बालयौन दुव्र्यवहार सम्बन्धी संक्षिप्त जानकारी पत्र बालयौन दुव्र्यवहार एक दण्डनिय अपराध हो । यस्तो अपराध विरुद्ध हामीले आवाज उठाएनौ भने यस्ता अपराधमा संलग्न व्यक्तिको मनोबल बढ्दछ र यस्तो अपराध दिनप्रतिदिन समाजमा बढ्दै जान्छ । यसर्थ यसका विरुद्ध आफु पनि बोलौ र अरुलाई पनि बोल्न प्रेरित गरौं । बालयौन दुव्र्यवहार भन्नाले कुनै वयस्क, पाको मानिस वा ठूला बालबालिकाले सानो बालबालिकामाथि यौन आसय झल्किने गरी गरिने व्यवहार नै बालयौन दुव्र्यवहार हो । यौन दुव्र्यवहार छोएर र नछोइकन दुवै किसिमबाट हुन सक्छ । सामान्यतया मानिसहरुमा छोएर गरिने केही यौनदुव्र्यवहारबाट मात्र बालबालिकामा नकारात्मक असर पर्दछ भन्ने बुझाई रहेको छ । तर यौन दुव्र्यवहारका दुवै पक्ष उत्तिकै घातक छन् र यसले बालबालिकाको समग्र विकासमा असर पार्दछ । यौन दुव्र्यवहार जँहा जतिबेला पनि र जोबाट पनि हुन सक्छ ।

नेपालकाे संविधानमा महिला अधिकार संविधान नेपालको मूल कानुन हो । संविधानले देशको राज्य तथा शासन सञ्चालन प्रकृया सुनिश्चित गर्दछ । संविधानको आधारमा देशमा अन्य सम्पूर्ण कानून, नीति, नियमहरु बन्दछन् । यसकै आधारमा कार्यपालिका, व्यवस्थापिका तथा न्यायपालिका गठन हुन्छ । सरकारका विभिन्न अङ्गहरुबीच काम कर्तव्य तथा शक्तिको विभाजनका साथै तीनीहरुबीचको सु–सम्बन्ध समेत सुनिश्चित गर्दछ । संविधानले नागरिकको मौलिक अधिकारको व्यवस्था गर्नका साथै ती अधिकारहरुको संरक्षणको व्यवस्था समेत गरेको हुन्छ । संविधानसँग बाझिने अन्य कानुन बाझिएको हदसम्म अमान्य हुन्छन् । नेपालको संविधान २०७२ नेपालको विद्यमान संविधान हो । यो संविधान जनाताका प्रतिनिधिले पारित गरेको पहिलो र नेपालको साताँै संविधान हो । यस संविधानमा ३५ भाग, ३०८ वटा धारा, ९ वटा अनुसूचिहरु रहेका छन् । राज्य सञ्चालन तथा अन्य क्षेत्रमा महिलाहरुको अधिकार सुनिश्चित गर्ने क्रममा देशमा विद्यमान वर्गीय, जातीय, क्षेत्रीय, भाषिक, धार्मिक, लैङ्गिक विभेद अन्त्य गरी आर्थिक समानता, समृद्धि र सामाजिक न्याय सुनिश्चित गर्न समानुुपातिक समावेशी र सहभागितामूलक सिद्धान्तका आधारमा समतामूलक समाजको निर्माण गर्ने संकल्पका साथ नेपालको संविधान (२०७२ साल असोज ३ गते) जारी भएको छ । राष्ट्रहित, लोकतन्त्र र राजनीतिक, आर्थिक र सामाजिक रुपान्तरणका लागि नेपाली महिलाहरुले पटक–पटक प्रत्यक्ष र अप्रत्यक्ष रुपमा गर्दै आएका ऐतिहासिक आन्दोलन, संघर्ष र योगदानलाई कदर गर्दै महिलाहरुको विशेष आवश्यकतालाई गम्भीर्यताका साथ आत्मसाथ गरी विशेष अधिकारको व्यवस्था सहित अस्तित्वमा आएको यो संविधानले परिवर्तनका मुद्दाहरु संस्थागत गराउन महत्वपूर्ण भूमिका निर्वाह गर्नेछ । संविधान राम्रो बनाउनु मात्र सबैथोक होइन, यसको कार्यान्वयनमा नै संविधानको सफलता निर्भर रहन्छ । तसर्थ संविधानलाई व्यवहारमा उतार्नु अपरिहार्य हुन्छ । जसले गर्दा महिलाको अधिकार सुनिश्चित हुन सकोस् र उनीहरुले आफ्नो अधिकार उपभोग गर्न पाउने वातावरण तयार होस् । यसका निम्ति नेपालको संविधान २०७२ ले महिलालाई प्रदान गरेको अधिकारका बारेमा सबै महिलाहरुले जान्नु तथा बुझ्नु जरुरी छ भन्ने मान्यतालाई मनन गरी यो जानकारी पत्र तयार गरिएको छ ।

