Conditional Use Permit –
Northgate Mobile Food Court

Requested Amendments
Setbacks
• Food truck pad sites and dining areas be setback a minimum of 100’ from rights-of-
way and public ways. The applicant has requested to meet Northgate Standards by
placing trucks and dining areas closer to the property line and sidewalk.
• Food truck pad sites shall be a minimum of 10’ away from other pad sites and dining
areas. The applicant is requesting 7’ spacing between pad sites and the dining
pavilion.
Parking
• A minimum of 2 off-street parking spaces shall be provided per food truck pad site.
The applicant is requesting to meet Northgate commercial parking requirements,
which does not require parking for commercial businesses.
Fire Lane
• A minimum of a 20’ fire apparatus access route is required around a mobile food
court. The applicant has requested to not provide one as fire has determined they can
fight from First Street and do not need access into the site.
Additional Conditions
1. No amplified music or sound is permitted on the property.
2. A minimum of two Texas certified peace officers hired by the owner, operator or
manager of the Long-Term Mobile Food Court are required to remain on the Property
to enforce the laws of the State of Texas anytime alcohol is sold or consumed on the
Property.
3.The Long-Term Mobile Food Court must close at 2:00 A.M and remain closed until 5:00
A.M.
Conditional Use Review Criteria
Purpose and Intent of UDO.
• The proposed use shall meet the purpose and intent of this UDO and the use shall meet all the minimum
standards established in this UDO for this type of use.
Consistency with Comprehensive Plan.
• The proposed use shall be consistent with the development policies and goals and objectives as embodied in
the Comprehensive Plan for development of the City.
Compatibility with Surrounding Area.
• The proposed use shall not be detrimental to the health, welfare, or safety of the surrounding neighborhood or
its occupants, nor be substantially or permanently injurious to neighboring property.
Harmonious with Character of Surrounding Area.
• The proposed site plan and circulation plan shall be harmonious with the character of the surrounding area.
Infrastructure Impacts Minimized.
• The proposed use shall not negatively impact existing uses in the area or in the City through impacts on public
infrastructure such as roads, parking facilities, electrical, or water and sewer systems, or on public services
such as police and fire protection, solid waste collection, or the ability of existing infrastructure and services to
adequately provide services.
Effect on Environment.
• The proposed use shall not negatively impact existing uses in the area or in the City.

Northgate Mobile Food Court

  • 5. Requested Amendments Setbacks • Food truck pad sites and dining areas be setback a minimum of 100’ from rights-of- way and public ways. The applicant has requested to meet Northgate Standards by placing trucks and dining areas closer to the property line and sidewalk. • Food truck pad sites shall be a minimum of 10’ away from other pad sites and dining areas. The applicant is requesting 7’ spacing between pad sites and the dining pavilion. Parking • A minimum of 2 off-street parking spaces shall be provided per food truck pad site. The applicant is requesting to meet Northgate commercial parking requirements, which does not require parking for commercial businesses. Fire Lane • A minimum of a 20’ fire apparatus access route is required around a mobile food court. The applicant has requested to not provide one as fire has determined they can fight from First Street and do not need access into the site.
  • 6. Additional Conditions 1. No amplified music or sound is permitted on the property. 2. A minimum of two Texas certified peace officers hired by the owner, operator or manager of the Long-Term Mobile Food Court are required to remain on the Property to enforce the laws of the State of Texas anytime alcohol is sold or consumed on the Property. 3.The Long-Term Mobile Food Court must close at 2:00 A.M and remain closed until 5:00 A.M.
  • 7. Conditional Use Review Criteria Purpose and Intent of UDO. • The proposed use shall meet the purpose and intent of this UDO and the use shall meet all the minimum standards established in this UDO for this type of use. Consistency with Comprehensive Plan. • The proposed use shall be consistent with the development policies and goals and objectives as embodied in the Comprehensive Plan for development of the City. Compatibility with Surrounding Area. • The proposed use shall not be detrimental to the health, welfare, or safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property. Harmonious with Character of Surrounding Area. • The proposed site plan and circulation plan shall be harmonious with the character of the surrounding area. Infrastructure Impacts Minimized. • The proposed use shall not negatively impact existing uses in the area or in the City through impacts on public infrastructure such as roads, parking facilities, electrical, or water and sewer systems, or on public services such as police and fire protection, solid waste collection, or the ability of existing infrastructure and services to adequately provide services. Effect on Environment. • The proposed use shall not negatively impact existing uses in the area or in the City.
