2. Civil service in Ukraine
The term civil service can refer to either
a branch of governmental service in
which individuals are employed (hired) on
the basis of professional merit as proven
by competitive examinations; or the body
of employees in any government agency
apart from the military, which is a
separate extension of any national
government.
3. Signs of civil service
a) is a professional activity (it can only deal with people who have the appropriate
education and training);
b) activities carried out in government and their unit (which is why homogeneous
activity in the executive committees of local governments, non-governmental
bodies not recognized public service);
c) wages in carrying out such activity paid for by public funds.
4. Functions of civil service
Functions of civil service - a direction of its activity,
reflecting its role and purpose in society.
This include:
A) ensure the effective functioning of all branches of
government
B) ensuring the rights, freedoms and legitimate interests
and duties of man and citizen
5. Law of Ukraine "On Civil Service"
Art. 4 Law on Civil Service from 17.11.2011
Right to Civil Service are citizens of Ukraine,
regardless of origin, social or economic status, race
and ethnicity, gender, political views, religious beliefs,
place of residence, have received appropriate
education and training and passed the established
competitive selection procedure or another procedure
laid down by the Cabinet of Ministers of Ukraine.
6. The main objectives of civil service
Protection of the public interest and the rights and freedoms of man and citizen
Achievements and strengthen the integrity of state
Ensuring effective activities of state bodies
Democratization ways of formation and activities of the state apparatus
The implementation of these objectives through civil servants
7. Civil servant
A civil servant or public servant is a
person in the public sector employed for a
government department or agency. The
extent of civil servants of a state as part of
the "civil service" varies from country to
country.
8. Civil servant
• Depending on the nature of authority, defining the role and degree of participation of
employees in the exercise of state and government functions, they are divided into managers,
professionals and technical staff.
Manager - a civil
servant who holds
public office related to
the direct
implementation of tasks
and functions of state
bodies.
Technical staff - it employees, service activities are not linked
to actions that entail legal consequences or affect the content
making, their eligibility is determined by the objectives of
maintaining performance management executives and
professionals by creating material, information, advisory and
other conditions necessary to perform the last official
functions.
Specialist - a public
official who has the
necessary professional
training and serves the
objectives and functions
of the public body
within the occupied
public office
9. The civil servant must act within their powers. After
receiving instructions that conflict with this law, the
public official commitment in writing immediately
report to the officer who gave the order, and if
insisting on his performance - report higher by
officials.
10. Specific duties and rights of civil
servants are determined on the basis
of standard qualification
characteristics and reflected in
official regulations and guidelines
approved by the heads of relevant
state bodies within the law and their
competence.
11. Consequently, the public service is a complex legal institution that regulates the
organization and operation of all public officials and law consists of different
areas of law, including constitutional, administrative, financial, labor, criminal,
housing, etc.