महिला पुनर्स्थापना केन्द्र (ओरेक) महिला अधिकारप्रति समर्पित एवम् लैङ्गिक समानता र सामाजिक न्यायका निम्ति संघर्षरत गैरनाफामुलक राष्ट्रिय गैरसरकारी संस्था हो । २०४७ चैत्र १९ मा स्थापित ओरेक महिला माथि हुने हिंसा, यसका कारण र परिणामको रोकथाम र महिला तथा सीमान्तकृत समुदायको आर्थिक, सामाजिक तथा सांस्कृतिक अधिकार सुनिश्चितता तथा सामाजिक न्यायमाथिको पहुँचको प्रवद्र्धन गर्न नेतृत्वदायी भूमिका निर्वाह गरिरहेको अभियानमुलक संस्था हो । मानव बेचबिखन विरुद्ध महिलावादी र अधिकारमुखि सोचमा आधारित भई महिला तथा बालबालिकाको बेचबिखनको अन्त्य गर्ने र प्रभावितको अधिकार तथा न्याय सुनिश्चताका लागि वकालत गर्ने उद्देश्यका साथ स्थापित यो संस्थाले महिलाअधिकार हनन मध्ये बेचबिखन एउटा परिणाम भएको निष्कर्ष निकाल्दै महिला अधिकारको मुद्दालाई फराकिलो नजरले हेर्न सुरु ग¥यो । महिलाको आफ्नो शरीर आफ्नै हो भन्ने यथार्थतालाई आत्मसात गरी महिला अधिकार प्राप्तीका निमित्त महिलाको उत्पादनशीलता, यौनिकता र गतिशीलतामाथिको नियन्त्रणको महत्वबारे समुदायका महिलालाई सशक्तिकरण गर्न सहजीकरण गरिरहेको छ । ओरेकले नेपालको महिलावादी आन्दोलनलाई सकारात्मक ढंगले अगाडी बढाउँदै महिला र बालिकाको अधिकार सुनिश्चितताको लागि राज्यलाई उत्तरादायी बनाउन र महिलामैत्री ऐन, नीति तथा कार्ययोजना निर्माणका लागि सबै तहको सरकारसँग समन्वय, सहकार्य र पैरवीमुलक गतिविधी गर्दै आइरहेको छ । समुदायमा आधारित महिला स्वास्थ्य तथा परामर्श केन्द्र, मनोविमर्श केन्द्र, सघन जैविक खेतीको अवधारणामा आधारित नमुना खेती, पर्यावरणमैत्री नमूना गाउँ, पछाडी पारिएको समुदाय तथा महिलाको समान प्रतिनिधित्व तथा राजनीतिक सहभागिताका लागि महिला तथा समुदायसँगको सहभागिता र साझेदारितामा कार्यक्रमहरु सञ्चालन गरेका उल्लेखनीय कार्यक्रमहरु रहेका छन् । संस्थाले महिला अधिकारको क्षेत्रमा २८ वर्षको लामो यात्रा पार गर्दा सुरक्षित मातृत्व तथा प्रजनन् स्वास्थ्य अधिकार ऐन २०७५, बेचबिखन विरुद्धको नीति, पाठेघर खस्ने समस्यालाई सम्बोधन गर्ने राष्ट्रिय नीति, सुरक्षित गर्भपतन सम्बन्धी कानुन, घरेलु हिंसा सम्बन्धी कानुन, एकिकृत किट व्यवस्थापन, जैविक खेती, सम्पत्तीमाथिको अधिकार तथा महिला अधिकार सम्बन्धीत अन्य थुप्रै प्रगतीशील नीतिहरु परिवर्तनमा उत्प्रेरकको भूमिका खेल्ने प्रभावितहरुले नेतृत्व गरेका संस्था तथा सञ्जालहरु स्थापना गर्न सहजीकरण तथा विभिन्न अभियानमुलक कार्यक्रमहरु सञ्चालन गरेको छ ।

बालश्रम आधुनिक समाजको लागि लज्जाको विषय हो । आज पनि नेपालमा लाखौं बालबालिकाहरू श्रमरुपी नरकमा बाँच्न बाध्य छन । एक्काइसौं शताब्दीको वैज्ञानिक युग र नयाँ नेपालको परिकल्पनाका साथ समाज अगाडि बढिरहेको अवस्थामा बालबालिका श्रमिकको रुपमा प्रयोग भइरहनु आधारभूत मानवअधिकारको हनन हो । बालश्रमको प्रयोग गर्नु र हुन दिनु राष्ट्रिय र अन्तर्राष्ट्रियस्तरमा हामीले प्रतिबद्धता गरेका मानवअधिकार सम्बन्धी सन्धि र सम्झौताविरुद्धको कार्य हो । कतिपय अभिभावकले आफना बालबालिकाले मिठो खान पाउँछन, राम्रो लाउँन पाउँछन भन्ने आशामा शहरमा काम गर्न पठाएको पाइन्छ । शहरमा कतिपय अभिभावकहरूले बालबालिकाहरूको कल्याण गरेको नाममा घरेलु श्रम, होटल तथा साना चिया पसलमा बालबालिकाको प्रयोग गरिरहेको पाइएको छ । यसरी बालबालिकाहरूलाई श्रममा संलग्न गराउनेमा उद्यमी, व्यवसायी, सरकारी तथा निजी र गैससमा काम गर्ने व्यक्तिहरू समेत छन । घरेलु बाल श्रमलाई नेपाल सरकारले पनि निकृष्ट प्रकारको श्रमको रुपमा वर्गीकृत गरेको छ । तसर्थ बालबालिकाहरूलाई श्रममा संलग्न नगराऔं । बालबालिकालाई यसरी श्रममा संलग्न गराउनु कानुनी रुपमा अपराध हो ।

