on the
production crew, they could sue me for
compensation, which could affect my print product
as money would be lost, co-workers may choose to
leave the print product work which would slow down
the process.
If someone were to say slander against me, it could
negatively affect my print product’s success if their
statement is not proven false. If we were to go to
court and it was proven slander, then I could get
compensation and it could bring more attention to
my company/print product, therefore improving it’s
ROYALTIES
• royalties - a payment made to writers, people who have invented
things, owners of property, etc. every time their books, devices, land, etc.
are bought or used by others.
How may this affect my print product?
I may have to pay a certain percentage of
profit to the owner’s of the music for
every digipack bought, which may affect
the price of my print product.
VIOLENCE
• VIOLENCE - behaviour involving physical force intended to hurt, damage, or
kill someone or something.
How may this affect my print
product?
If I were to use violence against someone in
the workplace, they could sue me, which
would put the print product process on
pause.
Alternatively, if I were to have someone be
violent towards me, it could mean the print
product may take longer to make if I were
to sue.
OFFENSIVE
LANGUAGE/BEHAVIOUR/MATERIAL
• Language/behaviour/material that makes someone to feel anger, hurt or
upset.
How may this affect my print product?
If my print product were to contain anything that causes insult
to another person or group of people, then I could be forced
to scrap the product and make it not offensive. This would
mean money lost, which may mean the budgeting will sink and
the second print product won’s be the best quality.
If someone were to say or do something offensive to another
co-worker on the print product team, it may cause tension and
therefore people won’t do their best performance, prohibiting
the print product from looking the best it can.
E - REGULATORY BODIES IN THE MUSIC INDUSTRY
Who are they and
what do they do?
What impact this
organisation would
have on my print
product?
BASCA
British Academy of Songwriters,
Composers and Authors
https://basca.org.uk/home/
MPA
Music Publishers Association
http://www.mpaonline.org.uk
PRS
Performing Rights Society (who are
now linked with MCPS – The
Mechanical Copyright Protection
Society)
https://www.prsformusic.com/
This academy is a voice for
music writers. They have
campaigns in Europe and
throughout the world.
If this academy were
to support us, they
could give legal
advice and
recognition for our
band.The MPA program is a
professional degree and a
graduate degree that
prepares individuals to serve
as managers, executives and
policy analysts
Getting an MPA helps
teach budgeting,
organizational
management and
perspective skills, which
are all useful skills to have
when creating something
new.
PRS pay royalties to their
members when their work
is: broadcast on tv/radio,
performed in public or
streamed/downloaded.
Joining this
association could be
good for my print
product, as every time
our band is advertised
or their music is
streamed, there would
be profit coming from
PRSOFCOM regulates the TV and
radio sectors, fixed line
telecoms, mobiles, postal
services, plus the airwaves over
which wireless devices operate.
This company would
help our print product
by aiming the adverts to
the right target
audiencelicenses recorded music
played in public or broadcast
on the radio or TV and then
distributes the fees to its
performer and record
company members
The company can help
give the right fees for
wherever our music is
played.
BPI is a main trade
association for UK record
labels, with over 380
members, and so is
responsible for a variety of
industry activities that
promote and protect British
music.
They can help give
recognition to the print
product by promoting
the band.
By registering my work it
will help establish and
endorse these rights with
immediate effect from the
date of registration.
Under Copyright Law, the
Songwriter has rights like the
exclusive right to gain reward
for their creative efforts.
a British organisation which
represents the collective
interests of the production side
of UK’s Commercial music
industry: artists, musicians,
songwriters, composers, record
labels, artist managers, music
publishers, studio producers
and music collecting societies.
Will help promote
by advertising and
therefore gain profit
