5. Minutes of the meeting to review the implementation of Public Procurement
(Preference to Make in India)(PPP-Mil)Order-2017 held on 14.03.2019 at Nirman
Bhawan, New Delhi under the chairmanship of Secretary, Ministry of Housing and
Urban Affairs, Nirman Bhavan, New Delhi.

A meeting on status of implementation of Public Procurement (Preference to Make in
India) (PPP-MII) Order-2017 in attached/subordinate offices and CPSEs of the Ministry was
held under the chairmanship of Secretary, MoHUA on 14.03.2019. The list of participants is
attached.
OSD (UT) & Ex. Officio JS welcomed the participants and gave a brief introduction
of PPP-MII Order-2017 issued by Department of Promotion of Industry and Internal Trade
(DPIIT) followed by a presentation by Director(MRTS-I) on PPP-MII Order and grievances
forwarded by DPIIT (list attached).
The status of grievances raised by various industrial undertaking against Smart Cities,
HUDCO, Metro Rail, CPWD, NBCC and DMRC were discussed at length. Secretary,
MoHUA stressed that PPP-MII Order should be followed by all offices under this Ministry
in letter and spirit, to promote domestic manufacturing and no restrictive/discriminative
clauses against the domestic manufactures be imposed in the tenders for public procurement.
After detailed discussion, following deci-ions were taken:
1. PPP-MII Order is also applicable in procurement by State/ULBs in
projects/Schemes fully/ partly funded by GoI as decided in Committee of Secretaries
Meeting. Respective mission directorates of this Ministry should advise the State
Govts/ULBs/Smart Cities for compliance of PPP-MII order in procurement under such
projects/schemes.

2. All mission directorates, divisions, attached/subordinate offices , CPSEs and
Metro rail companies under MoHUA should also disseminate down the order regarding
compliance of PPP-MII order and other related guidelines of GoI in procurement.

3. The procuring entities in addition to other guidelines of PPP-MII order, must follow
the following general guidelines as elaborated in PS to PM letter dated 3rd January, 2019
(copy enclosed):
(a) Indicating foreign make/brands in the tender, and thereby excluding local
manufacturers and service providers from participation, is in violation of
Public Procurement (Preference to Make in India) Order, 2017. Also, as per Rule 144(I)(b) of
GFR 2017, procuring agency shall not indicate a requirement for a particular trade
mark, tradename or a brand.
(b) As per Rule 144(iii) of GFR 2017, the technical specifications shall, to the
extent practicable, be based on the national technical regulations or recognized
national standards.

6. (c) Ministries/Departments should also ensure that their procurement entities do
not incorporate any such restrictive and discriminatory eligibility criteria regarding turnover,
specifications/testing/other standards in tender documents that exclude local
manufacturers/service providers letter and spirit, to promote domestic manufacturing and no
restrictive/discriminative clauses against the domestic manufactures be imposed in the
tenders for public procurement.

4. All mission directorates, divisions, attached/subordinate offices, CPSEs and
Metro rail eompanies under MoHUA will nominate one nodal officer each for disposal of
grievances and other issues.

5. Smart Cities, HUDCO, CPWD, NBCC and Metro Rail Companies shall dispose
of all pending grievances in consultation with DPIIT and intimate to Urban Transport

Complaints are being received, alleging that Government entities are indicating
foreign make/brands and/or restrictive conditions in their tenders, thereby excluding local
manufacturers from bidding process.
2. It may be noted that such stipulation of foreign make/brands and/or restrictive
'conditions (like mandatory requirement of certification by foreign bodies) in the tenders is
not only violative of Public Procurement (Preference to Make in India) Order, 2017 (PPP-
Mii Order 2017) Issued by DIPP, but also in violation of the General Financial Rules. In
this regard, it is necessary to follow the following general guidelines:
a. Indicating foreign make/brands in the tender, and thereby excluding local
manufacturers and service providers from participation, is in violation of Public
Procurement (Preference to Make in India) Order, 2017. Also, as per Rule 144(i)
