2. CONTRACTUAL BRIEF
Definition- This is a written agreement that two parties
sign with specific requirements, tasks, time frame and a set
payment. Because the contract is written and is signed by both
parties it must be followed, if it is not it can end up with people
being suede, or ending up in court because they have breached
their contract.
Advantages- An advantage of this brief is that because both
parties have signed and know exactly want each other has to
do, it means there is no room for confusion. As well as this
because it is a signed contract if the other party did not hold
up their side of the deal you have the means to take them to
court about a specific breach of the contract.
Disadvantages- One disadvantage of this type of brief is that if
you do not hold up your end of the deal or you change you
mind about anything the other party could take you to court.
As well as this if you do not deliver what your client has asked
for they may have the right not to pay you as you have not
delivered what you aggreed on.
3. FORMAL BRIEF
Definition- This is a brief that only states what the client wants,
it dose not outline a specific timescale or fee. This type of brief
only contains the necessary information needed to
complete what the client is asking for. The other information
will be decided on during negotiations with the client.
Advantages- An advantage of this type of brief if that it gives
you the freedom to take as much time as you need.
Disadvantages- A disadvantage of this type of brief is that it is
not always legally binding, therefore if someone did not hold
up their end of the brief you may not have the proper evidence
to take them to court.
4. INFORMAL BRIEF
Definition- This type of brief is more than likely going to be a
verbal agreement, it is not a contract or a written document. A
client and company discuss what they both want and agree
upon it.
Advantages- An advantage to this type of brief is that if you
have lots of freedom within a project, as well as this if you
decide you can no longer afford the project or it is not really
worth you time, you can technically stop doing it.
Disadvantages- A disadvantage of this brief structure is that if
you created what the other party asked for they are not legally
obliged to pay you. Therefore if they decided not to you would
have no right to take them to court or try and get them to pay
you.
5. CO-OPERATIVE BRIEF
Definition- This is when there are two or more company's hired
to work to a specific brief. These company's will work together
to create the final product or complete the project.
Advantages- A advantage of this type of brief is that if there are
two company's working on one project it brings two design
ideas together, which can improve the overall design of the
final product. As well as this, it could mean that the work load
can be lightened meaning you may have more time to work on
a specific part.
Disadvantages- A disadvantage is that you could be working
with someone who has compactly different ideas to you and
you just cannot come to an arrangement that you are happy
with.
6. NEGOTIATED BRIEF
Definition- This is when two or more company's are working on
a brief together , if they cannot agree on one idea they will
have to make a negotiated brief. This can involve changes in
any aspect of the project, the visuals and style but they have to
be within the legal and ethical boundaries.
Advantages- an advantage of this type of brief is that if you are
working with someone else and you disagree you can find a
way to work with each other and come to an agreement
together.
Disadvantages- A disadvantage of this type of brief is that you
may come to an agreement that one of the parties did not
agree with, this could mean that this process could take a long
time.
7. COMMISSION BRIEF
Definition- this is when a large company hires an independent
company to create something for them. The contract is
negotiated by the two company's rather than an external client,
the product the company make may be part of a bigger
production.
Advantages- An advantage of this is that as an independent
company or if you are working freelance, you could get the
chance to work with a bigger company and this cold help with
experience and your portfolio.
Disadvantages- A disadvantage of this type of brief is that the
work you create dose not actually belong to you, the copy right
will belong to the people who paid you to create something and
you may not even be credited for you work.
8. TENDER BRIEF
Definition- This is when a client or company publishes that they
need something creating, after this another company will then
create a brief including a budget and proposal and pitch it to
the client. More than one company may pitch ideas to the client
to try and win the contract, it is then up to the client to decide
who they want to create their product.
Advantages- An advantage of this type of brief is that if you
have a lot of control over what is in the brief, you can put your
on budget in and you have the freedom to create your own
ideas.
Disadvantages- A disadvantage of this brief is that if the client
dose not chose your brief, you will have wasted time and
possibly money on creating the idea, brief and proposal.
