1. Project Introduction
For our final Introduction to the Construction Industry (ICI) assignment, in a
group of two, we are to find a specific empty land to initiate a small
construction project that serves the purposes stated. The size of the and should
be between 900 meters square (30m x 30m) to 1200 meter square (30m x 40m).
The objective of this assignment is to enable us to develop an understanding of
the building team, its organization, duties and inter-relations within which they
will seek employment, career progression or further study. We developed an
awareness of the professional responsibilities as well as to appreciate their
profession in the construction industry.

2. Project Site
2.1 Site Introduction
Tebrau is the largest sub-division in Johor Bahru (JB) District. Its townships
include Bandar Dato’ Onn, Adda Heights, Taman Delima, Taman Daya, Setia
Indah, Taman Mount Austin, Desa Tebrau, Taman Istimewa and Taman Bukit
Mutiara. The villages in Tebrau are Kampung Kangkar Tebrau, Kampung
Pandan and Kampung Keling.

2.2 Site Location
We chose a relatively large empty land between Jalan Harmonium 35/3, Jalan
Harmonium 24 and Jalan Persiaran Desa Tebrau in Johor Bahru, Johor.
Since this empty land is at a rather potential location and where the crowds are
at, we decided to put it to good use. We decided to combine our concept ideas,
agriculture and commercial, as it is rare to find agriculture around most cities
here in Johor Bahru.

2.2 Site Analysis

The sun rises from the east and sets at the west therefore people can enjoy
and watch the sunset and the sunrise here. Wind blows from both the south
and east that makes the land here rather cool during day and night.

Ambience
Soft traffic noises can be heard all day long since it is located between two
roads at the south and the west. The place is cool through out day and
night.
Pros and Cons
The area is full of sophisticated shop houses and has very limited amount
of greeneries that is why we chose agriculture as one of our concept. That
area is accessible to a lot of places and is a rather convenient place.
Moreover, Hotel Tebrau CT, few 3 storey semi-d show houses and also few
new blocks are located across the street of this land which results more
crowd in years to come. Since it is located in between two two-lane main
roads, traffic might become a problem as well as noise pollution.

2.3 Site context

As the pictures above shown, our site is only 1200 meter square which is
30 meter by 40 meter in size of the whole piece of empty land between two
fairly busy roads. Across the street is a wide lawn and as you walk down
the road, an old abandoned building can be seen and at the end of the road,
a car maintenance workshop (Pusat Kelengkapan Kereta) is successfully

operating there.
On the road across the site we chose, there is a row of shop houses that
consists of a restaurant or best known as ‘Mamak’, a tuition center named
‘Inspirasi Juara’, a medical centre named ‘Pulse’, Laris Café, a karaoke
center and so on.

3. Project Concept
3.1 Concept introduction
Since the empty land is at the middle of a sophisticated busy mini town, a
combination of agriculture and commercial would do good for the people
around this area. The area is rather empty and stuffy and the air is not fresh and
clean due to the busy traffics from day to night, hence we propose to create an
agricultural area to lessen the carbon dioxide released by the vehicles that
passes by 24/7. Moreover, the plants can help cool down the temperature around
that land as well as provides the source of clear and fresh air early in the
morning that will be suitable for morning jogs and such.
As for the reason why we combine agriculture with commercial is because since
that area is where most crowds hang around, it would be a good potential place
for business. People living nearby can now have a healthier and cleaner
environment to be around during their free time and to also spend time with
nature in a modern way more often.

3.2 Concept images/ sketches
(Idea 1)
This was our first idea for the
agriculture + commercial plan. At
first, the land was full of sand and
decided to have carpet grass all over
this 30 meter by 40 meter wide land
to start off. Since the surrounding of
this place is a busy and
sophisticated town, a pond would
be perfect for people working
nearby to come and relax after their
working hours. They could also
have dinner on a floating food stall
and watch the busy traffic roads or the peaceful pond water that has a beautiful
water fountain in the middle. Jogging tracks are available for those who would
like to jog in the morning with lots of greens around. However, we find this
plan rather simple as there are too much empty spaces with grass.

