Possible aspects of review
i) New Provisions
ii) Revised provisions
iii) Provisions that gain broader applicability as a result of being moved from a specific
Directive to a single common Directive (that also potentially affects the relationship
between Recitals and Articles).
iv) Provisions that have been affected by developments in the sector since the 2002
Framework, and which should therefore be updated (but which have not been in the Draft).
– E.g. Usage of “broadcasting”
v) Transitional arrangements.
– There is no Article in this draft Directive on transitional arrangements
– If measures have been enacted under the previous Directives, do these measures continue in
force after the previous Directives are repealed?

Different areas for possible comment
– To provide input to DCMS on the draft EECC Decision and the 5G Action Plan
– The baseline is the two SPF papers on these topics
• Though we can refine the views in these papers if appropriate
– We should focus on the parts of the Commission documents that address spectrum
• Or with a specific spectrum dimension
• More general aspects can be addressed through techUK or trade associations
– The output of the meeting is likely to be concise, with perhaps half a dozen key points
• Areas of consensus, or where it is important to convey a range of views
• Detailed/editorial improvements can be provided to DCMS by individual stakeholders
– The form of the output will be agreed at the end of the meeting
• Together with the process for development

5 Key Areas of Agreement on the Framework
– The UK application of the current Telecoms Framework represents 'best practice'.
• From a UK perspective, there is no need for substantial changes
– Some UK stakeholders had less positive experiences in other EU countries
• The review should provide greater consistency in national implementation across EU MS
– Spectrum sharing will play an increasing role in finding spectrum for new applications
• It is important that the EECC does not skew decisions towards particular types of sharing and
away from others
– Harmonisation will be important in building successful ecosystems
• But differing views on the extent to which it should be mandated and centralised, rather than
the result of dialogue between Government and regulators and industry
– Predictability, consistency and timeliness of regulatory outcomes are important factors for
major investment decisions

Recommended Actions for Successful Deployment of 5G in the UK
– 3 main factors for a timely deployment of 5G in the UK:
• Access to appropriate sites
• Availability of supporting infrastructure (including backhaul)
• Availability of spectrum needed to support 5G
– Timely licensing and availability of frequency bands suited to 5G deployment is important
• Bands that might become harmonised globally for 5G
• bands already being planned for UK mobile award, such as 700MHz and 3.4GHz
– global harmonisation of millimetre-wave bands is needed, to achieve economies of scale
– The SPF supports the UK’s current position that has emerged from CEPT and ITU-R bodies
– Regulatory support is also needed for new forms of spectrum access – such as LAA
– Suitable access and tenancy conditions for radio sites is becoming increasingly important
• New types of sites will be needed, particularly for small cells
– The business models for use cases to different vertical markets need to be better understood
