5. Education of Mentally Retarded Children Act of 1958 In 1958 the Illinois Supreme Court held that a provision of the state constitution calling on the state to provide a system of free schools so all children could receive a good education did not apply to a child described as "mentally deficient or feeble minded." In 1958 Congress appropriated $1 million to help prepare teachers of mentally retarded children. Thenceforward, federal aid for the handicapped steadily increased.
