‘Turn to natural farming as overuse of chemical fertilisers causing ill-effects’

health, Union Home
Minister Amit Shah on
Saturday urged farm-
ers to launch a “new
green revolution” in In-
dia by adopting natural
farming methods.
He said the overuse of
chemical fertilisers is
turning the farmland
infertile and therefore,
adoption of natural
farmingmethodsisvital
to restore the land qual-
ity
,increaseagricultural
production and make
farmers prosperous.
Shah was virtually
addressing farmers af-
ter launching the logo
of the Gujarat govern-
ment’s initiative for
natural farming, its mo-
bile application and e-
vans to market the pro-
duce grown using the
natural farming meth-
ods through a chain of
Farmer Producer Or-
ganisations (FPOs).
He said Prime Minis-
ter Narendra Modi has
recognized chemical
fertilisers as a major
crisis and started look-
ing for options to stop
their use while also
aiming to increase agri-
cultural production, re-
duce water consump-
tion and bring prosper-
ity for cultivators.
“Let us launch a new
greenrevolutionthrough
natural farming, which
preserves and conserves
the land for the next
many years instead of
damaging it. To achieve
this, natural farming is
the only way out,” he
said in his video interac-
tion with the farmers of
the Gandhinagar Lok
Sabha constituency that
he represents.
The cooperation min-
ister said that natural
farming, which finds
mention in old texts, is
important for the coun-
try’s future.
“Natural farming is
vital for India today, but
I can certainly see that
the entire world will
have to accept the natu-
ral farming methods
initiated by our coun-
try. The entire world
will have to accept the
importance of desi cow
(which plays a major
role in the natural farm-
ing process),” he said.
The FPOs in Gujarat
will act as a bridge be-
tween consumers and
farmers. These organi-
sations will take the
farm produce to con-
sumers after certifica-
tion. This will be the
first such system in the
country, he said.
In the last two years,
more than two lakh
farmers in Gujarat have
adopted natural farm-
ing over 2.5 hectares of
land, he said.

jarat Governor Acharya
Devvrat also worked in
the field of natural
farming, Shah said that
scientists have certified
that adoption of natural
farming restores the
land quality and turns it
more fertile, increases
production, reduces the
use of water and makes
farmers prosperous.

Kolkata: Taking into
consideration the Cov-
id-19 situation, the
West Bengal State Elec-
tion Commission (WB-
SEC) on Saturday
decided to postpone
civic body polls to Feb-
ruary 12.
The municipal elec-
tions in Asansol, Bid-
hannagar, Siliguri and
Chandannagar, which
were slated to be held
on January 22, have
been postponed to Feb-
ruary 12, the WBSEC
stated in a notification
after its meeting with
the state government.
The move comes af-
ter the Calcutta High
Court ordered the
WBSEC to explore
the possibility of de-
ferring the polls by
four to six weeks in
view of a high num-
ber of Covid cases.

Lucknow: Out of the 107 tickets announced by
BJP, 44 have gone to OBC candidates, 19 to Dalits
and ten women candidates. The BJP has repeated
as candidates all its dynasts. Pankaj Singh, son of
Defence Minister Rajnath Singh, gets another go from
Noida; so does Kalyan Singh’s grand-son Sandeep
Singh, and Mriganka Singh, daughter of the late
BJP MP Hukum Singh, who will run from Kairana,
where the BJP alleges a Hindu exodus. Yogi’s deputy,
Keshav Prasad Maurya, was desperate to contest from
Mathura - the city of the Krishna Janmabhoomi where
a movement has been launched for a new temple
to replace a mosque. Mathura will be contested by
incumbent MLA Srikanth Sharma.
Star pracharak Yogi Adityanath popularity as the
preeminent Hindutva icon is problematic for some
leaders. With the first list of candidates released by
the BJP, the PM and Amit Shah have made it clear
that they are very much in control. Yogi can cross off
some items on his wish list - the PM and Amit Shah
have endorsed him as the presumptive CM of their
party - but in retaining him in Gorakhpur and not from
Ayodhya, the PM has drawn some boundaries with
an unmistakable message to Yogi: wait your turn.
There can only be one iconic Hindutva “Hindu Hridaya
Samrat”, and currently, that position stands filled. So
no slugfest in Ayodhya, but Gorakhpur is the option.

