Mekanisme pemakzulan presiden di Indonesia dan Korea Selatan melibatkan lembaga legislatif dan yudikatif, namun perbedaan terletak pada lembaga yang memutuskan pemberhentian presiden secara akhir, yaitu MPR di Indonesia dan Mahkamah Konstitusi di Korea Selatan.

2. LIMITASI
Mekanisme Pemakzulan (Impeachment) Presiden
yang dimaksud dapat dilihat dari konstitusi masing-
masing negara serta lembaga yang berwenang
dalam proses pemakzulan di kedua negara, mulai
periode pasca amandemen UUD NRI 1945 dan pasca
amandemen Konstitusi Korea Selatan pada 22
Oktober 1987.

3. ABSTRAK
Indonesia dan Korea Selatan merupakan negara yang berbentuk Republik. Keduanya juga menganut Sistem Pemerintahan yang demokratis.
Presiden di Republik Indonesia maupun di Republik Korea dipilih melalui Pemilihan Umum dengan masa jabatan selama 5 tahun setelah
terpilih. Jika jabatan Presiden di Indonesia bisa diemban selama 2 periode, maka lain halnya dengan Korea Selatan yang hanya
memperbolehkan Presidennya menjabat selama 1 periode saja. Sebagai sistem kontrol, maka dikenal istilah Pemakzulan yang merupakan
cara untuk membatasi kekuasaan pejabat publik. Dengan pemakzulan, pejabat publik dapat diberhentikan selama masa jabatannya. Dalam
tulisan ini, metode dan sistem pemakzulan yang dibahas dan dibandingkan adalah pemakzulan Indonesia model dengan sistem presidensial
dan pemakzulan Korea Selatan model dengan sistem semi-presidensil. Masalah hukum (issues) penelitian berkaitan dengan persamaan
dan perbedaan metode dan sistem pemakzulan di kedua negara. Metode penelitian yang digunakan adalah metode penelitian yuridis-
normatif. Mekanisme impeachment di Indonesia sebelum perubahan UUD 1945 belum ada secara eksplisit disebutkan di dalam Konstitusi
baik UUD 1945 naskah asli, Konstitusi RIS, maupun UUDS 1950. Namun, pengaturan mengenai impeachment ada di dalam TAP MPR Nomor
III/MPR/1978 yang memberikan kewenangan kepada MPR untuk memberhentikan presiden. Pasca perubahan UUD 1945 kemudian diatur
di dalam Pasal 7A dan Pasal 7B UUD 1945 mengenai proses impeachment yang melibatkan tiga lembaga yaitu DPR, MPR dan Mahkamah
Konstitusi. Dimana pemutus akhir dari diberhentikannya presiden di Indonesia yaitu di MPR. Itulah sebabnya para ahli banyak menyatakan
bahwa proses impeachment di Indonesia lebih besar unsur politiknya dibandingkan unsur hukumnya.
Mekanisme impeachment di Negara Korea Selatan diatur di dalam Pasal 63 dan Pasal 111 Konstitusi Korea Selatan yang memperlihatkan
bahwa mekanisme impeachment dilakukan dengan melibatkan dua lembaga yaitu parlemen (Majelis Nasional) dan lembaga yudisial
(Mahkamah Konstitusi). Penentuan akhir dari diberhentikan atau tidaknya seorang presiden di Korea Selatan dilakukan di Mahkamah
Konstitusi sehingga dianggap memenuhi proses hukum.

