A Muslim woman named Shayara Bano challenged the practice of triple talaq in the Supreme Court after her husband divorced her using that method. She argued that triple talaq, as well as polygamy and nikah halala, violate the fundamental rights of Muslim women under Articles 14 and 15 of the Indian Constitution. The Supreme Court took up the case and was tasked with determining whether triple talaq is unconstitutional. While the All India Muslim Personal Law Board argued that uncodified personal laws cannot be subject to judicial review, the court had to rule on whether triple talaq violates the fundamental rights of Muslim women.