(Idea 2)
For our second idea of our proposal plan, we decided to add more features to the
land instead of empty lawn like idea
1, so we decided to run an orchard,
mini fruit stalls and also a pond to
hold fishing competitions etc. We
wanted to have a pond because there
are no sports activity nearby this
area and thought of starting one.
Beside the pond, there will be a
gazebo where people can rest and
relax while watching the calm water
of the pond with fishes swimming
happily inside.

4. Final idea/master plan
We decided to call it Kaicyn’s orchard since agriculture is the main concept
here and only a small area of our site is under commercial concept which is
the fruit stalls in the middle.

After discussing the pros and
cons of ideas 1 and 2, we
finally decided to combine
both of them together as
well as to modify them both
a little. We found out that
quite a number of foreigners
such as Japanese, Turkish,
Koreans and so on are living
around Tebrau area as there is
an international school about
fifteen minutes away from
here and it would also create a good opportunity for us to run an orchard as well
as enable them to get to know more about our Malaysia local fruits such as king
and queen, durians and the mangosteen fruit. Not to forget rambutans, rose
apple (jambu) and many more. Since the surrounding of this site is rather
modern and busy, it would be really good to have an orchard here as in is
different from the others in the way that it is what most kids nowadays have
never seen before.

The car park is located at the end of the side, which is also at the side of the
road for people’s convenience when driving in or out. The pond with a beautiful
water fountain is taken from the first idea and it would be great instead of
having nothing but only green tress, plants etc. There are benches and lamp post
near the pond that would serve the community with recreational purposes.
From the pond, we can walk in after passing by a counter where entrance ticket
will have to be purchased before exploring the orchard. In the middle of the site,
fruit stalls are available for everyone to enjoy the juicy plants they visited in the
orchard. People could also walk into the fruit stalls zone without visiting the
orchard by entering through the car park.

5. Rationale

the orchard, we could buy them at

them at fruit stalls available in the
middle of Kaicyn’s orchard.

6. Types of Procedures
6.1 Development procedures:
First of all, in order to start a project on an empty land,
we need to convert the land use (Section 124,Act 56).
After that, plan a permission slip (Section 19, Act 172: prohibition of
development without permission). Coming up next is building plan approval
(Sec.70 (1), Act 133: No person shall erect any building without the prior
written permission of the local authority). Then, pass through the sub-division
(section 135-139, Act 56). The final process of development approval
is needed to get the Certificate of Fitness for Occupation (CFO).
The relevant statutes for application of CFO include:
1. Town and Country Planning Act 1976
2. Street, Drainage and Building Act 1974
3. Uniform Building By-Law 1984
4. Local Government Act, 1976
5. Electricity Supply Act
6. Sewerage Services Act 1993

6.2 Authority procedures:
1. Applicant submits application to secretariat of One Stop Centre. The One
Stop Centre (OSC) Secretariat should examine all documents submitted based
on the checklist prepared. If the application is incomplete, the OSC secretariat
will request the application to submit the necessary or addition
documents/plans.
The OSC Secretariat shall:
• Register the application
• Receive the receipt of processing fees
• Key in data for electronic submission, if applicable
• Issue letter receipt application to the applicant
2. OSC secretariat will distribute application to relevant departments. For
submission of building plans, the technical departments/ agencies that shall be
referred to are as below:
 Department of Fire and Rescue Services
 Water Supply Corporation
 Department of Sewerage Services
 Tenaga Nasional Berhad (TNB)
 Other related technical departments/agencies

3. Processing of building plan Application by the Department of Town Planning
Local Authority. For the building plan approval, the officer in the Building
Department shall undertake the following process and procedure:
 Receive application letter with complete documents from the One Stop

