Learning outcome 2: Tasks D and E
Note from the exam board
When considering legal and ethical issues candidates should refer to the code of
practice for the regulatory body, which affects the production of print media (in our
case – the music industry).
Work could be evidenced in written format, letters to relevant bodies or online
requests applying for copyright permission. It is important that learners relate the
relevant legal and ethical issue to the print product they are producing, for instance
when considering the photos/images and language for inclusion in a print product
such as a magazine etc.
Students aiming for merit or distinction would present all of their research in a
more creative manner such as Prezi, PowToon, emaze etc and use images,
videos and hyperlinks to enhance their work.
D - Legal and Ethical Considerations
Find out/define the below terms and tell us how this might have an impact on
your print products.
How this effects my print product?
Copyright/intellectual property rights
-Intellectual property refers to any
intellectual creation, such as literary
works, artistic works, inventions,
designs, symbols, names, images,
computer code. Intellectual property law
exists in order to protect the creators
and covers areas of copyright and
trademark law.
-This could affect my product because if
I use any famous images or quotes I
could be sued or forced to remove the
certain thing
Slander/libel
-A published false statement that is
damaging to a person’s reputation.
-A false statement would affect the
product as it is usually damaging so
could cause people to not buy the
Album and send hate towards it.
Royalties
-A sum paid to a patentee for the use of
a patent or to an author or composer for
each copy of a book sold or for each
public performance of a work.
-This could be a problem as if you are a
small company you would be making.
Do not use other peoples stuff so you
do not have to pay them as well.
Violence
-Music must not directly threat other
people using the lyrics and must also
not tell other people to commit acts of
violence as well.
-If I do so include offensive lyrics in the
songs could lead to the take down of
the album and the overall sales will be
greatly affected
Offensive language/behaviour/material
-Causing someone to feel resentful,
upset, or annoyed.
-Using offensive language will affect the
exposure of the album or songs and will
reduce the people who will actually be
able to hear the song and will greatly
affect the sales and exposure of the
album.
Public interest - Welfare of the general public in which
the whole society has a stake and which
warrants recognition, promotion, and
protection by the government and its
agencies.
-Therefore the titles and images used in
the production of the album must not be
out there is offend anyone or concern
anyone before printing.
E - Regulatory Bodies in the Music Industry
The music industry is mostly a self-regulated organisation. But just as any other
industry it must have regulators to protect all the people involved in the production
and realisation of a song, cd, a concert etc (copyright, trade, music representation).
The most important are listed below. Although all these companies have different
aims the vision is the same, keep the music industry alive. However, the fact that
technology is evolving so fast, makes it even harder for them to protect every single
detail.

06. lo2 task d&e legal and ethical report

  • 1. Learning outcome 2: Tasks D and E Note from the exam board When considering legal and ethical issues candidates should refer to the code of practice for the regulatory body, which affects the production of print media (in our case – the music industry). Work could be evidenced in written format, letters to relevant bodies or online requests applying for copyright permission. It is important that learners relate the relevant legal and ethical issue to the print product they are producing, for instance when considering the photos/images and language for inclusion in a print product such as a magazine etc. Students aiming for merit or distinction would present all of their research in a more creative manner such as Prezi, PowToon, emaze etc and use images, videos and hyperlinks to enhance their work. D - Legal and Ethical Considerations Find out/define the below terms and tell us how this might have an impact on your print products. How this effects my print product? Copyright/intellectual property rights -Intellectual property refers to any intellectual creation, such as literary works, artistic works, inventions, designs, symbols, names, images, computer code. Intellectual property law exists in order to protect the creators and covers areas of copyright and trademark law. -This could affect my product because if I use any famous images or quotes I could be sued or forced to remove the certain thing Slander/libel -A published false statement that is damaging to a person’s reputation. -A false statement would affect the product as it is usually damaging so could cause people to not buy the Album and send hate towards it. Royalties -A sum paid to a patentee for the use of a patent or to an author or composer for each copy of a book sold or for each public performance of a work.
  • 2. -This could be a problem as if you are a small company you would be making. Do not use other peoples stuff so you do not have to pay them as well. Violence -Music must not directly threat other people using the lyrics and must also not tell other people to commit acts of violence as well. -If I do so include offensive lyrics in the songs could lead to the take down of the album and the overall sales will be greatly affected Offensive language/behaviour/material -Causing someone to feel resentful, upset, or annoyed. -Using offensive language will affect the exposure of the album or songs and will reduce the people who will actually be able to hear the song and will greatly affect the sales and exposure of the album. Public interest - Welfare of the general public in which the whole society has a stake and which warrants recognition, promotion, and protection by the government and its agencies. -Therefore the titles and images used in the production of the album must not be out there is offend anyone or concern anyone before printing. E - Regulatory Bodies in the Music Industry The music industry is mostly a self-regulated organisation. But just as any other industry it must have regulators to protect all the people involved in the production and realisation of a song, cd, a concert etc (copyright, trade, music representation). The most important are listed below. Although all these companies have different aims the vision is the same, keep the music industry alive. However, the fact that technology is evolving so fast, makes it even harder for them to protect every single detail. Research the following organisations and find out what they aim to do. Think about how their regulations would impact on your print work.

They would support the exposure of my music and would also help with the legal issues it may be facing within the music and will tell me if I break any laws. MPA Music Publishers Association http://www.mpaonline.org.uk They Represent the full range of the UK’s music publishing sector, 240 members from the most established music publishers to independents start- ups. They support our music makers. They would be the ones to publish my album and music and also would help design the advert and CD cover. PRS Performing Rights Society (who are now linked with MCPS – The Mechanical Copyright Protection Society) https://www.prsformusic.com/ They pay royalties to their members when their work is performed, broadcast, streamed, downloaded, reproduced, played in public or used in film and TV. We support them by influencing policy, supporting and hosting awards and events, and investing in new technology to ensure we’re fit for the digital music age. OFCOM Office of Communications https://www.ofcom.org.uk/ Ofcom is the regulator for the communications services that we use and rely on each day.