4. Pemakzulan presiden merupakan mekanisme penting dalam sistem pemerintahan demokratis yang bertujuan untuk menjaga
akuntabilitas kepala negara. Dalam abstrak ini, kami akan membandingkan mekanisme proses pemakzulan presiden di Republik
Indonesia dan Republik Korea Selatan. Dalam konteks Indonesia, proses pemakzulan diatur dalam Pasal 7A hingga Pasal 7D Undang-
Undang Dasar Negara Republik Indonesia Tahun 1945. Proses ini dimulai dengan inisiatif pemakzulan oleh Dewan Perwakilan Rakyat
(DPR), penyelidikan oleh Panitia Pemakzulan, pembahasan dan persetujuan oleh DPR, pemeriksaan oleh Mahkamah Konstitusi, dan
pelaksanaan pemakzulan jika diputuskan sah.
Di sisi lain, dalam konteks Korea Selatan, proses pemakzulan diatur dalam Konstitusi Korea Selatan. Inisiatif pemakzulan dapat berasal
dari DPR atau dilakukan melalui petisi publik yang mendapatkan dukungan yang cukup. Setelah itu, terdapat sidang paripurna di DPR
yang memutuskan apakah pemakzulan dilanjutkan ke Mahkamah Konstitusi. Jika Mahkamah Konstitusi memutuskan pemakzulan
sebagai sah, presiden dinyatakan diberhentikan dan pemimpin sementara mengambil alih jabatan.
Perbandingan mekanisme pemakzulan di kedua negara ini menunjukkan beberapa kesamaan dan perbedaan. Kedua negara menganut
sistem pemerintahan presidensial dengan pembagian kekuasaan antara eksekutif, legislatif, dan yudikatif. Namun, terdapat perbedaan
dalam tahapan proses pemakzulan, termasuk inisiatif pemakzulan, pembentukan panitia pemakzulan, persyaratan suara dan
pemungutan suara, serta peran Mahkamah Konstitusi. Hal ini mencerminkan perbedaan dalam aspek hukum dan politik di kedua
negara.
Pengetahuan tentang perbandingan mekanisme proses pemakzulan presiden di Republik Indonesia dan Republik Korea Selatan penting
untuk memahami praktik demokrasi dan akuntabilitas kepala negara dalam konteks global. Perbandingan ini juga memberikan wawasan
tentang bagaimana proses pemakzulan dapat berkontribusi pada menjaga keadilan, akuntabilitas, dan integritas pemerintahan di
negara-negara demokratis

5. Mekanisme impeachment di Korea Selatan terlihat lebih kepada mekanisme hukum karena proses akhir
penetapan putusan berhentinya presiden ada di Mahkamah Konstitusi. Dalam Konteks Indonesia,
keputusan pemberhentian presiden ditentukan oleh MPR setelah sebelumnya diproses MK melalui usulan
DPR. Proses tersebut terlihat mempunyai dua mekanisme yaitu mekanisme hukum dan politik. Mekanisme
hukum sudah seharusnya ditempuh untuk memperoleh kepastian hukum dan keadilan. Sementara
mekanisme politik harus diteliti lagi apakah dibutuhkan atau tidak dalam mekanisme impeachment di
Indonesia. Meskipun memiliki sistem pemerintahan yang berbeda dengan Indonesia, namun ada satu
persamaan yang dapat ditarik dari mekanisme impeachment di Korea Selatan yaitu persamaan dalam hal
lembaga yang terlibat dari proses impeachment yaitu lembaga legislatif dan lembaga yudisial. Berdasarkan
uraian latar belakang diatas terdapat beberapa rumusan masalah yaitu: (1) Bagaimana Perbedaan
mekanisme dan alasan Impeachment di Republik Indonesia dan Republik Korea Selatan meskipun
melibatkan lembaga negara yang sama?; (2) Mengapa Konsep Impeachment di Republik Indonesia lebih
mengedepankan mekanisme politis dibandingkan mekanisme hukum sebagaimana konsep impeachment
yang diterapkan di Republik Korea Selatan?; (3) Bagaimanakah sifat/kedudukan putusan MK terkait
Impeachment di Republik Indonesia dan Republik Korea Selatan?
Apakah Indonesia masih membutuhkan mekanisme politik dalam proses impeachment Presiden?

8. • Mekanisme pemakzulan presiden adalah fitur penting dalam sistem
pemerintahan demokratis.
• Proses pemakzulan bertujuan untuk menjaga akuntabilitas kepala
negara, melindungi konstitusi, dan menjaga keseimbangan kekuasaan.
• Mekanisme pemakzulan memungkinkan lembaga legislatif dan lembaga
yudikatif untuk mengevaluasi dan mengontrol kekuasaan presiden.
• Pemakzulan adalah mekanisme untuk mengatasi penyalahgunaan
kekuasaan, korupsi, atau pelanggaran serius oleh presiden.
• Proses pemakzulan melindungi masyarakat dari pemimpin yang tidak
efektif atau yang merugikan kepentingan publik.
• Perbandingan mekanisme pemakzulan presiden di Republik Indonesia
dan Republik Korea Selatan akan memberikan wawasan lebih lanjut
tentang perbedaan dan persamaan di antara keduanya.
PEMAKZULAN (IMPEACHMENT)