बालबालिकाको उपयुक्त हेरचाह तथा बालमैत्री घर परिवार निर्माणका लागि अभिभावक शिक्षा स्रोत पुस्तक अभिभावकत्व जीवनको सबैभन्दा चुनौतीपूर्ण यात्रा हो, असल सन्तानका लागि चाहना गर्ने र त्यस अनुसार योजना बनाउने अभिभावकको लागि यो चुनौती अनिवार्य पनि छ । त्यसैले अभिभावक बन्ने व्यवस्थापकीय ज्ञान र सिप बहुआयामिक हुनु स्वभाविकै हो । ती सबै सवालहरू विस्तृत रूपमा यस यस स्रोत पुस्तकभित्र समेट्न सम्भव नभएता पनि प्रमुख सवालहरूसँग सम्बन्धित विषयहरूले अभिभावक तथा अभिभावकसँग प्रत्यक्ष काम गर्ने सरोकारवालाहरूका लागि पनि केही हदसम्म सान्दर्भिक हुने छ भन्ने अपेक्षा गरिएको छ । वैवाहिक जीवनको सुरुवातको सोच आउँदा नै अभिभावकत्वको सुरुवात हुन्छ । जब व्यवहार मै अभिभावक बनिन्छ, त्यसको निरन्तरता जीवन पर्यन्त रहन्छ । जस्तैः विवाह कुन उमेरमा गर्ने ? बच्चा कहिले जन्माउने ? बच्चा जन्माउन नचाहेको अवधिका लागि कुन गर्भनिरोधका साधन अपनाउने ? कसरी बढाउने र पढाउने, आत्मा निर्भर बन्न र विवाह गर्न योग्य कसरी बनाउने आदि देखि असल अभिभावकको लागि परिवारमा अप्रत्यक्ष रूपले अनन्तसम्म अभिभावकत्व रहिरहन्छ । पुस्तकको प्रयोजन जिम्मेवार अभिभावकका लागि उनीहरूका बालबालिकाका समग्र व्यक्त्त्वि विकास गर्न कस्ता कस्ता ज्ञान, सिप र धारणाको विकास गर्न आवश्यक पर्दछ भन्ने कुरालाई मध्यनजर राखेर यो स्रोत पुस्तिकामा सकेसम्म विविध सान्दर्भिक मुद्दाहरू समावेश गर्ने कोसिस गरिएको छ । गर्भधारण गर्ने निर्णयदेखि प्रसूति सेवा तथा बालविकासका लागि अभिभावकले पूरा गर्नु पर्ने दायित्वका सम्पूर्ण पक्षमा अभिभावकलाई दक्ष बनाउन यो स्रोत पुस्तकले प्रयास गरेको छ । यसमा भएका सामग्रीहरूको अध्ययनलाई सहज होस् भन्नका लागि त्यसका सैद्धान्तिक तथा प्राव

। “महिला अधिकारको क्षेत्रमा काम गर्ने महिलाहरूले समाजमा रहेको आफ्नो स्थानका कारण घरभित्र र बाहिर विभिन्न खाले जोखिमहरूको सामना गरिरहेको यथार्थतालाई आत्मसात गर्दै महिला मानवअधिकार रक्षकहरूका लागि विशेष प्रावधानहरू आवश्यक छन्” भनि संयुक्त राष्ट्रसंघका महासचिव मानवअधिकार रक्षक सम्बन्धी बिशेष प्रतिनिधि बिना जिलानीले आफ्नो पहिलो प्रतिबेदनमा उल्लेख गरेकी थिईन् । महिला मानव अधिकार रक्षकको परिभाषा र आवश्यक पर्ने मापदण्ड सम्बन्धी मानवअधिकार र महिलाको मानव अधिकारको क्षेत्रमा काम गर्ने संघ संस्था र व्यक्तिहरूको बीचमा हुने छलफलमा ओरेक नेपालको सहभागिता थियो । देश भित्र त्यतिखेर माओवादी र नेपाल सरकार बीच सशस्त्रद्वन्द चलेको थियो । यसबाट सबै भन्दा बढी मानव अधिकारप्रभावित भएका थिए । त्यतिखेर त्यस्ता मानव अधिकारजो महिला अधिकार खास गरी महिलाहिंसा बिरुद्ध सामुदायिक तह देखि नै सक्रिय थिए उनीहरू दोहोरो चपेटामा परेका थिए । धेरै महिलाहरूले आफूहरूलाई समुदायमा परिरहेको (मानव अधिकारको क्षेत्रमा काम गर्दाको बखतमा) समस्या ओरेक नेपालमा छलफल गर्ने गरेका थिए । ओरेकका केही