9. COMPETITION BRIEF
Definition- this is when somebody creates a brief and anyone
can complete the brief and submit it. All completed ideas are
then judged and the best one is selected and they create the
actually product.
Advantages- An advantage of this brief is that anyone can enter
these competitions.
Disadvantages- A disadvantage of this type of this brief is that
the client only pays the winner of the competition and to
enter competitions usually costs money.
10. MY BRIEF
Which structure/structures will your client brief use?
I will use a formal brief for my project. I have chosen this type of
brief because I think it is the most appropriate for my project, I
already have got a timescale and I do not need any money
therefore I do not need a budget. As well as this I do not think
it is necessary to sign a legally binding contract with my client.
Reference your reasons for choice/choices
11. READING THE BRIEF
Why is important to thoroughly read your brief?
It is always important the read the brief because if you don’t you may
miss something important that could change the who project, also if
you are signing a contractual brief and do not read it project, also if
you are signing a contractual brief and do not read it propally you may
have signed up to something that you don’t want but the other party
may have the right to sue you. Another reason it is important the
always read the brief is so they you complatly understand what you are
being asked to do, if you missread or skip something you may make a
product that is not what your client wanted.
12. READING THE BRIEF
What is the nature and demand of your client brief?
The nature of my brief is quite relaxed, there are some guide lines but
nothing that I have been told I have to do or cannot do.
13. NEGOTIATING A BRIEF
Why is it important to discuss the brief with your client prior to
production?
This is important because if you feel like there is something that they
have asked for that you cannot deliver to make sure that both of the
parties understand what each other is doing. As well as this, you have
to make sure that your clinet understand everything that you are going
to create for them.
14. NEGOTIATING A BRIEF
What are the advantages and disadvantages of employing discretion
with a brief?
An advantage of this would be that you can sort of put your own ideas
into a project if the client has not been specific enough. As well as this,
it might give you more freedom to improve you clients ideas, if they are
not appropriate or might not be achievable.
A disadvantage of this would be that if you did stay slightly from the
brief, when you show your client your final product they may not like it.
15. NEGOTIATING A BRIEF
Are there any potential legal/ethical/regulatory issues with the brief’s
proposed product?
One legal issue that if I happen to use images of people that are not
copyrighted to my client or that I have not take myself, they would not
be able to be used in promotional material. Apart from this because my
brief is quite relaxed and I have lots of freedom to create what I think
looks best, I don’t think there are any other issues with the proposed
products.
16. NEGOTIATING A BRIEF
Amendments you have considered to:
The Product- My brief may have to change the product because it might
be to ambitious, I may not have the time or resources to accomplish
what they are asking for, or there may be legal issues that mean I may
have to edit the brief.
The Budget- Changes to the budget are usually due to not having
enough money to finish a project, if this happens the budget will have
to be increased or the project will have to be changed so that it fits the
budget.
The Conditions- In the brief the payment that the client will pay the
company, this may need to be changed due to being paid to much or
to little. However, if this is not done before the contract is signed, for
instance id the project takes longer than expected, it is very hard to get
paid extra money.
17. OPPORTUNITIES
What opportunities could this brief allow you to explore?
Self Development
This will help me develop better media production skills because it gives
me the change to work with someone in the real world, I have to find
my own company and agree on my own brief. This will also help me as
all the ideas have to come form my head, I am given complete freedom
on what I create and how good it turns out.
Learning new skills
A new skill that I will learn during this project is being able to talk to
other company's in a professional way, to not be childish or
unprofessional when talking to a client. It will also give me the skills I
need to understand briefs and knowing how to create them in the best
way for both parties.
18. OPPORTUNITIES
Multi-skilling
There are multi-skilling opportunity's in this project as I have to learn
about my given subject and then be able to talk and promote them in a
positive way. This will help my writing skills as well as the actual design
work.
Contributing to a project
In my brief I have to make a leaflet and a business card, this gives me
the change to get something that I have created out there into the
pubic eye. However it dose not give me the chance to work for a bigger
project or others.