Centre Secretariat and open file
 Check fee payment
 Check Form A (Schedule II Uniform Building By Laws 1984)
 Check the building plan based on detailed checklist
 Receive comments from technical departments/ agencies and coordinate
comments with the agreed layout plan
 Prepare written directions to the applicant and ensures applicant comply
with conditions
 The director of Building Department shall table the recommendation
paper in the OSC Committee Meeting
4. Compilation and coordination of recommendation papers will be done.
The One Stop Center Secretariat will then:
 issue a letter of calling for meeting attached with meeting agenda to all
member of the OSC Committee
 and would then distribute the recommendation papers

 should a technical department/agency not able to provide comments
within the stipulated time without valid reason, the One Stop Centre
Committee shall proceed to consider the application and make decisions
For applications that had submitted the pre-computation plan at the early stage,
any differences noted between the pre-computation plan and the layout plan, the
OSC Secretariat will have to then inform the applicant to make the necessary

amendments.
5. One Stop Center will organics a committee meeting that shall undertake to
consider and make decisions on the applications on the applications for:
 planning permission
 building plans
 earthworks plans and road and drainage plans
The committee should also make recommendations for:
 pre-computation plan
 application for simultaneous sub-division and conversion under section
124A NLC in accordance with subparagraph 136 (1)(c)(i) NLC or
application for surrender and re-alienation section 204D NLC or
accordance with paragraph 204D(1)(d) NLC.

The decision of the planning permission in the OSC Committee Meeting

shall be issued through as well;
 Form C1, Schedule I Development Control (general) rules, 1986 –
Award Planning Permission to Applicant; and
 Form B, Schedule IV Development Control (general) rules, 1986 –
Notice to Person who Object the Planning Permission; or
 Form C2, Schedule I Development Control (general) rules, 1986 –
Reject to grant planning permission
These documents shall be signed by YDP or empowerment to the Director of
Planning Department Local Authority.
6. Preparation of notification of planning approval is sent to land
administrator. The OSC Secretariat shall prepare the necessary documents to
be submitted to the Land Administrator:
 Approved documents
 Form C1, Schedule I Development Control (General Rules), 1986 –
planning permission approval
 Letter of confirmation of approval

7. Prepare recommendation paper to the State Executive Council (EXCO). The
Land Administrator shall prepare a recommendation paper to the State Director
of Lands and Mines to be tabled at the meeting at the State Executive Council

for decision.
The State Director for Lands and Mines shall inform the State’s decision to the
Land Administrator and make a copy of the decision to the One Stop Centre
Secretariat.
8. The Land Administrator informs the applicant of the decision on the Land
Development Application
Under section 124A, the Land Administrator shall inform the applicant of the
following:
 The subdivision that has been approved
 For every subdivision, the category, conditions and expressed conditions
(if applicable) as directed by the State Authority
 Additional premium rate and quit rent for every subdivision as well as
other payments that need to be made
 The period for the payment of additional premium, quit rent and others
 Other conditions of approval as imposed by the State Authority.

At the same time, the Land Administrator need to present the notice in Form 7G
requesting the applicant to make the necessary payments within the stipulated

time as follows:
 Surveying fees if the survey is to be done by the Department of Land
Survey
 Payment for the preparation and registration of the Qualified Title for
every lot in the subdivision.
For section 204D, the Land Administrator shall inform the applicant of the
following:
 The terms of the approval for each unit that shall be re-alienated
 The additional premium and tax rate for each unit that shall be re-alienated
 Period of payment of the additional premium tax and other payments that
is charged
 The amount of premium in Form 5A in relation with each unit. The
survey charges shall not be included in Form 5A if the survey is to be
undertaken by a licensed surveyor and the Land Administrator has been
given the assurance by the Board of Surveyors.

9. Prepare decision paper for acknowledgement to the Full Council. The OSC
secretariat shall prepare decision paper of the One Stop Centre Committee to be
acknowledged at the Full Council Meeting of the Local Authority.
10. Inform the approval to the applicant. The ne Stop Centre secretariat shall:
 Collect the approved documents signed by the YDP or through
empowerment to the Director of Planning, Director of Building and

Director of Engineering.
 Inform the applicant the on the decision of the application enclosing the
approved layout plan, building plan and other related plans.
 The total time frame for the processing of simultaneous application is
suggested as 92 days (3 months and 2days).
 If the application falls within an area with the gazette local plan, the
normal time to process shall be 67days (2months and 7days)