समुदाय स्तरमा सक्रिय रूपमा काम गर्ने अधिकारकर्मीहरू पनि यो समस्याबाट पीडित थिए । नेपालमा समुदाय तहमा कार्यरत यी महिलाहरूले सुनाएका समस्याहरू र अन्तर्राष्ट्रिय तहमा बिशेषतः संयुक्त राष्ट्रसंघ मानवअधिकार परिषदमा महिला मानवअधिकार रक्षकहरूका सम्बन्धमा चलेको छलफलमा देखिएका समस्याहरू उस्तै थिए । त्यो स्थितिले समुदाय तहमा महिला अधिकारका लागि कार्यरत महिलाहरूले सबै ठाउँमा उस्तै समस्या भोगिरहेको यथार्थ हाम्रे सामु आएको थियो । यस्ता मानव मानवअधिकार रक्षक हुन् । त्यसैले यिनको पहिचान महिला मानव अधिकार रक्षकको रूपमा स्थापित हुनुपर्दछ भन्ने मान्यता महिला अधिकारकर्मीहरू भित्र रह्यो । माथि उल्लेख गरेझँैँ ओरेक नेपाल पनि त्यस्ता छलफलको एक महत्वपुर्ण घटक भएको कारण देशभित्र भएका यस्ता महिला अधिकारकर्मीहरूलाई संगठित गरी उनीहरूलाई महिला मानव अधिकार रक्षकको रूपमा चिनिन मान्यता पाउनु पर्छ र उनीहरूले पनि अरू मानवअधिकार रक्षकले पाउने गरेको मान, सम्मान र सुरक्षा पाउनु पर्छ भनी महिलाहरूलाई संगठित गर्ने प्रक्रिया थालियो । ओरेक नेपालले अन्य विभिन्न संघ संस्थाहरूको सहयोग लिँंदै सन् २००४ मा विराटनगर, दाङ्ग र बाग्लुङ्गमा “हिंसात्मक राजनीतिक द्वन्द्व, शान्ति र विकासका लागि चुनौति तथा द्वन्द्व, विस्थापन र स्थानागमन, शान्ति र विकासका लागि चुनौतिहरू” नामक सम्मेलन आयोजना गरेको थियो । उक्त सम्मेलनमा महिलाको मानवअधिकारको विषय अधिकांश सहभागीले उठाए पछि महिला मानव अधिकार रक्षकलाई छुट्टै संगठन निर्माण गर्न ओरेकले पहल सुरु गरेको थियो । सोही पहल स्वरूप २००६ को मार्चमा पहिलो पटक महिला मानवअधिकार रक्षकहरूको पहिलो परामर्श गोष्ठी काठमाडौंमा सम्पन्न भयो । जसले समुदाय स्तरदेखि राष्ट्रिय स्तरसम्म मानवअधिकार र महिला अधिकारका क्षेत्रमा क्रियाशील संघ संस्थाहरूको समन्वयमा महिला मानव अधिकार रक्षकहरूको पहिचान, सुरक्षा र अधिकारका निम्ति आपसमा संगठित र क्रियाशील हुने उद्देश्य राखेर निरन्तर काम गर्दै आएको छ ्र अहिले मानवअधिकार रक्षकहरूको राष्ट्रिय सञ्जालमा ८ हजार भन्दा बढी महिला मानवअधिकार रक्षकहरू आबद्ध रहेका छन् ।

यौनिकता मानवजीवनको एउटा महत्वपूर्ण पाटो हो । आफूले आफ्नो यौनिकतालाई बुझ्न सक्दा, आफ्ना इच्छाहरूलाई पूरा गर्न सक्दा हामी खुसी हुनसक्दछौँ । हामी सन्तुष्ट हुन्छौँ । यसको प्रभाव हाम्रो उत्पादनमापर्दछ । व्यक्तित्वमा झल्कन्छ । तर पनि हामी यसबारे कुरा गर्दैनौंँ । त्यसमा पनि हामी महिलाहरूका लागि त यस विषयमा बोल्नु, आफ्ना चाहना व्यक्त गर्नु र आफू सन्तुष्ट हुन चाहनु भनेको उनीहरूले गर्ने अपराध जस्तो मानिन्छ । आजसम्म हामी महिलालाई हामीले आफ्नो यौनिकतालाई कसरी नियन्त्रित गर्न सकिन्छ ? महिला भएर के–के गर्न हुन्न भन्ने मात्रै सिकाइएको छ । झन् त्यसमाथि समाजले तयार गरेको “असल महिला” को ढाँचाभित्र स्थापित भइरहन हामीले के–के गर्न हुँदैन भन्ने सूची निकै लामो छ । त्यो सूचीमा हामीले गर्न नहुने भन्ने कामहरूमध्ये खुसी हुने, आनन्दित हुने, आफ्नो शरीरलाई बुझ्ने आफ्नो यौनिकतालाई बुझ्ने र सोही अनुरूपको व्यवहार गर्ने कुराहरू सबभन्दा माथि छन् । यसले हामीलाई खुसीबाट टाढा राखेको छ । हाम्रो शरीरबाट टाढा राखेको छ । हामी आफूलाई आफैले माया गर्नबाट वञ्चित गरेको छ । फलस्वरूप हामी हेपिएका छौँ । हामीमाथि हिंसा हुने गरेको छ । हाम्रो शरीर, यौनलाई हामीलाई नै दबाउने औजारको रूपमा प्रयोग गरिएको छ । हामीलाई बलात्कृत भए पनि त्यही घरमा बस्न बाध्य गराइएको छ । चुपलाग्न दबाब दिएको छ । एच.