This session introduces students to federal higher education issues and the impacts on students. Topics of focus include: DACA (Deferred Action for Childhood Arrivals), an overview of the Higher Education Act Reauthorization, and the federal government budget agreement. There will be a summary of work that LeadMN has done around each issue as well as a presentation of action steps for student involvement moving forward.

What is DACA?
• Deferred Action for Childhood Arrivals (DACA) was a program
established through an Executive Order under President Barack
Obama in 2012.
• Allowed undocumented youth who came to the US as children:
• temporary relief from deportation
• a two-year work permit
• Not a pathway to citizenship

Eligibility Requirements
• Under age 31 as of June 15, 2012
• Arrived in U.S. before 16th birthday
• Have continuously resided in the U.S. since 06/15/2007
• Physically present on 6/15/2012, entered w/o inspection before
6/15/2012 OR fell out of lawful status as of 06/15/2012
• Attending school at time of application (or have graduated, earned
GED, honorable military discharge)
• Not convicted of felony, significant misdemeanor or 3 or more
misdemeanors

Current Situation
• September 5, 2017 - Trump Administration rescinded DACA.
• 6-month grace period for Congress to develop a more permanent
solution with a March 5th, 2018 deadline.
• No permanent solution
• Federal court cases (CA, NY) have allowed for the current DACA recipients to
renew but no new applications
• These cases challenged that decision to end DACA was unlawful. Supreme
Court declined to hear. Cases are going through respective Circuit Court of
Appeals.