has extended the ban on physical
rallies and roadshows for polls to
January 22 but granted relaxation
to conduct indoor meetings with
maximum 300 persons or 50% of

juries in kite-flying
accidents during the
Uttarayan festivities
in Gujarat on Friday
and Saturday
, includ-
ing 363 people in-
jured by kite strings.
About 132 cases
were reported from
Ahmedabad, followed
by41inVadodara,33in
Rajkot, 44 in Surat, 12
inBhavnagarand12in
Gandhinagar.
Most of the injuries
happened to commut-
ers,whosustainedcuts
on their throats and
faces due to kite string
hanging in public.
In Ahmedabad, the
108 service received
4,277 calls till late Sat-
urday—more than last
year’s count of 3,604
calls during the two-
day festival.
Nokite-flyingdeaths
were reported in
Ahmedabad on Friday
.
Meanwhile, in Su-
rat, 108 took 3,770 calls,
while 62 emergency
ambulances were de-
ployed in the city
. As
many as 3,770 calls
were received in Surat
cityanddistrictonSat-
urday
. Last year, 3,359
such calls were regis-
tered. This year, kite
strings left 27 people
injured, while also
causing road mishaps.
Two deaths and
some minor injuries
were reported on Sat-
urday. Further, in Ra-
jkot, a 16-year-old boy
was killed when he
chased a kite into the
path of an oncoming
train.

traditionally heralds
the beginning of
warm weather in
the state. While Union Home Minister Amit Shah did not fly kites this Uttarayan as he lost a close relative recently, he made it a point to visit the Jagannath temple when he visited Ahmedabad on Friday.

BIRDS, ANIMALS PAY THE PRICE
Firefighters, NGOs and government helplines
were called in to rescue and rescue the injured
birds during Uttarayan. Vikash Bihani of the 108
emergency service in Rajkot said, “Across Gu-
jarat, we got emergency calls for 1,371 injured
birds and animals on helpline 1962 of which
731 cases were for animals and 640 for birds
on Friday.” The Ahmedabad fire department also
rescued 35 birds trapped by rogue manjha in
trees. About 500 birds were injured in the city.

Valsad: The Mumbai-
Delhi Rajdhani Ex-
press train hit a ce-
ment pillar, which
some miscreants had
allegedly placed on
the railway track
near Valsad in south
Gujarat, although no
passenger was in-
jured, police officials
said on Saturday
.
The police suspect
that the incident,
which took place
around 7.10 pm on Fri-
day, was an attempt to
derail the Delhi-bound
train. They have regis-
tered a case in this
connection.
“The Mumbai-Haz-
rat Nizamuddin Au-
gust Kranti Rajdhani
Express train hit the
cement pillar placed
on the railway track
close to Atul station
near Valsad. After be-
ing hit by the train,
the pillar got pushed
off the track. The in-
cident did not affect
the train as it moved
on and no passenger
was hurt. The loco pi-
lot immediately in-
formed the Atul rail-
way station personnel
about it,” an official
of Valsad rural police
station said.
On being alerted,
senior police and rail-
way officials rushed
to the spot.
“Some miscreants
had placed the cement
pillar on the track.
The train hit the pil-
lar, after which the
train manager imme-
diately informed the
local station master,”
Rajkumar Pandian,
Range, IG of Surat,
told reporters.
It appeared to be a
case of attempt to de-
rail the train, he said,
adding that the police
are conducting an in-
vestigation into the
matter.
An FIR was lodged
against unidentified
miscreants at Valsad
rural police station,
and efforts are on to
nab the culprit using
technical surveillance
and human intelli-
gence, the Valsad rural
police official said.

Ahmedabad: The
state should pass a
bill under which
MLAs and ministers
should only be paid
minimum wages. It
should also stop
granting permission
to private schools,
and only government-
run primary, second-
ary and higher sec-
ondary schools must
exist—these are a few
demands made by ac-
tivist and farmer
leader Bharatsinh
Zala in a letter to
Chief Minister Bhu-
pendra Patel.
Rather than giving
MLAs and ministers
any additional allow-
ances, Zala feels the
money can be used for
developing their respec-
tive constituencies. The
state can also pay a
monthly remuneration
of Rs2,000 to disable
women, widows, senior
citizens and persons
with disabilities, he
said.
He has also argued
that if a person gets full
compensation for his/
her work, then there is
no reason to extend any
financial help or gov-
ernment schemes or
policies.
The whole motive
and idea behind the
Right to Information
Act were to make the
system transparent, but
it has failed. If the pub-
lic information officer
fails to share informa-
tion, then their senior
should immediately is-
sue a show-cause no-
tice, and on receiving a
dissatisfactory explana-
tion the officer should
be terminated.
Private education is
becoming unaffordable
to middle and lower-
middle-class society. It
is high time that the
state takes total respon-
sibility for education
and stops privatization
of education, demands
the activist.