आइ.भि. संक्रमित बनाएको छ । मानसिक रूपले पीडा दिएको छ । यस्ता धेरै अन्यायहरू हामीमाथि गरिएका छन्, हामीले के–के गर्न हुँदैन भन्ने लामो सूची तयार गरेर । त्यसलाई नमान्नेलाई जे गरे पनि हुन्छ भन्ने सोच स्थापित गराएर । यो पुस्तकमा हामीले यस्ता हामीलाई नियन्त्रण गर्ने सोचलाई परिवर्तन गर्दै हामीले आफूले आफैलाई माया गर्न के–के गर्नुपर्दछ ? हामी के–के गर्दा खुसी हुन सक्छौँ ? भन्ने हामी महिलाहरूको अनुभवमा आधारित सूचनाहरू राखेका छौँ । यौनिकताको सन्दर्भमा अहिलेसम्म व्याप्त मौनतालाई तोड्ने प्रयास गरेका छौँ । यसले कतिलाई अप्ठ्यारो पनि लाग्न सक्छ । तर यी अप्ठ्यारालाई पन्छाई अब बोल्ने बेला आइसकेछ बरू भनौँ ढिलै भइसकेछ भन्ने अनुभूति भने पक्कै हुनेछ । यस पुस्तकमा धेरै महिलाहरूका आफ्ना अनुभवहरू राखिएका छन् । कतिपय सूचना, व्यक्त गरिएका अनुभवहरू “Our Bodies Our selves” बाट उल्था गरेर पनि राखिएका छन् । धेरै अनुभवहरूलाई हामीले घटना अध्ययनको रूपमा राखेका छौँ । गोपनीयताको ख्याल गर्दै कसैको पनि नाम उल्लेख गरिएको छैन । सबैलाई मेरो अनुभवमा वा मलाई यस्तो भयो भनेर लेखिएको छ । तर यो यस पुस्तक संयोजन गर्ने व्यक्तिहरूको मात्रै नभइ सयौँ महिलाहरूको अनुभव हो भन्ने बुझ्नु जरूरी छ । अन्त्यमा, यौनिकताका सम्बन्धमा विगत १६ वर्षदेखि समुदायस्तरमा गरिएको तालिमको अनुभव र अन्तर्राष्ट्रियस्तरमा महिलावादीहरूको अनुभवमा आधारित नेपाली परिवेशका लागि तयार गरिएको यो पहिलोचोटी सामाग्री हो ।

महिलामाथि हुने हिंसा मानवअधिकारको हनन् हो; सामाजिक अपराध हो; महिलाको मानवअधिकारको हनन् हो; जनस्वास्थ्यको समस्या हो; आदि इत्यादि भनाइहरू धेरै लामो समयदेखि हाम्रो घर, परिवार, समाज, धर्म, संचार र राज्यदेखि अन्तररराष्ट्रिय तहसम्म दोहो¥याइने गरेको धेरै भइसक्यो । तर पनि हामीमाथि हिंसा भइरहेको छ । हामीलाई बलात्कार गरिन्छ, जिउँदै जलाइन्छ, आत्महत्या गर्न बाध्य पारिन्छ, मानसिक सन्तुलन गुमाउन बाध्य बनाइन्छ, हत्या गरिन्छ । यो पनि त्यत्तिकै सत्य हो । यस्तो किन हुन्छ त ? यसको मूल कारण कहाँ छ त ? यो स्थितिको समाधान कसरी गर्न सकिन्छ ? यी प्रश्नहरूको जवाफको खोजी पनि नभएका होइनन्, तर पनि किन यस्तो हुन्छ ? यसको गहिराईमा पुग्नु र त्यसको अन्त्य गर्नका लागि हामी संगठित हुनुपर्दछ भन्ने निक्र्योल हामीले निकालेका छौँ । यसका साथै हामीमाथि हुने हिंसाले हामी मात्रै नभई हामीलाई हिंसा गर्ने घर, परिवार, समाज र राष्ट्रलाई असर पारेको छ भन्ने पनि हामीले बुझेका छौँ । यसले हाम्रो सन्तानलाई असर पारेको छ । देशको भविष्यलाई असर पारेको छ भन्ने पनि हामीले बुझेका छौँ । हाम्रा यही अनुभवहरूलाई समेटी हामीमाथि हुने हिंसालाई हामीले नै कसरी नियन्त्रण गर्न सक्दछौँ ? यसको हाम्रो स्वास्थ्यलाई पारेको प्रभावलाई विश्लेषण गरी कसरी स्वास्थ्य राम्रो बनाउन सक्दछौँ भन्ने हाम्रा आफ्ना अनुभवहरूलाई हामीले यस भागमा राखेका छौँ । बुझ्न र बुझाउन सजिलो होस् भन्नका खातिर हाम्रा धेरै भोगाई, अनुभव, पीडा