They are fraudulent in nature. The nature of the object and the consideration is such that it defeats the purpose of the law.

 Consideration can be defined as demand of each parties
 Includes some right, interest, profit or benefit for one party
 some forbearance, loss or responsibilities undertaken by the other
 It can be to do something or to abstain from something
 Consideration should be promised

• Consideration must move at the desire of the promisor
• It may move from the promisee to any other person
• It can be in the past, present or future
• It must have value in the eyes of the law
• It should be over the Promisors’ existing obligations
• It cannot be Unlawful

 Consideration may be classified into three types
 Past, executed, or executing Consideration
Past Consideration:
when the consideration of one party was given before the date of
promise.
Executed Consideration:
It is something given or accepted in return for promise where the
promise act has already been performed.

• The desire of promisor is essential
• The consideration must be real
• Public Duty will not amount to be a ‘consideration’

An example of Lawful Consideration:
Peter and John enter into a contract where Peter promises to deliver 15
curtains to John in one month’s time. Also, John promises to pay Peter an
amount of Tk. 3,000 on delivery.
In this contract, John’s promise to pay Tk. 3,000, on delivery, is the
consideration for Peter’s promise. Also, Peter’s promise of delivering 15
curtains is the consideration of John’s promise to pay.

 Legality of objects depends on state’s law
 Every individual objects has to be lawful
 The court can’t force anyone if the object is unlawful
 To be a legal contract both object and consideration has to be lawful
