Copyright
Copyright is the bundle of exclusive rights over an author's or creator’s work for a
limited but rather lengthy period of time. These rights enable the author to control the
economic use of his work in a number of ways and to receive payment.

Under sections 175 - 176
• ideas, procedures, system, method or operation, concept,
principle, and discovery;
• facts or information;
• names, titles, slogans, and other short phrases;
• news of the day;
• official text of a legislative, administrative or legal nature; and
• works of the government.

General Fair Use Principle
(section 185.1)
The use of a copyrighted work for criticism, comment, news
reporting, teaching including limited number of copies for
classroom use, scholarship, research, and similar purpose is not
an infringement of copyright.

• the purpose and character of the use
• the nature of the copyrighted work
• the amount and substantiality of the portion used in relation to
the copyrighted work as a whole
• the effect of the use upon the potential market for or value of

Limitation or Exception to Copyright Under the Concept of Fair use
(Section 184.1 A-L)
The Philippine copyright laws include a number of limitations and exceptions,
which limit the scope of copyright protection, and which allow either free use of works
under certain circumstances, or use without permission but against a payment.
Statutory fair use which are essential to SLM Writing
b. making of quotations from published works if they are compatible with the fair use
and only to the extent justified for the purpose, including quotations from news articles,
periodicals and press summaries
e. the inclusion of a work in a publication, broadcast or other communication to the
public, sound recordings or films, if such inclusion is by way of illustration for teaching
purposes and is compatible with fair use
i. reproduction or distribution of published articles in specialized format exclusive for
PWDs.

• in copyright, it is the expression of ideas and not the idea per se is being
protected
• even if permission is not needed under the fair use principle, honor the
creator’s right to attribution
• avoid having an inventory of images from the creative commons
• RO 3 has an inventory of literary materials
