4. Section 406 paragraph one. Any person who,
through an act of performance made by another
person or in any other manner, obtains something to
the prejudice of such other person without legal
ground, must return it to the latter. The
acknowledgement of the existence or non-existence
of a debt is deemed to be an act of performance.

5. Section 406 paragraph two. The same
provision shall apply if something has
been obtained on account of a cause
which has not been realised or of a
cause which has ceased to exist.

8. Section 407. A person who has freely
done an act as if in performance of
an obligation, knowing that he was
not bound to effect the performance,
is not entitled to restitution.
มาตรา ๔๐๗ บุคคลใดได้กระทําการอันใดตาม
อําเภอใจเหมือนหนึ่งว่าเพื่อชําระหนี้โดยรู้อยู่ว่าตน
ไม่มีความผูกพันที่ต้องชําระ ท่านว่าบุคคลผู้นั้นหามี

9. Section 408. The following persons are not entitled to
restitution:
(1) A person who performs an obligation subject to a time
clause before the time has arrived.
(2) A person who performs an obligation which has been
barred by prescription.
(3) A person who performs an obligation in compliance with
a moral duty or with the requirements of social propriety.
มาตรา ๔๐๘ บุคคลดั่งจะกล่าวต่อไปนี้ไม่มีสิทธิจะได้รับทรัพย์คืน คือ
(๑) บุคคลผู้ชําระหนี้อันมีเงื่อนเวลาบังคับเมื่อก่อนถึงกําหนดเวลานั้น
(๒) บุคคลผู้ชําระหนี้ซึ่งขาดอายุความแล้ว
(๓) บุคคลผู้ชําระหนี้ตามหน้าที่ศีลธรรมหรือตามควรแก่การอัธยาศัย
ในสมาคม
10. Section 409 paragraph one. When a person who
is not a debtor has performed an obligation by
mistake and the creditor, in consequence thereof,
has in good faith destroyed or obliterated the
documentary evidence of the obligation or given
up any security or lost his right by prescription,
the creditor is not bound to make restitution.
มาตรา ๔๐๙ วรรคหนึ่ง เมื่อบุคคลผู้หนึ่งผู้ใดซึ่งมิได้เป็นลูกหนี้ได้
ชําระหนี้ไปโดยสําคัญผิดเป็นเหตุให้เจ้าหนี้ผู้ทําการโดยสุจริตได้

11. Section 409 paragraph two. The
provisions of the foregoing paragraph do
not prevent the person who has
performed from exercising a right of
recourse against the debtor and his
surety, if any.

