* Individuals with Disabilities Education Act
* Governs all special education services and provides
some funding to state and local education agencies
to guarantee special education and related services
for those students who meet the criteria for eligibility
* To qualify, a child must have one of the identified
disabilities AND it must adversely affect their
educational performance.
* Every school district has the legal responsibility to
identify, locate and evaluate children who are in need
of special education services.
* A child identified for services under IDEA must meet
specific criteria

4. ADA
* Americans with Disabilities Act
* Title I of the Americans with Disabilities Act of
1990 prohibits private employers, state and local
governments, employment agencies and labor
unions from discriminating against qualified
individuals with disabilities in job application
procedures.
* Includes any individual with a disability
* Includes the need to make accommodations for
people with disabilities. Including: redesigned
equipment, assigning “aides”, accessibility, altering
facilities.
* Evaluations/documentation of disability are the
student’s responsibility and expense.
5. SECTION 504
* Section 504, a civil rights law, prohibits discrimination on the
basis of disabling conditions by programs and activities receiving
or benefiting from federal financial assistance.
* This statute does not require the federal government to
provide additional funding for students identified with special
needs.
* Covers individuals who meet the definition of qualified
"handicapped" person.
* For a child to be identified as eligible for services under Section
504, there are less specific procedural criteria that govern the
requirements of the school personnel.
*Decisions about the child, evaluation data, and placement
options are made by knowledgeable individuals.
* The decisions made about the child do not need written
consent of the parents, they only need to notify the parents.
6. ESSA
* Every Student Succeeds Act
* The most modern law that uses NCLB as the basis.
* This law allows educational systems to be much more focused on teaching and
learning, and that gives states and educators more latitude while maintaining federal
funds for the students who need it most.
* There are four pillars included to allow a strong and purposeful public education:
promoting children’s well-being; supporting powerful learning; building teacher and
staff capacity; and fostering cultures of collaboration among educators,
administrators, families and communities.
* ESSA and NCLB have the same testing requirements.
