1) While Ukraine has established principles and regulations for public consultations in policymaking, these processes are not functioning effectively in practice.
2) Central executive bodies and local governments have not properly implemented rules for consultation and public participation remains tokenistic rather than meaningful.
3) Institutional weaknesses, unclear responsibilities, lack of oversight, and passive civil society have prevented public consultations from realizing their democratic potential in Ukraine.

Vkhutemas
Russian state art and technical school founded in 1920 in Moscow. The workshops were established by a order from Vladimir Lenin with the intentions, in the words of the Soviet government, "to prepare master artists of the highest qualifications for industry, and builders and managers for professional-technical education. It was formed by merging the first and second Moscow Free Art Studios. It included an art department (painting, sculpture, and architecture) and an industrial department (printing, textile, ceramics, woodworking, and metalworking). Actually, Vkhutemas’ main function was to train stand painters and architects. At the same time, the industrial departments were given the task of training new kinds of artists, able to work with the traditional forms of plastic arts and to create the entire environment of objects surrounding men, including objects of everyday life and work tools. (Hamilton, G.H., 1993)
The architectural message can be transmitted through different channels. The visitor receives information through his/her visual, tactile, olfactory, or acoustical senses. The visual sense is known as the most influential one. If we consider architecture as a tool for communication, then, the importance of attracting visual senses comes out, and this attraction can be done by image. Since the past till now, the image in different terms and perceptions has tries to transferred this message. This was done with different tools, elements and materials. Using visual materials allows to better match the respondent`s perception to possible stimuli. Here, we want to look to the concept of image according to its material.
The proposal solution in order to deal with the complexity of contemporary life and on the other hand, prioritizing the satisfaction of the human who is looking for comfortable life is to put simplicity and complexity together in a same system of style and title it “SIMPLEXSITY”
In this theory the form is outcome of various physical, social, psychological and symbolic functions
For example if we want to design concert hall, the form will be the abstract of functional data which is defined by the distance of the seats the place of foyer the relation between all functions and also a symbolic appearance of the building. In this type of design the context of the building is not considered and we can put the designed project in different sites and places with no attention to the contextual matters. In this theory architects must act like a scientist. It means that they have to find some form in a body of pre existing facts. So it can be named as kind of true and false game. The designer will do its job according to client`s needs climatological conditions and community values. The difference is here that architects cannot define general lows for the design solution as like as the scientists do.

The Jordanian political system is based on the separation of powers
(Legislative, Executive, and Judiciary).The Jordanian parliament consist of
two houses, the house of senate (75 members appointed by the king), the
house of representatives (150 members elected by people).
The government is responsible to the lower house, The Legislative power has
the right to monitor the performance of executive power and hold it
accountable. Yet, the executive authority has the right to propose draft laws
and to issue provisional laws in certain cases.

The new project “Mapping decentralization reforms in Ukraine”, initiated by DESPRO with the financial support from the Swiss agency for development and cooperation (SDC), differs essentially from all the earlier projects. It envisages the analysis of reforms aimed at decentralization in Ukraine and finding out why, despite huge effort and resources invested into decentralization over the recent 20 years, Ukraine ended up in situation, which is characterized by strengthened centralization, while the very notion of decentralization has acquired most negative connotation due to the failure of the respective reforms.

Без підвищення тарифів на газ та електроенергію для населення Україна не здатна перебудувати газовий та енергетичний ринки, підвищити енергоефективність і зменшити шкідливий вплив енергетики на довкілля. Водночас підвищення тарифів потребує налагодження надійної системи захисту соціально вразливих категорій споживачів. Побудова цієї системи є частиною міжнародних зобов’язань України в рамках Енергетичного Співтовариства, а також Програми економічних реформ Президента.
Міжнародний центр перспективних досліджень у партнерстві з Київським міжнародним енергетичним клубом Q-club за фінансової підтримки уряду Швеції провели семінар з формулювання політики «Нові тарифи на газ та електроенергію: яким має бути соціальний план дій щодо вразливих груп споживачів?»
У семінарі взяли участь представники бізнесу, а саме компаній «Нафтогаз Україна», ДТЕК, «АЕС Київобленерго», представники урядових інституцій, зокрема Державного агентства з енергоефективності та енергозбереження України, Міністерства реґіонального розвитку та будівництва, Національної комісії, що здійснює державне регулювання у сфері енергетики, Київської міської державної адміністрації, а також експерти і споживачі.
Під час семінару експерти дійшли таких висновків:
• Реформи надходять «згори», що викликає спротив населення. Незалучення громадськості до процесу формування тарифної та соціальної політики – це серйозна проблема (Олександр Тодійчук, президент Київського міжнародного енергетичного клубу Q-Club).
• Обсяг витрат бюджету на субсидування споживання газу і теплової енергії домогосподарствами становить 6% ВВП. Це більше, аніж заг

Круглий стіл “Адміністрування ПДВ як чинник розвитку експортних галузей”
Мета круглого столу: представити результати дослідження “Адміністрування ПДВ на конкретних прикладах експортоорієнтованих підприємств в металургії, машинобудуванні та легкій промисловості», організувати змістовний публічний діалог влади, українських та іноземних інвесторів щодо варіантів державної політики адміністрування ПДВ на експорт та способів подолання наявних проблем. Результати обговорення будуть використані під час підготовки аналітичної записки щодо адміністрування ПДВ у металургії, машинобудуванні та легкій промисловості, яка буде представлена до органів державної влади в якості рекомендацій щодо адміністрування.
Обговорення передбачається провести навколо таких питань:
1. Якими є наслідки проблем з адмініструванням ПДВ для експортних галузей та економіки в цілому?
2. Які проблеми заважають вчасному відшкодуванню ПДВ?

