Pendakwaraya melawan Nureen Azlina binti Akmal
OKT bangun dan tunduk sambil melihat kepada Puan Hakim. Pendakwaraya bangun
memperkenalkan diri.
Pendakwa : Tuan Majistret, saya Nur Atiqah binti Roslan Timbalan Pendakwaraya yang
akan menjalankan pendakwaan kes ini dan rakan bijaksana Cik Sara binti

“Bahawa kamu pada 10/9/2004 di antara jam 5.30 petang hingga 10.00
malam bertempat di bilik mandi belakang kilang perabut tidak bernombor
Jalan Tambak Merah, TamanMelati, di dalam daerah Gombak di dalam
negeri Selangor telah didapati dengan sengaja menyebabkan kecederaan
parah di bahagian muka ke atas penama Ku Ahmad Kamal bin Ku Kamil
KPT 840830-01-5679 dengan menggunakan asid,oleh yang demikian
kamu telah melakukan satu kesalahan di bawah seksyen 320 (f) Kanun
Keseksaan dan boleh dihukum di bawah Seksyen 326 Kanun yang sama.”

Pendakwa : Puan Hakim, sejajar dengan peruntukan di dalam jadual pertama Kanun
Prosedur Jenayah bahawa kesalahan ini tergolong dalam kesalahan tidak
boleh jamin, pendakwaan tidak menawarkan sebarang ikat jamin terhadap
tertuduh Puan.

Peguambela : Puan Hakim, the accused plead to this Honorable court to grant bail based on
these arguments. Indeed, the offence charged on the accused person is an
offence categorized under non-bailable offence in provides under first
schedule of the Criminal Procedure Code. However, in the case of PP v Mat
Zain [1948-49] MLJ Supp 142 it was highighted that the court has
discretionary power to grant bail for non bailable offences depending on the
circumstances and facts of each case. Thus it shows that the provision is not
mandatory to be complied with.
According to Section 388 (1) of Criminal Procedure Code
When any person accused of any non bailable offence is arrested or detained
without warrant by a police officer or appears or is brought before a Court,
he may be released on bail by the officer in charge of the police district or by
that Court, but he shall not be so released if there appears reasonable
grounds for believing that he has been guilty of an offence punishable with
death or imprisonment for life:
Provided that the Court may direct that any person under the age of sixteen
years or any woman or any sick or infirm person accused of such an offence
be released on bail.
In case of Dato Balwant Singh [2002] 4 MLJ 427, even though the accused was
charged with murder under Section 320 Penal Code punishable with death
penalty, the fact that he was 80 years old and was of ill health at the material
point of time, the court granted bail to the accused base on the proviso under
Section 388 (1) of CPC.
We are argued since the accused within the proviso mention above, thus the
accused may be released by the court on bail.
The accused was 25 years old and she was a mother of two children and was
breast feeding. She lived in the house which had been rented for the past 5
years with the payment of RM 300 per month. She worked as clerk in
Matsimura Factory with salary RM 1000 per-month. At the material time, she
has a quarrel with victim (her husband) and it was victim who brought the
acid and when she trying to snatch the plastic bag, the plastic exploded and
caused it splashed to victim’s face.

The accused plead for mercy to this honourable court grant bail to her and
she undertakes to attend to court whenever she requires to do so for the
purpose of this proceeding.

Prosecution plead from this Honorable court to reject the application to
grant bail to the accused base on following arguments.
The words used in Section 388(1) of CPC is the court may be released on
bail.. The word may in this context shall reflects the discretionary power of
the court whether to release the accused with bail or not. This provision is
not mandatory.
We refer to case PP v Wee Wee Siang [1948] 1 MLJ 114 when the High Court
lists down 9 non- exhaustive factors to be considered by the court before the
application of bail could be granted. The factors inter-alia, by looking at
whether there are reasonable grounds to believe that the accused is guilty of
offence, looking at the nature and gravity of the offence and danger of
witnesses being tempered with is accused is released on bail. Further in case
PP v Dato’ Ser Anwar Ibrahim [1998] CLJ JT (12) Augustine Paul J, considered
the facts in Wee Wee Siang and also inter-alia, danger of witnesses being
tempered.
In present case, base on the investigation, we are in the belief that there is a
prima-facie case that the accused guilty of the offence since it was accused
who splash the acid onto victim’s face dissatisfied that the victim had an
affair with another woman. The accused indeed has a motive to perform
such. Furthermore, one of the prosecution witness is her daughter which
staying with the accused and victim prior to this incident. If the accused
release with bail, we afraid that the accused has tendency and opportunity to
temper prosecution witness.
Base on the arguments above, we oppose the application for bail and pray to
this Honorable Court to put the accused person under remand.

dikemukan, Mahkamah dengan ini menggunakan budi bicara Mahkamah
sebagaimana yang diperuntukan di dalam proviso Seksyen 388 (1) Kanun
Prosedur Jenayah. OKT dilepaskan dengan jaminan sebanyak RM 5,000
dengan seorang penjamin warganegara Malaysia. Tertuduh adalah dilarang
samasekali dari mengacauganggu saksi dan mempengaruhi saksi
pendakwaan. Dan sekiranya mahkamah ini menerima aduan yang
seumpamanya, mahkamah tidak akan teragak-agak untuk membatalkan
jaminan ke atas kamu dan meletakkan kamu dalam tahanan reman. Kamu
juga perlu hadir pada bila-bila masa yang ditetapkan untuk prosiding ke atas
kamu dan kegagalan untuk mematuhi arahan ini akan mengakibatkan waran
tangkap dikeluarkan ke atas kamu.
