2. CONTRACTUAL BRIEF
Definition: A contractual brief is a illegally binding document, so this means you have to produce a
product to a certain time frame to a certain budget. You both have to sign to agree to this
contractual brief. If you one of you doesnât follow through you can take that other person to
court. An example of this would be if you and a client both signed a brief for the producer to
produce a magazine for the 1st of May and the producer didn't finish it in time, that client
could sue.
Advantages Both clients knows what they are doing. All the specifics are wrote down on the
document for you, this means you will run into less issues. There is also protection for both
client and producer. The contract also protects the producer from doing any extra work or
being exploited by the client as you have proof on the document for how much work you need
to do. Funding is another upside as you know how much you are getting paid so you know
how to budget your project.
Disadvantages
Your locked in once you have signed. You can also get sued for producing the wrong product. Also
you donât do the duty's you have signed to you can get sued. Over all you have to read the
brief properly and you have to follow by the brief.
3. FORMAL BRIEF
Definition
A formal brief is where a client provides a company with a brief that explains the product they want to be
assembled. The brief will contain the correct information you need to complete the project. Any additional
information will need to be negotiated with the client also the brief is not always legally binding. For
example if a writer wanted some posters making on their book and created a brief of the things the
required, they have formalised the brief and stated what they wanted but its up to the creator to chose the
colours, fonts and the graphics and therefore have to discuss to their client the different options making it
more of a flexible brief.
Advantages
A formal brief Gives you more flexibility. It also keeps things fairly simple in the sense that it means that you
donât have to read a massive contact and you can have more of an input. You can also have more of a
discussion, for example you can chat with them on the phone and then formalise it with an email. Another
example is that its not always legally binding so if you change your mind you donât have to go through with
it. You can also use the emails as proof for protecting yourself.
Disadvantages
A disadvantage for a informal brief would be that its not a reliable form of work. If you need a product for a
scheduled event there isn't a guarantee the work is going to be finished by then making it a risky. It could
be hard to get paid also, this is because the worker didn'tâ sign for anything
4. INFORMAL BRIEF
Definition
Informal is a very relaxed approached to a brief. It could just be verbal. So there is no contract and
protection. For example, there is a guy who is a manager who works for a company who wants
you to do a video for his company. He rings you up and asks you down the phone and thatâs it.
Its not written down or set in stone.
Advantages
Informal adds full flexibility there is no formality to it. The client is open to any ideas as it is
informal, no set time frame either, so as long as it is done at some point, then thatâs ok.
Disadvantages
Its not reliable. If you are a business and you want some flyers done in time for an event you could
be in trouble if its not done in time. Another thing is that you might miss a businesses core
message across their brand ethos. You need a formal or a contracted brief to understand
what's going on fully in the correct detail. There also isn't any financial protection in an
informal brief. You could also represent the brand incorrectly.
5. CO-OPERATIVE BRIEF
Definition
Where you are working with someone else on a specific brief for example two or more
production company's are working on a brief. For example two people are making a
movie and there is a audio engineer and a camera man. Its usually big companies that
need lots of staff to create something as one person cant do everything.
Advantages
The work can be undertaken much faster as two or more people are working on the
product. You can also bounce ideas off each other. Another advantage is you have two
people and if one of you becomes ill another can pick up the work.
Disadvantages
You could disagree and have creative differences. Also itâs the logistics of it like Who's going
to do what. Also the money couldn'tâ be split unfairly and You also earn less then you
doing it all yourself.
6. NEGOTIATED BRIEF
Definition
A negotiation is a discussion between yourself and another. It Is when two or more companies are
working together on a brief. You are trying to objectify what you are working on. If there are
my disagreements on the contract, they can negotiate. Negotiation is an important part of any
brief. This could involve discussing the deadline, product, and legal and ethical obligation.
Advantages
it makes sure that people are happy for example, resources, budget, time constraints. Making sure
the fine details are known and agreed upon from both parties. Successful negotiation ensures
that all parties will work together effectively, this is called synergy.
Disadvantages
Arguments by occur for example on party may not agree with one of the terms. You may not get
that correct information and one party could be doing something wrong. This causes more
conflict and more issues.
