The parliamentary elections in 2016 indicated that one of the most problematic issues was related to determination of which party was entitled to the supplemental funding of GEL 300,000 for creating a parliamentary faction. Due to lack of clarity, the CEC provided wrong interpretation of applicable regulations and as a result, Industry Will Save Georgia received GEL 300,000 while it failed to pass the electoral threshold of 3%, received only 0.78% of votes and was able to secure only a single majoritarian seat in parliament.1 In addition, even if such ambiguity didn’t exist we believe that the principle of providing funding to a party for creating a faction is inherently wrong. Creating a parliamentary faction should not be viewed as an additional accomplishment of a party, as this is automatically related to the party’s entry into Parliament and therefore, a party should not be receiving an additional funding for creating a faction. The funding has nothing to do with compensation of faction expenses as these expenses are already covered by the parliamentary budget.

Uttar Pradesh Assembly Elections, 2012
Executive Summary
Uttar Pradesh Election Watch (UPEW) has analyzed affidavits of all 403 MLAs of Uttar Pradesh
2012 Assembly Elections.
Out of these 403 MLAs analyzed for Uttar Pradesh 2012 Assembly Elections, 189 (47%) have
declared criminal cases against them. In 2007 assembly elections for the whole of Uttar
Pradesh, out of 403 MLAs analyzed, 140 (35%) MLAs had declared criminal cases against
themselves.
Out of these 189 (47%) MLAs with declared criminal cases against them, 98 MLAs (24%) have
declared serious criminal cases against them. In 2007 assembly elections, out of 140 (35%)
MLAs with declared criminal cases, 78 (19.35%) had declared serious criminal cases against
them.
The top 3 MLAs who have declared the maximum number of serious cases against themselves
are: 1) Mitra Sen (SP, Bikapur constituency) with 36 criminal cases including 14 cases related to
murder, 2) Sushil Singh (Independent, Sakaldiha) with 20 criminal cases including 12 charges
related to murder, 3) Ram Veer Singh (SP, Jasrana) with 18 criminal cases including 8 charges
related to murder.
Among other parties, the following MLAs have declared the maximum number of serious
criminal cases against them, 1) Mohd. Aleem khan (BSP, Bulandsahar) with 3 criminal cases
including 4 seious IPCs. These serious IPCs inculdes 1 charges related to murder and 1 charges
related to rape, 2) Ajay (INC, Pindra constituency) with 8 criminal cases including 3 charges
related to murder, 3) Upendra (BJP, Phephana) with 11 criminal cases including 5 charges
related to murder, 4) Mokhtar Ansari (Qaumi Ekta Dal, Mau Constituency) with 15 criminal
cases including 8 charges related to murder.
Out of all 403 MLAs analyzed from Uttar Pradesh 2012 Assembly Elections, 271 (67%) are
crorepatis. In 2007 Assembly Election for the whole of Uttar Pradesh , 124 (30.77%) MLAs were
crorepatis.
The MLAs with maximum assets in Uttar Pradesh is of Nawab Kazim Ali Khan of INC from Suar
constituency with assets worth Rs. 56.89 Crores followed by Shah Alam of BSP from
Mubarakpur with assets worth Rs. 54.44 Crores and Mahesh Kumar Sharma of BJP from Noida
constituency with assets worth Rs. 37.45 crores.
6 MLAs have declared assets of less than 5 lakhs.
A total of 22 (5.5%) MLAs out of 403 analyzed declared liabilities of Rs. 1 crore and above.

crore, For BJP is 4.01 crore and INC is 4.61 crore.
A total of 239 (59%) MLAs (out of 403 analyzed) are graduate or with higher educational
qualification in the Uttar Pradesh 2012 Assembly Election.
Only 40 (10%) MLAs (out of 403 analyzed) are 8th pass and below

A total of 6839 candidates contested in Uttar Pradesh 2012 Assembly Elections representing 223
parties. In 2007 Assembly Elections, 6086 candidates contested representing 131 parties. There was a
growth of 70% in the number of political parties and a growth of 12% in the number of candidates
contesting elections. Out of the 223 parties contesting in 2012 Assembly Elections, only 11 parties
managed to win seats along with 6 INDEPENDENT candidates, rest 212 Parties failed to secure even a
single seat.

UPEW has analysed affidavits of all 403 MLAs. 189 (47%) MLAs out of these 403 MLAs from Uttar
Pradesh Assembly, 2012 have declared criminal cases against them. Of these 189 MLAs, there are
declared serious criminal cases against 98 (24%)MLAs.

Serious crimes distribution for major parties-MLAs
There are several cases of violent crimes like murder, attempt to murder, theft, extortion, robbery etc
declared against MLAs in Uttar Pradesh 2012 Assembly Elections. The table below gives a summary of all
serious violent offences related to murder, kidnapping, extortion, theft, robbery and dacoity. As can be
seen from the table MLAs of SP has 172 serious IPC counts against them, while MLAs from BJP have 28
serious IPC counts each declared against them.
