Can intellectual property rights holders demand the website blocking as a remedy under current Union laws? And if so, does this remedy really help them in preventing any future infringements? Or is it just a "plaster" that stops the infringements for a while, but never solves the problem? In the article, these and related legal questions will be answered. This summarises my full report on the role and responsibilities of online intermediaries re copyright infringement, June 2011. The conclusion is that the rush to graduated response solutions is premature given their drawbacks and that legal attention should first go to creating better legal frameworks for facilitating legal online content delivery.

A Survey of Internet User’s Attitudes and Uses of Mobile Phones compared to those of Feature Phone users. Published February 2016 by Effective Measure in partnership with SilverstoneCIS and the IAB and MMA South Africa.
Effective Measure, a leading provider of digital audience, brand and advertising measurement together with SilverstoneCIS, a mobile first audience marketing and solutions group, surveyed 2,299 mobile Internet users in South Africa (between November and December, 2015).
Topics covered a range of areas including but not limited to users’ manufacturer preference, time on device, use of device and internet usage.
The survey was conducted across smartphones and feature
phones to highlight the differences in user consumption across the two types of mobile Internet connections.
South Africa isn't just Africa’s biggest economy, it’s also home to some seriously impressive mobile internet statistics.
Our report looks at everything mobile internet-related - from social media to education, banking to e-commerce. It's hard not to be impressed by how quickly mobile has built new opportunities for locals, and also businesses looking to enter South African market.

The increasingly sophisticated realm of crime involves challenges related to digital evidence, and employing such evidence in court, as well as actors, actions, or substantial effects that are wholly or in some part located or have been carried out in different jurisdictions. Access to relevant evidence is essential both for the conviction of criminals and for the protection of those wrongly accused. However, due to the decentralised nature of cyberspace, the targeted evidence may be residing in multiple jurisdictions at once or it may be impossible to identify the location at all at a given time (e.g. in the case of cloud computing).
This presentation examines a range of traditional and novel tools aimed at ensuring law enforcement agencies’ cross-border access to evidence such as the Mutual Legal Assistance framework, and the initiatives in the European Union (notably the e-Evidence proposal), Council of Europe (the Budapest Convention) and in the United States. The discussion then moves on to relevant principles of international law such as territorial sovereignty, and seeks to examine the possible global reach and effect on other regions of the EU e-Evidence proposal.

The European Commission's proposal for a new General Data Protection Regulation (GDPR), represents the most significant global development in data protection law since Directive 95/46. It will considerably impact cross-border e-discovery in the EU.

The European Commission’s Digital Single Market Strategy aims to ease content blocking restrictions on paid content across Europe. However, when it comes to copyright infringement, the Strategy currently only encompasses “large-scale infringement.” In order to achieving a level-playing field, Internet blocking order has become the ‘weapon of choice’ for combatting music piracy in the digital world. But what are a content owner’s rights?

• Rome I: choice of law cannot deprive consumers of protection
of law of the State of habitual residence
● Is it contrary to Unfair Terms Directive 93/13 not to inform the
consumer of this?
● CJEU:
• Choice of law clause is unfair insofar as it gives impression that
only the chosen law applies, without informing consumer that
he enjoys protection of mandatory provisions of law that would