र संघर्षलाई घटना अध्ययनका रूपमा राखिएका छन् । नाम, ठेगाना परिवर्तित गरिएको भए तापनि यी हाम्रा यथार्थ हुन् भन्ने सबैमा स्पष्ट हुन जरुरी छ । हाम्रा धेरै साथीहरूका जिवनकथाहरू हाम्रो यो पुस्तकको आधार हो । तिनीहरूलाई संकलन, विश्लेषण र लेखन गर्ने बेला धेरै पटक हाम्रा आँखाहरू भरिए, मन रोयो । कतिले त खप्नै नसकि बाहिर पोख्यौँ । तर यसकासाथै त्यसरी मन भरिएर पोखिएको बेला पाएको अर्को साथीको साथ, हात र विश्वासले हामीलाई अझ अगाडि बढायो । यो पुस्तक तिनै विश्वासलाई अmभ कसरी दह्रो बनाउने, ती हातमा अरू हातहरू धेरै साथीहरूको साथ लिँदै थप्दै जाने र हाम्रा जिवन कथाहरूमा परिवर्तन गर्ने भन्ने प्रयास हो । यसप्रकार गरिएको प्रयासकै कारण यो पुस्तक यो रूपमा आउन सकेको हो । यसमा धेरै प्रकारका समाधानका उपायहरू पनि दिइएका छन् । तर पनि हामीले के बुझेका छौँ भने हामी महिलाहरूबीच विविधता छ । त्यसैले एउटै प्रयास सबैका लागि उपयुक्त हुन्छ भन्ने छैन । त्यसैगरी हामीले के पनि बुझेका छौँ भने हामीमाथि हुने हिंसा र त्यसबाट हाम्रो स्वास्थ्यमा पर्ने असर दुवै राज्यको हामी प्रति रहेको त्रुटीपूर्ण नीतिहरूले गर्दा भएका हुन् । त्यसैले यसको समाधानका लागि राज्यलेनै महत्वपूर्ण जिम्मेवारी निर्वाह गर्नुपर्दछ । यो राज्यको नै दायित्व हो । हाम्रा यही बुझाइलाई मूर्तरूप दिन हामी राज्यलाई कसरी जिम्मेवार बनाई आफ्नो भूमिका निर्वाह गर्न सघाउन सक्दछौँ भन्नेबारे चिन्तित भई गर्न सकिने कामहरू पनि प्रस्तुत गरेका छौँ । हालसम्म गरिरहेका हाम्रा प्रयासहरू पनि अगाडि ल्याउने कोशीस गरेका छोँ । तर यस्तो भन्दैमा हामीले राज्यलाई विस्थाचपित गर्न खोजेको भने पक्कै होइन । यो कुरा बुझ्दै राज्यका संरचनाहरूलाई अझबढी चलायमान गराउन सकिन्छ, त्यसप्रति पनि हामी संवेदनशील हुनु जरुरी छ ।

In 1991, WOREC was established by a group of women’s right activists to respond to the needs of a woman who had experienced extreme abuse and violence as a trafficked person. In the early 1990s, Dr. Renu Adhikari Rajbhandari, founding Chairperson of WOREC was working as a medical doctor with the Government of Nepal. In the course of her work, she met a girl in the Nuwakot police station, who returned from Mumbai after being trafficked there for six years. As a medical officer working with National AIDS and STD control program, Dr. Renu visited Nuwakot for blood sample of the girl to find her HIV status. But interaction with the girl revealed the reality of her life; her heartbreaking story throwing a challenge to all institutions of society and state which are supposed to protect vulnerable persons like the girl. Dr Renu was speechless after she had conversation with and ultimately became the inspiration to start WOREC. The girl’s body was full of blue marks, and her vagina was wounded as brothel owner used to hit her with a bunch of keys. Analysis of this case from a feminist perspective reveals the layers of marginalization of that girl of being poor, a Dalit, a child of a