วรรคก่อนนี้ไม่ขัดขวางต่อการที่บุคคลผู้ได้ชําระหนี้

12. Section 410. A person who had made a
performance for an intended result which is not
produced is not entitled to restitution, if, from the
beginning, it was known to him that the
production of the result was impossible or if he
has prevented the result in violation of good faith.
มาตรา ๔๑๐ บุคคลผู้ใดได้ทําการชําระหนี้โดยมุ่งต่อผลอย่างหนึ่งแต่
มิได้เกิดผลขึ้นเช่นนั้น ถ้าและบุคคลนั้นได้รู้มาแต่แรกว่าการที่จะเกิด
ผลนั้นเป็นพ้นวิสัยก็ดีหรือได้เข้าป้องปัดขัดขวางเสียมิให้เกิดผลเช่น
นั้นโดยอาการอันฝ่าฝืนความสุจริตก็ดี ท่านว่าบุคคลผู้นั้นไม่มีสิทธิจะ
ได้รับคืนทรัพย์
13. Section 411. A person who has made
an act of performance, the purpose of
which is contrary to legal prohibition
or good morals, cannot claim
restitution.
มาตรา ๔๑๑ บุคคลใดได้กระทําการเพื่อชําระหนี้
เป็นการอันฝ่าฝืนข้อห้ามตามกฎหมายหรือศีลธรรม
อันดี ท่านว่าบุคคลนั้นหาอาจจะเรียกร้องคืนทรัพย์
ได้ไม่
14. Section 412. If the property which was unduly
received is a sum of money, restitution must be
made in full, unless the person who received it
was in good faith in which case he is only bound
to return such part of his enrichment as still
exists at the time when restitution is demanded.
มาตรา ๔๑๒ ถ้าทรัพย์สินซึ่งได้รับไว้เป็นลาภมิควร
ได้นั้นเป็นเงินจํานวนหนึ่ง ท่านว่าต้องคือเต็มจํานวน
นั้น เว้นแต่เมื่อบุคคลได้รับไว้โดยสุจริต จึงต้องคืน
ลาภมิควรได้เพียงส่วนที่ยังมีอยู่ในขณะเมื่อเรียกคืน
15. Section 413 paragraph one. When the property which
must be returned is other than a sum of money and the
person who received it was in good faith, such person
is only bound to return it in such condition as it is and
is not responsible for less or damage to such thing.
But he must return whatever he has acquired as
compensation for such loss or damage.
มาตรา ๔๑๓ วรรคหนึ่ง เมื่อทรัพย์สินอันจะต้องคืนนั้นเป็นอย่างอื่น
นอกจากจํานวนเงินและบุคคลได้รับไว้โดยสุจริต ท่านว่าบุคคลเช่นนั้น
จําต้องคืนทรัพย์สินเพียงตามสภาพที่เป็นอยู่และมิต้องรับผิดชอบใน
การที่ทรัพย์นั้นสูญหายหรือบุบสลาย แต่ถ้าได้อะไรมา้ป็นค่าสินไหม
ทดแทนเพื่อการสูญหายหรือบุบสลายเช่นนั้น ก็ต้องให้ไปด้วย
16. Section 413 paragraph two. If the person
who received the property was in bad faith
he is fully responsible for the loss or
damage even caused by force majeure,
unless he proves that the loss or damage
would have happened in any case.
มาตรา ๔๑๓ วรรคสอง ถ้าบุคคลรับทรัพย์สินไว้โดยทุจริต
ท่านว่าจะต้องรับผิดชอบในการสูญหายหรือบุบสลายนั้น
เต็มภูมิ แม้กระทั่งการสูญหายหรือบุบสลายจะเกิดเพราะ
เหตุสุดวิสัย เว้นแต่จะพิสูจน์ได้ว่าถึงอย่างไรทรัพย์สินนั้นก็
คงต้องสูญหายหรือบุบสลายอยู่นั่นเอง
17. Section 414 paragraph one. If restitution is
impossible on account of the nature of the
property received or for any other reason, and
the person who received the property was in
good faith, such person is bound only to return
such part of his enrichment as still exists at the
time when restitution is demanded.