9. Mekanisme impeachment di Indonesia sebelum perubahan UUD 1945 belum ada secara eksplisit disebutkan di dalam
Konstitusi baik UUD 1945 naskah asli, Konstitusi RIS, maupun UUDS 1950. Namun, pengaturan mengenai impeachment ada di
dalam TAP MPR Nomor III/MPR/1978 yang memberikan kewenangan kepada MPR untuk memberhentikan presiden. Pasca
perubahan UUD 1945 kemudian diatur di dalam Pasal 7A dan Pasal 7B UUD 1945 mengenai proses impeachment yang
melibatkan tiga lembaga yaitu DPR, MPR dan Mahkamah Konstitusi. Dimana pemutus akhir dari diberhentikannya presiden di
Indonesia yaitu di MPR. Itulah sebabnya para ahli banyak menyatakan bahwa proses impeachment di Indonesia lebih besar
unsur politiknya dibandingkan unsur hukumnya.
Mekanisme impeachment di Negara Korea Selatan diatur di dalam Pasal 63 dan Pasal 111 Konstitusi Korea Selatan yang
memperlihatkan bahwa mekanisme impeachment dilakukan dengan melibatkan dua lembaga yaitu parlemen (Majelis
Nasional) dan lembaga yudisial (Mahkamah Konstitusi). Penentuan akhir dari diberhentikan atau tidaknya seorang presiden di
Korea Selatan dilakukan di Mahkamah Konstitusi sehingga dianggap memenuhi proses hukum.

10. Pasal 7A
Presiden dan/atau Wakil Presiden dapat diberhentikan dalam masa jabatannya oleh Majelis Permusyawaratan Rakyat atas usul Dewan Perwakilan
Rakyat, baik apabila terbukti telah melakukan pelanggaran hukum berupa pengkhianatan terhadap negara, korupsi, penyuapan, tindak pidana berat
lainnya, atau perbuatan tercela maupun apabila terbukti tidak lagi memenuhi syarat sebagai Presiden dan/atau Wakil Presiden.
Pasal 7B
(1) Usul pemberhentian Presiden dan/atau Wakil Presiden dapat diajukan oleh Dewan Perwakilan Rakyat kepada Majelis Permusyawaratan Rakyat hanya
dengan terlebih dahulu mengajukan permintaan kepada Mahkamah Konstitusi untuk memeriksa, mengadili, dan memutus pendapat Dewan Perwakilan
Rakyat bahwa Presiden dan/atau Wakil Presiden telah melakukan pelanggaran hukum berupa pengkhianatan terhadap negara, korupsi, penyuapan,
tindak pidana berat lainnya, atau perbuatan tercela; dan/atau pendapat bahwa Presiden dan/atau Wakil Presiden tidak lagi memenuhi syarat sebagai
Presiden dan/atau Wakil Presiden.
(2) Pendapat Dewan Perwakilan Rakyat bahwa Presiden dan/atau Wakil Presiden telah melakukan pelanggaran hukum tersebut ataupun telah tidak lagi
memenuhi syarat sebagai Presiden dan/atau Wakil Presiden adalah dalam rangka pelaksanaan fungsi pengawasan Dewan Perwakilan Rakyat.
(3) Pengajuan permintaan Dewan Perwakilan Rakyat ke-pada Mahkamah Konstitusi hanya dapat dilakukan dengan dukungan sekurang-kurangnya 2/3 dari
jumlah anggota Dewan Perwakilan Rakyat yang hadir dalam sidang paripurna yang dihadiri oleh sekurang-kurangnya 2/3 dari jumlah anggota Dewan
Perwakilan Rakyat.
(4) Mahkamah Konstitusi wajib memeriksa, mengadili, dan memutus dengan seadil-adilnya terhadap pendapat Dewan Perwakilan Rakyat tersebut paling
lama sembilan puluh hari setelah permintaan Dewan Perwakilan Rakyat itu diterima oleh Mahkamah Konstitusi.
(5) Apabila Mahkamah Konstitusi memutuskan bahwa Presiden dan/atau Wakil Presiden terbukti melakukan pelanggaran hukum berupa pengkhianatan
terhadap negara, korupsi, penyuapan, tindak pidana berat lainnya, atau perbuatan tercela; dan/atau terbukti bahwa Presiden dan/atau Wakil Presiden
tidak lagi memenuhi syarat sebagai Presiden dan/ atau Wakil Presiden, Dewan Perwakilan Rakyat menyelenggarakan sidang paripurna untuk meneruskan
usul pemberhentian Presiden dan/atau Wakil Presiden kepada Majelis Permusyawaratan Rakyat.
(6) Majelis Permusyawaratan Rakyat wajib menyelenggarakan sidang untuk memutuskan usul Dewan Perwakilan Rakyat tersebut paling lambat tiga puluh
hari sejak Majelis Permusyawaratan Rakyat menerima usul tersebut.
(7) Keputusan Majelis Permusyawaratan Rakyat atas usul pemberhentian Presiden dan/atau Wakil Presiden harus diambil dalam rapat paripurna Majelis
Permusyawaratan Rakyat yang dihadiri oleh sekurang-kurangnya 3/4 dari jumlah anggota dan disetujui oleh sekurang-kurangnya 2/3 dari jumlah anggota
yang hadir, setelah Presiden dan/atau Wakil Presiden diberi kesempatan menyampaikan penjelasan dalam rapat paripurna Majelis Permusyawaratan
Rakyat.