7. COMMISSION BRIEF
Definition
A commission brief is a large media company will hire a smaller media company to create a product
for them. For example the BBC may hire a separate film company to make production for them,
then the BBC will use this production. This is basically outsourcing your work to another
company. For example Dock10 studios are commissioned by the BBC to create the match on the
day. The BBC produce the show and DOC10 film it.
Advantages
One key advantage is that when you receive a brief you are in the same field expertise. Also another
company manages the production of the product. Another benefit is you can keep getting
payments and royaltyâs from their product and work as they keep getting used then you will
keep continuing to make profit form when its used. An example of this would be stock photos as
people can keep using your image for years and this allows you to keep making money for a long
time off one photo.
Disadvantages
Your payments would get split between to company's so you would get less money. Also you may
have communication issues between company's and this can cause issues.
8. TENDER BRIEF
Definition-
A tender brief is an open brief where the client will put out a brief, and a producer will offer their services to fit th
brief. There will be more then one producer offering to their brief. The company will then pick the one they
want, Some may chose the cheapest option and some may chose the one with the best quality it depends on
the company.
Advantages
One advantage of a tender brief is it gives the client lots of flexibility between who they can chose from and they
will bring a range of ideas with them on what they want to implement. The client will chose the best proposal
and they will get full control of the ideas that have been suggested to them. Another benefit is the client has lo
of ideas to choose from. The cheaper can pick the cheaper ones if that works out for them and the big
company's can get the best quality they are after.
Disadvantages
It could be a waste of time if you donât win the pitch this will make you unhappy also you could have been getting
other work wiliest wasting time with the company that didnât pick you. You also will have to work to a low cost
and a low budget.
9. COMPETITION BRIEF
Definition
A competition brief is available to all participating production companies. It allows each
company to complete the brief were they are then judged and the best is awarded the
product that has been shown. It doesnât cost to enter but the client has to pay the
winning company. For example E4 set up a competition named stins where companies
could make a 15 second moving graphic for the logo. The winner would have it shown
on TV and they win ÂŁ3000.
Advantages
An advantage of this would be if you create a good piece of work and it wins you could
receive lots of further good opportunities as it would be very hard to win against lots
of people. Your work would also get seen by lots of other big company's that will want
you to work for them. You could also win lots of money.
Disadvantages
The obvious disadvantage would be that you may not win and time could be wasted. You
will be up against lots of other contenders that may be better so its your decision if you
want to enter. If you think you have what it takes then you have nothing to lose.
10. MY BRIEF
Which structure/structures will your client brief use?
My client has given me an formal brief. This is because they have emailed me a
brief stating that she wants posters for her book and my client has also sent
me some dimensions that need to be required. There isn't a deadline so this
gives me lots of time to produce my work.
Reference your reasons for choice/choices
As itâs an formal brief I can email my client about my work and log the
conversation. This is better because if I run into any issues I can speak to my
client about it an resolve them through email.
11. READING THE BRIEF
Reading a brief properly will ensure you full understand what needs to be done. For example what needs to be done, time
you do it in, the limitations, ethos, personnel and contact. Knowing all this can help you complete the task to the best
possible outcome. If you donât read it properly you could mess up and when it comes closer to the deadline and you
send your work to the client just to see if everything is done properly the client could come back to you and say you
have done it all wrong. This means you have less time in resolving the problems resulting in rushed work that wont be
up to the standard. If you read the brief properly I you did what the client asked you wouldnât have these issues.
With my brief I will need to take on board that my client wants me to design one poster for twitter and one for Instagram.
My client has given me the correct sizes to use for the two pages. 1080x1080 for Instagram and 1200x600 for twitter. I
will need to make sure I use this correct sizes to please my client. Another thing my client mentions in the brief is that
she wants me to use all the characters out of the book included on the design. I will have to make sure I do this as I
donât want to create work that doesnât have her specific requirements. Other thing the client has mentioned is that she
wants the characters and the fonts from the book to look the same as they do on the book. This is to ensure brand
identity is there. The brief also states I can use my own creativity this means I can come up with whatever design I want
but I will still be having to include the characters and the fonts I am given. Another thing to mention is this book is for
children, this means ill be to insure its family friendly and that there is no explicit content on the designs. I will also
insure that the designs look the best quality. My client also provided me with a phone number and an email. This
allows for me to contact the client whenever I run into any issues I face and any questions. I could also send the client
my work before its finished to see weather she likes the idea and look so far.
