There was long demand of Direct Selling Industry(“DSI”) for enactment of an express legislation to distinguish between the direct selling entity engaged in genuine direct selling activities and those entities involved in illegal operation of money circulation schemes in form of Ponzi and/or Pyramid Schemes.
The Government of India, pursuant to reports of Parliament Committee on growing menace of the money circulation schemes under one or more disguised structure, has been mulling to bring effective central legislation for curbing all kinds of Ponzi and/or Pyramid Schemes.
The lack of clear distinction in definitions between/among genuine direct selling entities and entities involved in illegal operation of money circulation schemes created confusion and various state governments arrested officials of direct selling entities under the provisions of Prize Chits and Money Circulation Schemes (Banning) Act, 1978, State’s Depositors Protection Act and Indian Penal Code.
Department of Consumer Affairs (Ministry of Consumer Affairs, Food and Public Distribution, GOI) issued DIRECT SELLING GUIDELINES, 2016, inter-alia, in order to curb the menace of money circulation schemes and to bring uniformity in regulations and control of the DSI in the country.
This presentation will enable the direct selling entities to structure their business in compliance of these guidelines and also enable them to understand the new business module for carrying out direct selling activities.

This paper will explore how consumers and customers make buying decisions. We will look at how Amazon uses the environmental factors of offering and price to influence customer to purchase their products. Amazon developed the Amazon Echo, a product most consumers did not know that they would have a need for, the Echo is a smart speaker that connects to voice-controlled intelligent personal assistant service known as Alexa. The Echo was first introduced during the 2016 Super Bowl where there would be millions of people watching. The commercial played throughout the game, and this was the first step in the offering of the Echo to a mass targeted market. Studies have shown that the super bowl is one of the largest watched programs on TV and it is a perfect place to introduce a new product.
Whether a consumer have a need for the Echo or not, the commercial embedded the device in the minds of million and this is the first step in the consumer factors, of the buying process. Now that there is a visual imagine of the Echo. The next step is for the customer to start researching the product, once this is done your search for the Echo is stored. You will start seeing
ads in your social media thread and even if you visit Walmart or Target the Echo will pop-up on the side as a reminder that you did a search on this item. These advertisements start to stimuli your mind and you become more curious and start a more detailed search on the Echo. At this point, Amazon have gathered enough information on the customers to start focusing on a targeted market. They will market products that interest you along with the Echo and show you items others have purchased along with the Echo. After so many ads, the customer starts to get rating about the product from online reviews and ask around. If the ratings are good the customer will most likely purchase the Echo. This is known as the consumer response stage.
Though, I have explained how Amazon stimuli a consumer to purchase their products. Amazon count on the use of demographic and psychographics to segment the market. Their segmentation is on actual purchase behavior and not the assumption or expressed interest. Amazon target each customer individually and converting visitors in to high-value and long-term customers, using the micro-level segmentation strategies. Amazon audience is the middle and upper class customer who really do not have the time to go out to a shopping mall or a physical outlet to shop.
Amazon has successfully positioned itself as a “Go Global Act Local” e-commerce giant. You can buy anything and have it shipped directly to an isolated location.

5. Amazon Marketplace ( i.e:Third-party Marketplace ) is Amazon.com's fixed-price online marketplace that allows sellers to survey their goods alongside Amazon's offerings. Buyers can buy new and used items sold directly by a third party through Amazon.com using Amazon Marketplace. This concept is similar to eBay's successful half.com. This sales strategy and program has been very profitable for Amazon.com, with a commission rate of 6 to 15 percent of the sale price, a $0.99 per-transaction fee, as well as a variable closing fee. Users can leave feedback on transactions, similar to eBay's feedback system, except that Amazon uses a five star rating system instead of just positive, neutral, or negative. Any feedback less than four stars will negatively affect the seller's rating. It is important to note that this rating system is different from Amazon's regular book rating system - while their book rating system should be used to vote on the content of the book, the quality of the publication, the individual's opinion of the book, or any number of other factors, the Amazon Marketplace rating system should only be used to describe the quality of the transaction and whether the product meets the criteria in the seller's listing. Negative feedback, for instance, because a book is old and expensive, affects the seller's feedback rating negatively, and causes other buyers to be less likely to purchase from that seller. Another big difference in the Amazon vs. eBay feedback is reciprocity. Amazon has a one way street. The seller is always judged for the feedback left but the seller is powerless to effect the feedback of the buyer because the buyers feedback is not included in any metric Amazon uses. If a buyer on eBay has bad feedback you can block them but on Amazon you have to accept a sale from a bad feedback customer. Without this measure, customers who feel for any reason to leave a bad feedback can and do. Check it out for yourself. Take a Powerseller on eBay and see if they are selling on Amazon you will see similar items but feedback will be at least 5% off on Amazon what it is on eBay.