14. Lembaga yang terlibat secara langsung dalam mekanisme impeachment
Presiden di Republik Indonesia adalah DPR, Mahkamah Konstitusi, dan
MPR. Lembaga yang memegang status inquisitorial institution (lembaga
inkuisitor) dalam proses tersebut adalah DPR dan MK. MK berwenang
untuk memeriksa dan mengadili putusan DPR untuk selanjutnya ditindak
lanjuti oleh MPR yang memegang kekuasaan secara utuh untuk
memberhentikan Presiden. Sedangkan di Republik Korea Selatan hanya
Majelis Nasional dan Mahkamah Konstitusi yang terlibat dalam proses
impeachment Presiden. Dalam hal ini majelis nasional berhak mengajukan
mosi impeavhment untuk selanjutnya Mahkamah Konstitusilah yang
berhak untuk memeriksa, mengadili dan memberikan keputusan final
untuk memberhentikan atau tidak memberhentikan Presiden.

15. Pasal 24C UUD NRI 1945
(1) Mahkamah Konstitusi berwenang mengadili pada tingkat pertama dan
terakhir yang putusannya bersifat final untuk menguji undang-undang
terhadap UndangUndang Dasar, memutus sengketa kewenangan lembaga
negara yang kewenangannya diberikan oleh Undang-Undang Dasar,
memutus pembubaran partai politik, dan memutus perselisihan tentang
hasil pemilihan umum.
(2) Mahkamah Konstitusi wajib memberikan putusan atas pendapat Dewan
Perwakilan Rakyat mengenai dugaan pelanggaran oleh Presiden dan/atau
Wakil Presiden menurut Undang-Undang Dasar

16. Mahkamah Konstitusi Korea Selatan baru dapat menyelenggarakan seluruh
kewenangannya setelah Undang-Undang Mahkamah Konstitusi ditetapkan
pada 1988. Berdasarkan ketentuan yang tercantum dalam Pasal 111 ayat (1)
Konstitusi Korea Selatan 1987, Mahkamah Konstitusi memiliki kewenangan
sebagai berikut:
1. Mengadili konstitusionalitas suatu undang-undang atas permintaan
Pengadilan;
2. Pemakzulan (Impeachment);
3. Memutus pembubaran partai politik yang tidak konstitusional;
4. Menyelesaikan sengketa kewenangan antar lembaga-lembaga negara; dan
5. Memutus permohonan individual.

17. 1. Di Indonesia, sifat putusan Mahkamah Konstitusi (MK) hanya sebagai
pertimbangan bagi MPR untuk memutuskan dapat tidaknya Presiden
dan/atau Wakil Presiden dimakzulkan. Tidak ada aturan mengikat yang
mengharuskan MPR mengikuti putusan MK. Jadi bisa saja putusan MK
dianulir oleh MPR melalui proses rapat paripurna yang merupakan
penentu dari proses pemakzulan Presiden dan/atau Wakil Presiden di
Indonesia.