5. Organization: Auxiliary support (2)
CEBs and local executive bodies (LEBs) now have advisory civic
councils attached to them that:
– coordinate effective interaction between executive bodies and the public;
– bring public opinion into play in the formation and execution of state
policy.
In practice, CEBs and LEBs have
begun to post draft legislation and
regulations on their official sites.
6. What does the government say? (1)
Presidential Decree №212 “On the Strategy of state policy to foster the
development of civil society in Ukraine” dated March 24, 2012, notes:
– “The work of CEBs and LEBs continues to be opaque, closed and
excessively bureaucratic rather than moving towards effective dialog
with civil society.”
– “The mechanisms for civil society to be engaged in the process of
formulating and executing state policy are not being properly used.”
– “Positive instances of effective cooperation between CEBs, LEBs and civil
society institutions are the exception rather than the rule.”
7. What does the government say? (2)
The President continues to emphasize the importance of engaging
civil society in the policy-making process.
During a meeting with student leaders
on November 14, 2012, the President
stated,
“When reforms directly affect voters,
it’s very important for voters to
understand why they are taking
place.”

8. How is it that, given all the attention
to democratic development on the
part of those in power, civil society in
Ukraine remains uninformed, unheard,
and unsatisfied?
9. The problems (1)
“Need to include civil society in the process” remains
more declarative than actual:
– In practice, CEBs and LEBs do not follow the
Cabinet Regulation or the Procedure for
holding consultations.
– As a rule, the consultation process comes
down to merely publishing draft legislation
and regulations.
– The democratic standards of public
participation are simply ignored.
10. The problems (2)
The institutional capacity of CEBs and LEBs
makes it difficult to hold high-quality
consultations:
– Sub-units of CEBs and LEBs responsible for
interacting with civil society lack the necessary
knowledge and skills.
– The staffing of such sub-units is frequently too
small.
11. The problems (3)
Neither the Law “On central executive bodies” nor the
standard provisions regarding ministries and CEBs
define the functions of these bodies with regard to
holding public consultations.
As a result, such functions are also
missing in the provisions on sub-
units attached to the
administrations of these bodies and
in actual job descriptions.
12. The problems (4)
Oversight, as a means of upholding legislation on engaging
civil society, is ignored.
Officials, whose powers include calling to task those
responsible for violations, follow the law at their own
discretion: if they feel like it, they respond; if they don’t
feel like it, they don’t. So public consultations depend
directly on their will and whims.
Such officials are not answerable to anybody for their
biased actions and thus go unpunished.
13. The problems (5)
The law does not specify responsibility and
penalties for such direct violations as failure to
follow the procedure for holding public
consultations.
14. The problems (6)c
The public consultation process is not properly regulated.
Provisions in individual laws only partly regulate this
institutions:
– The law only extends the requirement to hold public consultations to
the Cabinet of Ministers, CEBs, LEBs and local governments.
– There is no requirement whatsoever to hold public consultations when
legislation is being drafted by National Deputies of Ukraine as a
legislative initiative or in the Law “On the Regulation of the Verkhovna
Rada.”
– Nor is the President bound to hold consultations when drafting decrees
and other legal acts: Presidential Decree №970 dated November 15,
2006, allows this requirement to be applied selectively.
15. The problems (7)
Civil society institutions are:
– overly passive in exercising their rights and
defending their interests in the policy-
making process;
– not making use of existing levers of
influence on the government.
16. What steps might bring hope?
1. Civil society needs to pressure the government to move from declarative to real
actions in terms of public consultations.
2. The institutional capacity of government bodies to hold public consultations
needs to be improved.
3. A basic law needs to be adopted that will:
– set the minimal standards, mechanisms and procedures for public
participation based on the existing Procedure for public consultations;
– be binding on all government agencies, without exception, including the
President of Ukraine and VR Deputies.
– establish the specific violations for which specific officials will be held
accountable.
1. A system of independent state oversight needs to be set up that would
automatically penalize officials for inaction in terms of holding public
consultations.
17. Recommendations to civil society and
donors (1)
Demand that the Government provide a
transparent institutional chart of the executors and
a chart of state oversight for holding public
consultations.
Demand that the President and Government draft
and incorporate changes to the provisions on CEBs
and individual job descriptions to make it
mandatory to hold public consultations.
18. Recommendations to civil society and
donors (2)
Demand that the Verkhovna Rada adopt a basic law
that properly and fully regulates public consultations.
Demand that the Government hold responsible all
officials who fail to follow the procedure on holding
public consultations.
Broadly disseminate current legislative and regulatory
documents on public consultations and demand that
government bodies uphold them.
