farming tools and the using the ox. Attitudes towards the technology at the time for each civilization
caused pride and encompassed order to accumulate success, but the Han viewed workers more equally

I had been out of the hospital for two weeks. I was staying on track with my medicine, with the help of
my husband Bryon. I have been dealing with depression for a while now and I eventually ended up
being emitted to the hospital. I decided to take time off work for a while until I got back in the swing
of things. Me and my husband Bryon decided that was the best thing to do. Every day Bryon would
make sure I took my medicine in the morning before he went to work and every evening when he got

sure didn t try anything to take my life. Bryon removed all of the sharp objects from the house, like
knives and scissors. I didn t feel like all of that was necessary, but I could see why he did that with the

In 1861, the Offences Against the Person Act (OAPA 1861) was introduced to give distinction
between various criminal acts towards other people. However, from its inception it has created the
requirements for defences for the numerous offences. One of the most complex of these is the defence
of consent, the one to be considered here. With regard to this problem, it is necessary to identify any
crime that has been committed, examine how consent will apply and analyse how satisfactory the law
is on this topic. I will first discuss what crimes Wilbur has committed followed by whether he can
indeed use the defence of consent before finishing with my own thoughts on the law and how this area
could possibly benefit from reform.
Under s.20 of the OAPA 1861, Wilbur has committed the crime of Grievous Bodily Harm (GBH)
against Ewan. Despite only meaning to cause bruising which would count as battery, Wilbur has
caused a much more serious offence in GBH albeit unintentionally. Wilbur did not mean to cause
GBH but s.20 of the above act enables him to be charged for GBH without meaning it, as it brings a
recklessness element into play. Under s.20, the defendant must have the intention or be reckless as to
the causing of some harm. There is no need for the prosecution to establish that they intended or was
reckless as to causing serious harm. In the case of DPP v Smith , grievous bodily harm was defined as
really serious harm, which the ripping off of two fingers definitely satisfies.