Making sure I follow these steps will allow me to not run into an issues I come across. The fact that my client has let me use
my own creativity for the posters allows me to come up with lots of ideas. With it being an informal brief I am not
locked into it so if I decide I donât want to do it I wont have to. There is also no deadline she has specified so I can finish
it for whenever. I will be aiming to finish it for the college deadline so she can expect to have it then.
Reading a brief and the nature and demand of your client brief?
12. NEGOTIATING A BRIEF
Why is it important to discuss the brief with your client prior to production?
It is important to discuss your brief with your client prior to production to make sure you
both understand each other. By not speaking to you client and getting on with your work
straight away could be an issue. This is because you could of read the brief wrong and you
could be producing work that is incorrect. Speaking to the client before hand makes sure
you both fully understand what's be produced and what's going on. Asking them again
about what's happening reassures the requirements and it allows for less problems and a
better work flow. For example after my client emailed me the brief she also sent me screen
shots of existing work that was done for her for inspiration. This helped me get a better
idea of what needs to be done and the style she likes.
13. NEGOTIATING A BRIEF
What are the advantages and disadvantages of employing discretion with a brief?
An advantage of employing discretion with a brief is that you get control as no one is bossing you
around and controlling what you do. This gives you lots more freedom to chose what you want
to make. You could also add things in you client didnât ask for if you think it worked better.
Your client may like it or dislike it thatâs the risk you are facing when doing something like that.
Another advantage is that you aren't getting bothered by anyone this means you can get on
with your work in piece. This allows for you to get on with your work faster, this will in turn
please your client.
A disadvantage of discretion is you donât get much advice or help. Because you are working alone
you get no help or opinions from anyone. This could lead to your work not being at its best as
it needed tweaking but you didnât realise that and someone who was giving advice may of
seen the tweaks and helped you.
14. NEGOTIATING A BRIEF
Are there any potential legal/ethical/regulatory issues with the briefâs proposed product?
Firstly my client has asked me to produce work that is for her children's book.
The brief stated that I was to use her characters and her fonts. This allows me to
run into less copyright issues as its her characters and her fonts. This only things
I need to be careful on is when am design the backgrounds and things for the
characters to be in. This wont be an issue as I will be using shapes on Photoshop
I wont be taking any images off the internet. I will have to be careful on not
putting anything explicit on them as it is for a children's book.
15. NEGOTIATING A BRIEF
Amendments you have considered to:
The Product
The product will be as my client has my client has specified I will be using my
creative skills to make something appealing to her and her audience.
The Budget
There is no budget as I will only be using Photoshop and using emails to contact
her.
The Conditions
The conditions are the same I have to use those correct dimensions, characters
and the font there is no deadline still and I will get the work in to her as soon
as am done.
16. OPPORTUNITIES
What opportunities could this brief allow you to explore?
Self Development and learning new skills
I will gain some of the social skills you gain from speaking to clients and I will also be gaining
skills on reading a brief for future reference. This will help me in the future with fully
read a brief and understand it not only that, but also know what to do after I have read
it. For example emailing my client asking if thatâs everything the clients after to double
check thatâs what am doing. This will lead to less problems and a happier client.
17. OPPORTUNITIES
Multi-skilling
From this brief I can you my skills such as Photoshop, social media knowledge and writing. I
will be using all these skills to make my posters and when contacting my client. Have
Photoshop skills sets you apart from people and it shows that you are capable of
designing professional products.
Contributing to a project
My project will increase awareness of the author and her book. Doing this free of charge
really helps the client as being an author can be very expensive to get yourself going.
Having given free posters helps bring awareness and save money for her. It also helps
me gain experience for future life.