Gandhinagar: Guja-
rat on Saturday re-
ported seven COV-
ID-19 fatalities, the
highest rise in a sin-
gle day in the last few
months, taking the
overall toll to 10,151.
However, the new
cases in the state
dropped for the second
consecutive day on Sat-
urday with the registra-
tion of 9,177 infections,
raising the overall tally
to 9,16,090, the Gujarat
health department said.
Ahmedabad district
collector Sandip Sagale
is among the day’s addi-
tions and is under home
isolation, officials said,
adding that Jamnagar
collector Saurabh Par-
dhi and municipal com-
missioner Vijay Khara-
di also tested positive
for COVID-19.
Of the seven fresh fa-
talities, Surat reported
three deaths,
Ahmedabad two, while
Navsari and Rajkot
each saw one fatality,
the department said.
With a total of 5,404
patients discharged
during the day
, the num-
ber of recoveries in Gu-
jarat increased to
8,46,375, the department
said in a release.
Gujarat is now left
with 59,564 active cases.
The condition of 60 of
them is critical.
Ahmedabad (2,621),
Surat (2,214), Vadodara
(1,211) and Rajkot (438)
accounted for over 70
per cent of the total
fresh infections.
Ahmedabad district
reported the highest
number of 2,666 new
cases, followed by 2,496
infections in Surat,
1,298 in Vadodara, 587
in Rajkot, 250 in
Bhavnagar, and 218 in
Gandhinagar, the re-
lease said.
A total of 1.76 lakh
people were adminis-
tered COVID-19 doses
on Saturday, taking the
total number of the dos-
es administered in Gu-
jarat to 9.46 crore, it
said.

Ahmedabad: A Class I
officer with the agri-
culture department
has filed a criminal
complaint against her
husband and in-laws
for domestic violence,
criminal intimidation,
mental and physical
assault.
Kalpnaben Panchal
on Friday, filed a com-
plaint with the Gandhi-
nagar Women Police
Station alleging that
her husband Jayesh
Panchal, father-in-law
Manilal Panchal and
other family members
were beating and men-
tally torturing her. In
2003, she married
Jayesh, a love marriage
not supported by her
parents. The couple has
two children.
After the birth of the
second child in 2008, her
husbandstartedsuspect-
ing her of having an ex-
tramarital relation as a
result he started beating
and harassing her. If she
refused to give her sala-
ry
, he would beat her
and, if she complained
tothein-laws,theywould
further instigate Jayesh
against her.
The complainant has
even alleged that when
her in-laws came to stay
with them, her father-in-
law Manilal used to ob-
jectionablytouchher.He
had also written a love
letter to her. When she
complained to her hus-
bandaboutherfather-in-
law’s acts, she was asked
to do as his father asked
her to do. If she did not
surrender to her father-
in-law, her husband
threatened to kill their
son. In November 2021,
she was also pushed out
of her house, as her hus-
band had a sex worker
visitinghim.Theywould
threaten and beat her if
she did not agree to a di-
vorce. The case is under
investigation by Police

Ahmedabad: About
50 residents of the
city’s Vejalpur area
took to the zonal of-
fice on Saturday to
protest against wa-
ter scarcity in their
locality after written
representations over
the past three
months failed to
draw any attention
from the authorities.
Protesters say many
societies have been ex-
periencing very low
water pressure with
some houses receiving
no water at all.
“Problems arise due
to lack of regular sup-
ply. Earlier, the water
was pumped from a
tank in the area, but
now it’s pumped from
a tank in Makarba,
which is a contribut-
ing factor to the water
supply problems,” the
letter stated.
Deputy City Engi-
neer Amit Patel said
that the water tank at
Makarba has been des-
ignated as the area’s
main pumping station
after the Vejalpur tank
was decommissioned.
“Some of the socie-
ties located in upper
lying areas also have
issues. At present, a
valve has been placed
in the water delivery
system to increase the
pressure in the net-
work and the issue will
be solved,” Patel said.

