In 2012 New York launched one of the most ambitious education reform policy agendas in the country fueled by $700M in Race to the Top funding. New technology, online collaboration, and data driven instruction were at the center of one the largest NY RTTT projects. But within a year student data had shifted from being part of the solution to being part of the problem as public and political opposition grew across the state. The story of what happened in New York between 2012 and 2015 mirrored much of what unfolded across the U.S. raising the question of where we go from here with education reform, emerging technologies, and student data.

I. INTRODUCTION
Compliance with applicable laws and regulations has always been a
concern of business ventures. Historically, internal or external legal counsel
provided guidance, usually on a case by case basis. Over recent history,
compliance efforts have become more structured and formal as the number
and complexity of rules have increased, and as government has provided
rewards for demonstrating efforts to comply and punishment for failing to
demonstrate efforts to comply.1 As business entities and government have
interacted over the years, a complex system of compliance management has
evolved.
II. STRATEGIC CONSIDERATIONS
A. The Current Compliance Context
Today, compliance programs are commonplace. Many different
professions are involved, including a new class of “compliance
professionals” with their own certifying bodies.2 Compliance rules stretch
across many federal rule areas, witnessed by the fact that more than a dozen
agencies potentially have a say in how a U.S. financial institution operates
abroad.3 Compliance concerns no longer stop with legal compliance, and
now include industry protocols, licensing requirements, and an array of
standards and ethical concerns.

Additionally, foreign compliance regimes now span the global business
environment and do not necessarily match up with U.S. compliance rules as
reflected, for example, by the fact that common U.S. compliance hotlines
appear to conflict directly with EU and individual European nation data
protection rights.4 Parts of Europe are opposed to anonymous reporting.5
Growing international protocols regarding foreign bribery are expanding
compliance requirements for many companies.6
What began as voluntary efforts to mitigate corporate monetary
penalties in the event of certain federal criminal prosecutions, have evolved
into mandated or quasi-mandated compliance programs. Over time, these
compliance programs have become increasingly complex and expansive, and
the continuous layering of rule explanations has morphed into a maze of

In this paper, we look at available regulatory guidelines, current state and future considerations for use of social media in PV, possible areas of influence, expected challenges, potential solutions and next steps.

This is the first version of the paper that we will use to promote debate, reflection and progress around the systemic M&E initiative. The initiative’s main objective is to promote a rethink of how we measure our impacts on market systems and their evolution towards more inclusion, productivity and efficiency (i.e. how do we know that the markets systems we work with are actually going to continue reducing poverty and protecting the environment even after we have left the scene).
The paper is a live document and it is intended to evolve with the conversations that donors, academic researchers, and practitioners working in inclusive market development and finance/microfinance development. Most of these conversations will take place in MaFI, in USAID’s Microlinks (23-25 Oct, 2012) and the SEEP 2012 Annual Conference. 23. GAO Report on OPMs: ED
Response
• Response 2: The Department concurs with this
recommendation. We agree to reinforce for institutions of
higher education that the ban on incentive compensation
applies to all education programs that an institution offers and
all contracts that an institution enters. This will help the
institutions better understand what documentation must be
maintained and provided to auditors and program reviewers.
The Department will amend its procedures for program reviews
and propose changes to the Compliance Supplement. These
modifications will identify the types of information that
institutions must provide about contracts with third parties
during audits and program reviews to improve enforcement of
the ban on incentive compensation. The information identified
will address any third-party contracts that involve recruiting
activities, such as OPMs.