18. Section 414 paragraph two. If a
person who received the property
was in bad faith, he is bound to pay
the full value of the property.
มาตรา ๔๑๔ วรรคสอง ถ้าบุคคลได้รับทรัพย์สินนั้นไว้โดย
ทุจริต ท่านว่าต้องใช้ราคาทรัพย์สินนั้นเต็มจํานวน
19. Section 415 paragraph one. A
person who received the property in
good faith acquires the fruits thereon
as. Long as such good faith
continues.
มาตรา ๔๑๕ วรรคหนึ่ง บุคคลผู้ได้รับทรัพย์สินไว้
โดยสุจริต ย่อมได้ดอกผลอันเกิดแต่ทรัพย์สินนั้น
ตลอดเวลาที่ยังคงสุจริตอยู่
20. Section 415 paragraph two. In case
where he has to return such thing, he
is deemed to be in bad faith from the
time when restitution is demanded.
มาตรา ๔๑๕ วรรคสอง ถ้าผู้ที่ได้รับไว้จะต้องคืน
ทรัพย์สินนั้นเมื่อใด ให้ถือว่าผู้นั้นตกอยู่ในฐานะ
ทุจริตจําเดิมแต่เวลาที่เรียกคืนนั้น
21. Section 416 paragraph one. Expenses
which were necessary for the preservation
of the property or for its maintenance or
repair must be reimbursed in full to the
person who returns such property.
มาตรา ๔๑๖ วรรคหนึ่ง ค่าใช้จ่ายทั้งหลายอันควร
แก่การเพื่อรักษาหรือซ่อมแซมทรัพย์สินนั้น ท่านว่า
ต้องชดใช้แก่บุคคลผู้คืนทรัพย์สินนั้นเต็มจํานวน
22. Section 416 paragraph two. However
such person cannot claim reimbursement
of the ordinary expenses for maintenance,
repairs or charges made within the time
during which he has acquired the fruits.
มาตรา ๔๑๖ วรรคสอง แต่บุคคลเช่นว่านี้จะเรียก
ร้องให้ชดใช้ค่าใช้จ่ายธรรมดาเพื่อบํารุงซ่อมแซม
ทรีพย์สินนั้นหรือค่าภารติดพันที่ต้องเสียไปใน
ระหว่างที่ตนคงเก็บดอกผลอยู่นั้นหาได้ไม่
23. Section 417 paragraph one. For the expenses other
than those provided in paragraph 1 of the foregoing
section the person who returns the property can
claim reimbursement only if they were made while he
was in good faith and if the value of the property is
increased by such expenses at the time of restitution,
and only to the extent of such increase.
มาตรา ๔๑๗ วรรคหนึ่ง ในส่วนค่าใช้จ่ายอย่างอื่นนอกจากที่กล่าวมา
ในวรรคต้นแห่งมาตราก่อนนั้น บุคคลผู้คืนทรัพย์สินจะเรียกให้ชดใช้
ได้แต่เฉพาะที่เสียไปในระหว่างที่ตนทําการโดยสุจริต และเมื่อ
ทรัพย์สินนั้นได้มีราคาเพิ่มสูงขึ้นเพราะค่าใช้จ่ายนั้นในเวลาที่คืนและ
จะเรียกได้ก็แต่เพียงเท่าราคาที่เพิ่มขึ้นเท่านั้น
25. Section 418 paragraph one. If the person who has in bad
faith unduly received a property has made alteration in, or
additions to it, he must return the property after having put
it in its former condition at his own expense, unless the
owner of the property chooses to have it returned in its
present condition, in which case the owner must pay at
his option either the cost of the alterations or additions, or
sum representing the increased value of the property.
มาตรา ๔๑๘ วรรคหนึ่ง ถ้าบุคคลรับทรัพย์สินอันมิควรได้ไว้โดยทุจริต
และได้ทําการดัดแปลงหรือต่อเติมขึ้นในทรัพย์สินนั้น ท่านว่าบุคคล
เช่นนั้นต้องจัดทําทรัพย์สินนั้นให้คืนคงสภาพเดิมด้วยค่าใช้จ่ายของ
ตนเองแล้วจึงส่งคืน เว้นแต่เจ้าของทรัพย์สินจะเลือกให้ส่งคืนตาม
สภาพที่เป็นอยู่ ในกรณีเช่นนี้ เจ้าของจะใช้ราคาเท่าค่าทําดัดแปลง
หรือต่อเติมหรือใช้เงินจํานวนหนึ่งเป็นราคาทรัพย์สินเท่าที่เพิ่มขึ้นนั้น
ก็ได้ แล้วแต่จะเลือก
26. Section 418 paragraph two. When restitution is to
be made, if it is impossible to put it in it's former
condition or the property would be damaged thereby,
the person who received the property must return it in
such condition as it is and he is not entitled to
compensation for any increase of value accruing to
the property from such alterations or additions.
มาตรา ๔๑๘ วรรคสอง ถ้าในเวลาที่จะต้องคืนทรัพย์นั้นเป็นพ้นวิสัยจะ

ขึ้นเพราะการดัดแปลงหรือต่อเติมนั้นได้
27. Section 419. No action on account of
undue enrichment can be entered later
than one year from the time when the
injured party became aware of his right to
restitution or later than ten years from the
time when the right accrued.
มาตรา ๔๑๙ ในเรื่องลาภมิควรได้นั้น ท่านห้ามมิให้
ฟ้องคดีเมื่อพ้นกําหนดหนึ่งปีนับแต่เวลาที่ฝ่ายผู้เสีย