disabled woman from a village, and most importantly a child born outside the institution of marriage, as the root causes of trafficking. The absence of support mechanisms was making such young women even more vulnerable. The police was also stigmatizing her for being a returnee from Mumbai, with all the stigma attached to victims of trafficking. This holistic analysis was later reflected in WOREC’s program to support such women and advocate for rights of all women. Read the first annual report of WOREC published in 1992 AD.

पैरवीको यस अंकमा ओरेकले गत छ महिनामा सञ्चालन गरेका अभियानमुलक तथा पैरवीमुलक कार्यक्रमहरु समवेश गरिएको छ । तथ्यगत पैरवीका लागि अन्वेषी प्रकाशन, राष्ट्रिय, प्रदेश तथा स्थानियस्तरमा संक्रमणकालिन न्याय तथा द्वन्द्वप्रभावितका सवालहरुमा ध्यानाकर्षण, लैङ्गिक समानता, लैङ्गिक नीति निर्माणका लागि पैरवी, न्यायमा महिलाको पहुँचजस्ता सवालहरुमा संस्थाले आफ्ना गतिविधी केन्द्रित गरेको थियो । यसैगरी लैङ्गिक हिंसा विरुद्धको १६ दिने अभियान तथा महिलाको स्वास्थ्य अधिकार तथा स्वास्थ्य सेवामा पहुँच, महिलाको काम तथा गतिशीलताको अधिकार र दिगो विकासका लागि ईको भिलेज नमुना कार्यक्रमका लागि समेत पैरवीका कार्यक्रम यो समयमा सम्पन्न भएका छन् ।

The feminist group of Nepal particularly women led organizations, human rights activists and the members of South Asian Feminist Alliance on Economic, Social and Cultural Rights (SAFA for ESCR) with the leadership of Women’s Rehabilitation Center (WOREC) and technical support from Programme on Women’s Economic, Social and Cultural Rights (PWESCR) worked collaboratively to determine the real picture of women on ESCR in Nepal. A two-day workshop was organized on 31 July and 1 August 2014 to understand the procedure of Economic, Social, Cultural Rights (ESCR) treaty body monitoring and the process to develop an Alternate Report with a clear guideline and timeline for monitoring. In this process, WOREC coordinated with 63 organizations and individuals to discuss and bring out the ground reality of the condition of women in Nepal. The workshop, at the end, led to a formation of a group having 33 organizations and individuals to jointly develop a collaborative civil society report. This Mid-term Report on ESCR is a study on the status of implementation of the recommendations made by CESCR to the government. The study finds that the government is snail paced to implement the concluding observations and lag behind to implement its core obligation to fulfill the basic needs and rights of the people. The government has initiated to work in few of the recommendations however it has not yet started working on many recommendations. The GoN needs to treat ESCR issues giving utmost importance and expedite the process to fulfill CESCR’s concluding observations.

