Fair Use
In the section 184 of RA 8293, it stipulates the limitations of copyright. One form of this
is fair use.
As presented in section 185 of the same law, fair use of copyrighted work for criticism,
comments, new reporting, teaching including limited number of copies for classroom
use, scholarship research and similar purposes is not infringement of copyright.
This section further stipulates the factors to be considered in the determining if the use
of a work is under fair use. These factors are (1) the purpose and character of the use;
whether such use is of commercial nature or is for non-profit educational purposes, (2)
the nature of copyrighted work, (3) the amount and sustainability of the portion used in
relation to the copyrighted work as a whole, (4) the effect of the use upon the potential
market value of or value of the copyrighted work.
