All Rights Reserved#esignatureforgov The History of E-Signatures • UETA – Uniform Electronic Transaction Act – is one of several United States Uniform Acts proposed by the National Conference of Commissioners on Uniform State Laws (NCCUSL). 47 states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands have adopted the UETA. Its purpose is to harmonize state laws concerning retention of paper records and the validity of electronic signatures. • ESIGN Act – allows electronic signatures to have the same legality as a traditional ink signature. In fact, President Clinton used a digital signature to sign the act – 15 years ago.

Email Shared Q&A SSO / Pass Thru SMS Text KYC (SSN/DOB) KBA • Email – Proves a signer has access to a specific email address • Email w/Custom Questions – Proves a signer has access to a specific email address and also knows custom signer-specific information • What is your account number? (a. 123456) • Please enter your Transaction ID: (1234) • SMS Text Message – Sends a one-time password to a signer’s mobile device that a signer must enter to complete steps during a transaction. • Know Your Customer (KYC) – Performs an identity check to ensure the signer’s first/last name match the SSN and DOB for that party. – Signers must confirm their SSN and DOB after the transaction is approved and sent. • Knowledge Based Authentication (KBA) – By using the SSN/DOB, a signer must answer a set of random multiple choice questions based on 30 years of public data. – The highest form of remote authentication available.

Dependent E-Signatures • You should only use e-signatures that permanently embed the legal evidence into the document and audit trail-making them independent of the vendor. • The integrity of the document and each individual signature should be verified without ever leaving the signed document. • With dependent e-signatures, verifying the legality of an e-signature requires a link to the e-signature vendor’s website or server.