Rajkot: Around two
years back, a new-
born girl child was
found abandoned on
the outskirts of Ra-
jkot. The baby was
suffering from
around 20 deep
wounds and dog bites.
On Saturday, an Ital-
ian couple adopted
the baby from the
114-year-old Kathi-
yawad Balashram.
The newborn strug-
gled between life and
death for three months
and, later was sent to
Kathiyawad Balash-
ram. Including the for-
mer chief minister Vi-
jay Rupani everyone
prayed for the child’s
quick recovery. The
child was named ‘
Amba’
by the Rajkot police
commissioner Manoj
Agarwal.
Speaking to First In-
dia Balashram presi-
dent, Haresh Vora said,
“Amba is completely fit
and healthy
. We handed
her to the Italian couple
Gunther and Katrina
Planck. Katrina works
at a hospital and, she
said she will take leave
for one-and-a-half-year
to look after and raise
Amba. In the past, the
couple had adopted a
two-year-old male child
from Chhattisgarh who
is now six years old.”
“Over 375 children of
Balashram have been
adopted by foreign par-
ents—75 in Germany
and around 700 in In-
dia. Currently, we have
120 children from age
three months to 18,”
Vora added.

NEXT CRISIS
he Russian threat to
Ukraine is not only
potential crisis in
Eastern Europe this
year. Bosnia  Herze-
govina is heading for a period of
deep political turmoil, with a key
election scheduled for October.
Bosnia has never been an un-
complicated place. In the late 19th
and early 20th century, it gener-
ated one crisis after another,
eventually contributing to the
outbreak of World War I. Then,
with the breakup of Yugoslavia
in the late 20th century, it was the
site of a brutal war between Bos-
nian Muslims (Bosniaks), Serbs,
and Croats. Dayton Accords end-
ed the conflict in 1995, after over
100,000 people had been killed.
Bosnia should be doing much
better than it is 26 years after the
war ended. Instead, another deep
crisis looms. The Bosnian Serb
leader, Milorad Dodik, is beating
nationalist drum and pushing for
Republika Srpska to assert even
greater independence vis-à-vis
the central government. The
rhetoric is intensifying on all
sides, leading to calls for another
international intervention.

n a stunning move that has
stirred the cricketing world,

captaincy of Team India even
in Test Cricket. Kohli an-
nounced his decision through
social media on Saturday
evening. He wrote, “every-
thing has to come to a halt at
some stage and for me as Test
captain of India, it’s now.”
While tongues are wagging
about the reasons behind the
sudden announcement, it is
the ending of an exceptional
run which made Kohli the
most successful captain of In-
dia ahead of M.S.Dhoni and
Sourav Ganguly
.
His admirable leadership
qualities took the Indian Test
team to unprecedented suc-
cess as he led India to 40 wins
in the total 68 test matches
where he was the skipper.
Under Kohli, India won their
first Test series in Australia
and also lead 2-1 against Eng-
land on their home turf.
Along with Shastri, he
turned Team India into a for-
midable force in Test Cricket.
Most importantly, his being
at the helm made sure that
world class fitness became a
necessity for anyone to be an
integral part of the Indian
team. Apart from all the
cricketing achievements as
captain, he will be known as
someone who changed the
image of Indian cricketers as
rather laidback and slow on
the field to being fast and
sprightly athletes.
He took over the mantle of
captaincy from M.S. Dhoni in
2014-15 on a tour to Australia
where his own batting form
had stunned the world. He
had big shoes to fill in, but he
rapidly took the Indian Test
Team from the seventh spot
in rankings to number one in
the last seven years. Apart
from overhauling fitness,
Kohli also brought about a
change in mindset when the
playing eleven consistently
played with five bowlers. Pre-
viously, Dhoni preferred to
have a batsman extra and
played with four bowlers. But
Kohli talked about getting 20
wickets regularly and insist-
ed on the batters to take on
more responsibility

His decision comes a day af-
ter India lost against South
Africa 2-1. It was a series
marked as India’s final fron-
tier as they had never won a
series in South Africa. Kohli’s
men were the favorites and it
looked like history was about
to be made after India won the

Indian Captain. Though Vi-
rat’s own batting showed

nowhere near his best. His
invaluable 79 in the first in-
nings of the last Test was a
laboured effort and a rather
un-Kohli knock.
But Kohli fans have always
been treated to great batting
while he was captain. Most
captains find it difficult to
better their averages leading
the side with extra responsi-
bilities, but not Kohli. He av-
eraged 54.8 and made 5864
runs with 20 hundreds in 68
Tests as Captain. He also
missed a couple of records by
a whisker as he was just a
century short of going ahead
of Ricky Ponting as the Cap-
tain with most centuries.
Moreover, Kohli was just a
win away from surpassing
Steve Waugh as the second
most successful Test Captain
. Also, India never lost a Test
series at home under Kohli,
winning all 11 series played.
His decision has left many
peoplesurprised.Lastmonth,
there was a huge controversy
over his sacking from One
Day captaincy and Virat went
on record to say that he
wasn’t made aware of the de-
cision earlier by selectors.
His strained relationship
with BCCI boss, Sourav Gan-
guly, may have also led to Vi-
rat deciding to leave Test Cap-
taincy in order to avoid two
power centers along with Ro-
hit Sharma. Maybe, it was old
cricketing wisdom at play,

