This document provides an overview of copyright, fair use, and plagiarism. It discusses that copyright is a legal protection that promotes progress in arts and sciences by protecting creators' exclusive rights to their work for their lifetime plus 70 years. Fair use is an exception that allows use of copyrighted works without permission if the use is deemed "fair" based on four factors. Plagiarism is presenting another's work as one's own without proper attribution. It encourages properly citing sources to avoid plagiarism accusations that can result in sanctions like reduced grades or suspension.
4. Disclaimer
I am not an expert in Copyright, Fair Use, or
Plagiarism.!
Copyright & Fair Use info is based on U.S.
Copyright Office !
(U.S. Gov't Info does not have copyright protection
so borrow at will but make sure you cite it). !
Plagiarism info is based on Indiana University's
Tutorial
8. Fair Use
An exception to the copyright law's
"exclusive" rights to authors!
If the "use" is "fair" then no
permission is necessary!
Otherwise, you have to ask authors/
creators for permission
9. Fair Use = Four
Factors
"purpose and character of the use" - is the use commercial
nature or nonprofit/educational!
"nature of the copyrighted work" - is it a creative work? is
it unpublished?!
"amount and substantiality" of the part used vs. the entire
copyrighted work!
Market effect - "effect of the use upon the potential
market...of the copyrighted work" (section 107 of copyright
law)
10. Fair Use = Four
Factors
The more factors in your favor, the more
likely that it is a "fair use exception"!
It is not a simple equation because it's a
complicated legal issue
13. SUNY Cortland's
Plagiarism Sanctions
"Potential sanctions...reduction of
grade, elimination of grade,
reduction of course grade, failure
for the course, probation, suspension,
counseling, expulsion from the
College or any combination of these
sanctions."
14. Paraphrasing
summarizing someone else's idea or
work!
IN YOUR OWN WORDS!
citing the author (e.g. According to
Smith (2011), ... (p. 205).!
If you don't use your own words or cite
then you have plagiarized.
15. Direct Quotes
Why is there a slide for this? You
know what a direct quote is.!
Similar to paraphrasing, if you don't
use "" and an in-text citation you
have plagiarized.
16. In-text citation with
References/Works Cited/
Bibliography
Proper citation requires both in-text
(aka parenthetical) citation!
AND a full reference at the end of
your paper!
Why?
18. "SafeAssign™ is a plagiarism prevention
service, offered by Blackboard...This
service helps educators prevent
plagiarism by detecting unoriginal
content in student papers. "!
I will probably be using this service for
submission of your final essays.
19. Plagiarism vs.
Copyright
Plagiarism is different than copyright
infringement!
Copyright is a LEGAL issue involving
unsanctioned use of someone's work;!
Plagiarism is an ETHICAL issue involving
unacknowledged use of someone's work!
You cannot copyright an IDEA but you can
plagiarize one.
20. Why do you need
to know this?
Law Suits:!
- "copyright trolls"!
- Cold Play v. Joe
Satriani!
- Capitol v. Thomas
Reputation Damage!
- MLK!
- Joe Biden, 1988
