Small Presentation
Surrogacy is a way for couples or individuals who can't have a baby on their own to still have a child. It involves another
woman, called a surrogate, who carries the pregnancy for them. The surrogate becomes pregnant with the couple's or
individual's embryo, which is created using the intended mother's egg or a donor's egg and the intended father's sperm or
a donor's sperm. The embryo is placed into the surrogate's uterus through a medical procedure called in vitro fertilization
(IVF).

As for risks, the process carries similar risks to a standard
pregnancy, such as gestational diabetes or high blood
pressure.
 However, with proper medical care and monitoring, these risks
can be minimized.
DIFFERENCE BETWEEN SURROGACY AND
GAMETE INTRAFALLOPIAN TRANSFER -
Surrogacy- GIFT-
1) when another women carries - and gives birth
to a baby for a person or couple Who cannot
conceive or carry a pregnancy themselves.
2) Surrogate may use her own egg (Traditional
surrogacy) Or a donor egg ( gestational
surrogacy) that is fertilized with sperm Either
from the intended father or a donor Through
IVF.
3) Surrogate involves someone else carrying the
pregnancy for intended parents And requires
legal contracts and agreements.
1) Gamete Intrafallopian Transfer (GIFT) -
Fertility treatment is used when Women has a
problem with her fallopian tubes that prevents
natural conception.
2) With Gift, the Women's eggs And the partners
sperm are placed Directly into her fallopian tubes
where fertilization Can occur inside her body
naturally.
3) GIFT does not involve a surrogate, It is a
medical procedure to help couples conceive by
facilitating fertilization inside the women’s body.
Ques.Is surrogacy legal in India for foreigners ?
Ans.No, surrogacy in India is not permitted for foreigners. Only OCI card holders can
opt for surrogacy in India.
Ques.Is embryo donation allowed in surrogacy?
Ans.No, embryo donation is not permitted in surrogacy. The intended parents must be
biological parents (egg or sperm).
Ques.What is the duration of the surrogate’s insurance?
Ans.The surrogate’s insurance must cover her for three years ( 36 months).

Ques. What are the key changes in the 2024 Surrogacy Law in India?
Ans. In 2024, India’s surrogacy law shifted to altruistic surrogacy, prohibiting
commercial surrogacy. Surrogates can only receive compensation for medical
expenses and insurance. Eligibility criteria for intended parents were
established.
Ques. Is commercial surrogacy still allowed in India in 2024?
Ans. No, commercial surrogacy is banned in India in 2024. Only altruistic
surrogacy is permitted, with no monetary gain for surrogates.