OLD LAW
Before the Finance Act 2021 was
introduced, the department could
reopen or reassess income upto
four or maximum upto six 6
years (as the case may be) by is-
suing notices under section 148
of the Act, meaning thereby, the
return of income for assessment
year 2014-15 could be reopened
up to 31st March 2021. For
extending the period from four
to six years it was required that
income which was chargeable to
tax and had escaped assessment
was one lakh rupees or more due
to fault of assessee. The assess-
ing officer had to have reasons to
believe that income had escaped
from assessment. Such reopen-
ing of assessment was subject to
various legal issues which led to
multiple litigations.
NEW LAW
Finance Act 2021 brought amendments in sections 147 to 151 of the Act thereby changing
the scheme of reassessment of income. A new section 148A was introduced along with change in
timelines, which prescribed the procedure to initiate the reassessment proceedings wherein the
Assessing Officer has been made duty bound to have some information first, conduct
enquiry after seeking approval from appropriate authority
(procedure prescribed), give opportunity to assessee,
seek reply and pass an order forming his belief,
before issuing notices for reassessment. The time
period for reopening has been reduced to 3
years, i.e. no notices for the assessment year
2017-18 and prior could be reopened after
1st April 2021. In cases where the assess-
ing officer possesses certain evidences/
documents that income chargeable to tax,
represented in the form of assets more
than fifty lakhs has escaped assess-
ment, a time limit of ten years has been
prescribed, subject to adequate approval
and procedure as prescribed in 148A be-
ing followed. The department vide the said
amendment and tried its best to reduce the
various legal issues, which were prominent
in old regime.
COVID AND ITS INTERPLAY
WITH NEW LAW
COVID-19 had disrupted the
entire timelines and machinery
of government due to distress
amongst the tax payers and
government keeping a soft
hand. Due dates for compli-
ances under various laws
were revised from time to
time to enable effective work-
ing as per deadlines.
Accordingly, with
respect to issuance of
reassessment notices,
the timeline of notices which
could be issued upto 31st
March 2021 was revised upto
30th June 2021, as numerous
notices could not be
issued by department
due to COVID disrup-

JUDICIAL RELIEF TO TAXPAYERS
CONTROVERSY
After the introduction of new law, various contro-
versies (legal issues) arose with respect to notices
for assessment years 2017-18 and period prior
to the same issued by the department after 1st
April 2021, specially with respect to notices for AY
2013-14, 2014-15  2015-16. First that the time
limit available with the Income Tax department
was just three years beyond which
the notices could not have
been issued and second that the department had
to compulsorily follow the procedure prescribed
in new section148A of the Act, failing which the
notices issued and reassessment proceedings
were void in this regard. Later it was also argued
by tax payers that the legislature has permitted
re-assessment to be made only in accordance
with the substituted provisions, which
could be done either only
in the manner
prescribed, or no
re-assessment
at all.

except Chhatisgarh High
Court which has upheld the
issuances of notices as per
old law and within extended
timelines to be valid. Honor-

held that the
amended law
needs to be
followed and
the assessing
officers be-
fore issuing
the notices

and time lines for issuing
of notices. It was held that
the intent, purpose and
scope of the amendments
introduced by the Finance
act, 2021 was to protect the
rights and interests of as-
sessees as well as promote
public interest. It is settled
law that if legislation is
introduced to remedy the
defective rule and no one
suffers thereby, it is sen-
sible to apply it to pending
proceedings. Though relief
has been granted by many
courts still Income Tax be-
ing a jurisdictional issue all
notices falling only under
High Courts which have
quashed the notices would
get relief and for other
courts which are against
the assessee’s unless the
Supreme Court distin-
guishes the order of High
Courts relief is delayed.
Accordingly for the
benefit of taxpayers va-
lidity of notices issued
after 1st April 2021 for
assessment years prior
to 2018-19 the relief
can be summarized in
table.
Out of the various
modes of assessing the
income, the department
relies upon the
provisions of section 147
of the Income Tax Act
to identify and tax the
income which has
escaped assessment in
course of regular
scrutiny procedures.
Without adopting the new procedure by the issuing authority
were valid or not, has been settled to a great extent by the
Allahabad, Delhi, Mumbai and Rajasthan High Courts, which
have quashed the notices issued after 1st April 2021.