Women's Rehabilitation Centre (WOREC) is a nonprofit making, a non-governmental organization working for the protection and promotion of human rights. Established in 1991, WOREC is one of the leading national organizations that work to prevent violence against women, its causes and consequences, and to ensure economic, social and cultural well-being of women as well as other marginalized groups by promoting their access to rights and social justice. WOREC started her work with an objective to prevent trafficking in women and children and advocate for the rights of survivors, whereas in the course of work, with the realization that trafficking is one among various other outcomes of women rights violations, WOREC started to work from broader perspective for women’s right. Being an organization guided by feminist values, WOREC believes that empowering women to control her body, sexuality and reproduction is a key to enable women to exercise her rights. Community-based women health and counseling centers, model farms based on bio-intensive farming concepts, engagement with women and other community groups for political participation and equal representations are some of the exemplary works of WOREC. This year WOREC documented and analyzed 1,751 cases of violence against women in its publication Anbeshi 2018. Among 1,751 recorded cases domestic violence accounts for 65% of VAW, followed by social violence (17%) and rape (7%). Domestic Violence Domestic violence is the highest reported category of violence against women as it makes upto 65% (1140). The data shows women suffered violence from their husband (76% of perpetrators) and family members (24% of perpetrators). Social Violence Among the reported cases 17% (295) women suffered from social violence. 54% (160) of social violence was perpetrated by neighbours while 18% (54) was by family members. Rape A total of 130 cases of rape was reported in WOREC which is 7% of all cases recorded along with 2% (37) of an attempt to rape. Of the total cases, 46% (59) were perpetrated by neighbours, 16% (21) by family members and 12% (16) by intimate partners. It is important to note that 63% (82) of rape survivors were children below 16 years and neighbours perpetrated 46% (59) of cases followed by 16% (21) perpetrated by family members. Sexual abuse Sexual abuse accounts for 4% (72) of reported cases where intimate partners were responsible for 33% (24) of cases. Murder 13 cases of murder and 6 cases of attempt to murder were documented this year where 62% (8) of reported murder was committed by the husband. Trafficking This year WOREC documented 11 cases of trafficking with 19 cases of attempt to trafficking. Suicide A total of 10 cases of suicide was documented by WOREC where women were compelled to commit suicide because of blaming in character, forced marriage and torture. Age group and violence against women According to the data, women of age group 17-25 years were affected mostly by violence against women. 37% (643) survivors are in 17-25 years age group, 32% (564) survivors are in 26-35 and 13% (222) are below 16 years. Situation of women human rights defenders in Nepal

Nepal has been making legal and institutional improvements for the promotion of women’s rights, by establishing protection mechanisms such as National Human Rights Commission and National Women’s Commission. However, the status of Nepali women still remains vulnerable due to weak enforcement of laws, policies and plan of action, and poor performance of state mechanisms. It is partly happening due to lack of infrastructure, resources and responsible governance, but mostly because of state’s unwillingness to invest enough resources for the protection of women and their rights. The Gender Inequality Index of the 2015 UNDP indicates that the inequality between men and women achievements are known as reproductive health, empowerment and economic activity in which Nepal ranks in 115th position in global scenario in terms of Gender Inequality Index, 2015. Similarly, the Gender Development Indicator (GDI) shows that Nepal falls under the category of low human development ranking 145th position in the world with lowest GDI among South Asian countries. This alternate report (CEDAW Shadow report) is prepared in collaboration with more than 100 of NGOs/CBOs from all seven provinces of Nepal, in line with the government’s recent periodic report focusing on VAW, FMWs, WHRDs, online GBV and women’s health. This is a supplemental report to the consolidated alternative report of the CEDAW led by Forum for Women, Law and Development as part of collective efforts of Human Rights Treaty Monitoring Committee (HRTMCC).