ment has decided to
roll out a subsidy of
Rs12,060 crore in the
next five years to up-
grade textile technolo-
gies and provide an
impetus to the sector.
The decision was tak-
en during a recent meet-
ing of the ministry of
textile authorities with

South Gujarat Chamber
of Commerce to uplift
the textile industry

The ministry has
planned to give a 25-30%
subsidy on capital in-
vestment for small- and
medium-scale indus-
tries. It will be provided
by the Central govern-
ment. The new scheme
could be implemented
from April 1.
A meeting was also
held with textile traders
under the leadership of
textile secretary
, Upen-
dra Singh.

see a provision of Rs280
crore with Rs1,230 crore
subsidy for textile mills.
Besides, Rs1,625 crore
will be earmarked for
garment manufacturing
and Rs150 crore conces-

man allegedly gunned
down two persons
during a clash be-
tween two groups of
a community in Por-
bandar, police said on
Saturday.
An case has been reg-
istered against 11 per-
sons, including local
BJP councillor Bhima
Odedara and his son
Nilesh, for the incident
that took place on Fri-
day night.
The two groups held
a grudge against each
other over some past
dispute about the mu-
nicipality election held
in February last year,

“Last night, some
members of two groups
from Maher communi-
ty clashed. One of them
was a former Army

weapon. Two persons
died from shots fired

lice, the clash erupted

members of the two
groups were hit, follow-

ther added Nisar’s
father died two days
before his marriage.
After his marriage,
Nisar decided to ac-
cess the folder to see
his father’s photos
but, he found that the
folder was locked, on
his computer.
When he tried to ac-
cess the folder, he re-
ceived a message from
the hacker demand-
ing ransom money
within minutes. He
then reached out to
the cycbercrime
branch for help.

  • 1. ‘Turn to natural farming as overuse of chemical fertilisers causing ill-effects’ First India Bureau Ahmedabad: Pointing out that the overuse of chemical fertilisers is creating an adverse im- pact on the quality of land, water and human health, Union Home Minister Amit Shah on Saturday urged farm- ers to launch a “new green revolution” in In- dia by adopting natural farming methods. He said the overuse of chemical fertilisers is turning the farmland infertile and therefore, adoption of natural farmingmethodsisvital to restore the land qual- ity ,increaseagricultural production and make farmers prosperous. Shah was virtually addressing farmers af- ter launching the logo of the Gujarat govern- ment’s initiative for natural farming, its mo- bile application and e- vans to market the pro- duce grown using the natural farming meth- ods through a chain of Farmer Producer Or- ganisations (FPOs). He said Prime Minis- ter Narendra Modi has recognized chemical fertilisers as a major crisis and started look- ing for options to stop their use while also aiming to increase agri- cultural production, re- duce water consump- tion and bring prosper- ity for cultivators. “Let us launch a new greenrevolutionthrough natural farming, which preserves and conserves the land for the next many years instead of damaging it. To achieve this, natural farming is the only way out,” he said in his video interac- tion with the farmers of the Gandhinagar Lok Sabha constituency that he represents. The cooperation min- ister said that natural farming, which finds mention in old texts, is important for the coun- try’s future. “Natural farming is vital for India today, but I can certainly see that the entire world will have to accept the natu- ral farming methods initiated by our coun- try. The entire world will have to accept the importance of desi cow (which plays a major role in the natural farm- ing process),” he said. The FPOs in Gujarat will act as a bridge be- tween consumers and farmers. These organi- sations will take the farm produce to con- sumers after certifica- tion. This will be the first such system in the country, he said. In the last two years, more than two lakh farmers in Gujarat have adopted natural farm- ing over 2.5 hectares of land, he said. Pointing out that Gu- jarat Governor Acharya Devvrat also worked in the field of natural farming, Shah said that scientists have certified that adoption of natural farming restores the land quality and turns it more fertile, increases production, reduces the use of water and makes farmers prosperous. About 132 cases were reported from Ahmedabad, followed by41inVadodara,33in Rajkot, 44 in Surat, 12 inBhavnagarand12in Gandhinagar. Most of the injuries happened to commut- ers,whosustainedcuts on their throats and faces due to kite string hanging in public. In Ahmedabad, the 108 service received 4,277 calls till late Sat- urday—more than last year’s count of 3,604 calls during the two- day festival. Nokite-flyingdeaths were reported in Ahmedabad on Friday . Meanwhile, in Su- rat, 108 took 3,770 calls, while 62 emergency ambulances were de- ployed in the city . The police suspect that the incident, which took place around 7.10 pm on Fri- day, was an attempt to derail the Delhi-bound train. They have regis- tered a case in this connection. “The Mumbai-Haz- rat Nizamuddin Au- gust Kranti Rajdhani Express train hit the cement pillar placed on the railway track close to Atul station near Valsad. After be- ing hit by the train, the pillar got pushed off the track. The in- cident did not affect the train as it moved on and no passenger was hurt. The loco pi- lot immediately in- formed the Atul rail- way station personnel about it,” an official of Valsad rural police station said. On being alerted, senior police and rail- way officials rushed to the spot. “Some miscreants had placed the cement pillar on the track. The train hit the pil- lar, after which the train manager imme- diately informed the local station master,” Rajkumar Pandian, Range, IG of Surat, told reporters. It appeared to be a case of attempt to de- rail the train, he said, adding that the police are conducting an in- vestigation into the matter. An FIR was lodged against unidentified miscreants at Valsad rural police station, and efforts are on to nab the culprit using technical surveillance and human intelli- gence, the Valsad rural police official said. First India Bureau Ahmedabad: The state should pass a bill under which MLAs and ministers should only be paid minimum wages. It should also stop granting permission to private schools, and only government- run primary, second- ary and higher sec- ondary schools must exist—these are a few demands made by ac- tivist and farmer leader Bharatsinh Zala in a letter to Chief Minister Bhu- pendra Patel. Rather than giving MLAs and ministers any additional allow- ances, Zala feels the money can be used for developing their respec- tive constituencies. First India Bureau Gandhinagar: Guja- rat on Saturday re- ported seven COV- ID-19 fatalities, the highest rise in a sin- gle day in the last few months, taking the overall toll to 10,151. However, the new cases in the state dropped for the second consecutive day on Sat- urday with the registra- tion of 9,177 infections, raising the overall tally to 9,16,090, the Gujarat health department said. Ahmedabad district collector Sandip Sagale is among the day’s addi- tions and is under home isolation, officials said, adding that Jamnagar collector Saurabh Par- dhi and municipal com- missioner Vijay Khara- di also tested positive for COVID-19. Of the seven fresh fa- talities, Surat reported three deaths, Ahmedabad two, while Navsari and Rajkot each saw one fatality, the department said. With a total of 5,404 patients discharged during the day , the num- ber of recoveries in Gu- jarat increased to 8,46,375, the department said in a release. Kalpnaben Panchal on Friday, filed a com- plaint with the Gandhi- nagar Women Police Station alleging that her husband Jayesh Panchal, father-in-law Manilal Panchal and other family members were beating and men- tally torturing her. In 2003, she married Jayesh, a love marriage not supported by her parents. The couple has two children. After the birth of the second child in 2008, her husbandstartedsuspect- ing her of having an ex- tramarital relation as a result he started beating and harassing her. If she refused to give her sala- ry , he would beat her and, if she complained tothein-laws,theywould further instigate Jayesh against her. The complainant has even alleged that when her in-laws came to stay with them, her father-in- law Manilal used to ob- jectionablytouchher.He had also written a love letter to her. When she complained to her hus- bandaboutherfather-in- law’s acts, she was asked to do as his father asked her to do. If she did not surrender to her father- in-law, her husband threatened to kill their son. In November 2021, she was also pushed out of her house, as her hus- band had a sex worker visitinghim.Theywould threaten and beat her if she did not agree to a di- vorce. First India Bureau Ahmedabad: About 50 residents of the city’s Vejalpur area took to the zonal of- fice on Saturday to protest against wa- ter scarcity in their locality after written representations over the past three months failed to draw any attention from the authorities. Protesters say many societies have been ex- periencing very low water pressure with some houses receiving no water at all. “Problems arise due to lack of regular sup- ply. Earlier, the water was pumped from a tank in the area, but now it’s pumped from a tank in Makarba, which is a contribut- ing factor to the water supply problems,” the letter stated. Deputy City Engi- neer Amit Patel said that the water tank at Makarba has been des- ignated as the area’s main pumping station after the Vejalpur tank was decommissioned. “Some of the socie- ties located in upper lying areas also have issues. At present, a valve has been placed in the water delivery system to increase the pressure in the net- work and the issue will be solved,” Patel said. For extending the period from four to six years it was required that income which was chargeable to tax and had escaped assessment was one lakh rupees or more due to fault of assessee. The assess- ing officer had to have reasons to believe that income had escaped from assessment. Such reopen- ing of assessment was subject to various legal issues which led to multiple litigations. NEW LAW Finance Act 2021 brought amendments in sections 147 to 151 of the Act thereby changing the scheme of reassessment of income. A new section 148A was introduced along with change in timelines, which prescribed the procedure to initiate the reassessment proceedings wherein the Assessing Officer has been made duty bound to have some information first, conduct enquiry after seeking approval from appropriate authority (procedure prescribed), give opportunity to assessee, seek reply and pass an order forming his belief, before issuing notices for reassessment. The time period for reopening has been reduced to 3 years, i.e. no notices for the assessment year 2017-18 and prior could be reopened after 1st April 2021. In cases where the assess- ing officer possesses certain evidences/ documents that income chargeable to tax, represented in the form of assets more than fifty lakhs has escaped assess- ment, a time limit of ten years has been prescribed, subject to adequate approval and procedure as prescribed in 148A be- ing followed. The department vide the said amendment and tried its best to reduce the various legal issues, which were prominent in old regime. COVID AND ITS INTERPLAY WITH NEW LAW COVID-19 had disrupted the entire timelines and machinery of government due to distress amongst the tax payers and government keeping a soft hand. Due dates for compli- ances under various laws were revised from time to time to enable effective work- ing as per deadlines. Accordingly, with respect to issuance of reassessment notices, the timeline of notices which could be issued upto 31st March 2021 was revised upto 30th June 2021, as numerous notices could not be issued by department due to COVID disrup- tion. JUDICIAL RELIEF TO TAXPAYERS CONTROVERSY After the introduction of new law, various contro- versies (legal issues) arose with respect to notices for assessment years 2017-18 and period prior to the same issued by the department after 1st April 2021, specially with respect to notices for AY 2013-14, 2014-15 2015-16. First that the time limit available with the Income Tax department was just three years beyond which the notices could not have been issued and second that the department had to compulsorily follow the procedure prescribed in new section148A of the Act, failing which the notices issued and reassessment proceedings were void in this regard. Later it was also argued by tax payers that the legislature has permitted re-assessment to be made only in accordance with the substituted provisions, which could be done either only in the manner prescribed, or no re-assessment at all. ❍ A.Y. UPTO 2014-15 Cannot be reopened ❍ A.Y. 2015-16, 2016-17 AND 2017-18 Can be reopened subject to new procedure u/s 148A only if the income escaping assessment is more than 50 lacs, rewpresented by an asset. Void if new procedure not followed. ❍ A.Y. 2018-19 ONWARDS Can be reopened subject to new procedure u/s 148A as per amended law. The controversy that whether the department was right in issuing notices after 1st April 2021, as it had increased the time lines legally and whether the said extended timeline were ultra vires the provisions of law and notices issued without adopting the new procedure by the issuing authority were valid or not, has been settled to a great extent by the Honorable Allahabad, Delhi, Mumbai and Ra- jasthan High Courts, which have quashed the notices issued after 1st April 2021 being ultra vires the amend- ed provisions of the Act, except Chhatisgarh High Court which has upheld the issuances of notices as per old law and within extended timelines to be valid. Honor- able Delhi High Court in the case of Monmohan Kohli and Honor- able Rajasthan High Court in the case of BPIP Infra Pvt. Ltd. have specifically held that the amended law needs to be followed and the assessing officers be- fore issuing the notices must have fol- lowed the amended provisions of conduct- ing enquiry and time lines for issuing of notices. It was held that the intent, purpose and scope of the amendments introduced by the Finance act, 2021 was to protect the rights and interests of as- sessees as well as promote public interest. It is settled law that if legislation is introduced to remedy the defective rule and no one suffers thereby, it is sen- sible to apply it to pending proceedings. Though relief has been granted by many courts still Income Tax be- ing a jurisdictional issue all notices falling only under High Courts which have quashed the notices would get relief and for other courts which are against the assessee’s unless the Supreme Court distin- guishes the order of High Courts relief is delayed. Accordingly for the benefit of taxpayers va- lidity of notices issued after 1st April 2021 for assessment years prior to 2018-19 the relief can be summarized in table. Out of the various modes of assessing the income, the department relies upon the provisions of section 147 of the Income Tax Act to identify and tax the income which has escaped assessment in course of regular scrutiny procedures. Without adopting the new procedure by the issuing authority were valid or not, has been settled to a great extent by the Allahabad, Delhi, Mumbai and Rajasthan High Courts, which have quashed the notices issued after 1st April 2021.
