Chapter 7 on memory
To understand the three processing phases of memory, consider that right now you are reading the information in this textbook. Presumably, you are trying to remember the information. In the encoding phase, your brain changes information—for example, what you see on the page when you are reading this text—into a meaningful neural code that it can use (Figure 7.2, Step 1). The storage phase is how you maintain the coded representation in a network of neurons in the brain. Storage can last a fraction of a second or as long as a lifetime. In retrieval, the third phase of memory, you re-access the information. INTRODUCTION
For this graded project, you’ll be presented with a parental
custody case, a list of relevant facts, and the testimonies of
two expert witnesses. You’ll need to research the law in your
own jurisdiction regarding factors used to determine cus-
tody. Then, you’ll write two memorandums, one for each of
the opposing sides, applying the law you found to the facts
of the case.

You should know the following information about the case.
The Participants
Sally Bright asked her husband, John, to move out tem-
porarily due to marital difficulties. After a brief separation,
Sally filed for divorce and received temporary custody of
their 14-year-old daughter, Chastity. John’s response to

Although some critics have proposed curtailing or
eliminating oral argument in certain cases,
both judges and lawyers believe
it plays a vital role in the appellate
process, a recent survey shows.

portant elements of deciding cases
on appeal is oral argument, an ele-
ment of advocacy older than writ-
lJ ten briefs in this country. Briefs originally were
not required in appeals, and oral argument
J1 continued without time limits even when
briefs were submitted. Eventually briefs did
begin to displace argument: the Supreme Court
first waived oral argument when written argu-
ments were submitted, then mandated briefs
prior to argument, and finally both reserved
argument for the most important cases and
reduced the time granted each party.t
Curtailment of oral argument in other appel-
late courts, partly the result of caseload pres-
sure, has attracted continued attention. Var-
ious sources have warned that eliminating oral
argument in all cases would harm the appel-
late process. 2 Most recently, the Devitt Com-
mittee (the Committee to Consider Standards
for Admission to Practice in the Federal Courts
of the Judicial Conference of the United States)
brought further attention to legal advocacy at
both trial and appellate levels. The "substan-
tially divided" committee, however, made no
recommendations concerning appellate advo-
cacy because it found "the problems presented
... not sufficiently serious to call for the recom-
mending of remedies" 3-at least by compari-
son with trial advocacy, to which the commit-
tee devoted the bulk of its attention. Despite the
Devitt Committee's view, appellate advocacy
remains of considerable importance.

Over the decades, law enforcement leaders have been under
increasing pressure to answer the question, “What do I do
with a law enforcement employee who has been proven to
be untruthful in the workplace?”
Many departments have been confronted with significant and farreaching
court decisions that play prominent roles in this decisionmaking
process, as well as vigorous debates and lengthy court
battles with labor organizations around the issue of truthfulness
expectations in policy and disciplinary actions.
The U.S. Department of Justice has issued far-reaching
instructions on the conduct of federal law enforcement cases that
may involve local and state police employees who have histories
of being untruthful in the workplace. There have been articles
published in Police Chief magazine and other publications discussing
this issue. In light of these critical and evolving issues,
a recent decision from the Tennessee Court of Appeals analyzing
the procedures and practices of the Metropolitan Nashville
Police Department (MNPD), in Davidson County, Tennessee, can
be instructive.

In 1994, three teenage males were convicted for the crimes of murder in West Memphis, Arkansas. Jessie MisKelley Jr, Damien Echols, and Jason Baldwin were tried and convicted for the murder of three 8 year-old boys: Steven Branch, Michael Moore, and Christopher Byers. Jessie and Jason received life sentences while Damien, the suspected ring-leader, was sentenced to death.
In August of 2011, all three men made an Alford Plea and were released from jail as time served. An Alford plea is better known as the “I’m guilty but I didn’t do it” defense.
Under the Alford plea, the defendant admits that sufficient evidence exists with which the prosecution could likely convince a judge or jury to find the defendant guilty beyond a reasonable doubt. However, the defendant(s) cannot be charged with these crimes again (Double Jeopardy Law). All three are currently free men and trying to integrate back into society.
In 2013, we are still in search of answers as to what happened to the three 8 year-old boys and who is responsible for their death. Under the Alford plea, Damien, Jason, and Jessie are considered guilty of these crimes. Under our laws, they are considered ex-cons. The state of Arkansas has declared the murders of the three boys a cold case despite questions that have been raised regarding the possible involvement of two of the stepfathers, John Mark Byers and Terry Hobbs.
There are many speculations as to what might have happened if the three men would have chosen to wait for a re-trial.
For this paper, present an argument as to what you believe would have been the outcome of such a case. Would the three been found guilty or not guilty?
Additionally, this argument will be focused on a specific element of the case.
You may choose one of the following: police error/law enforcement mistakes (including false confession), Satanic Panic, or Media Involvement in case.
Whichever element you choose to write about will be the sole argument for the paper.

Learning Team C believes that Stu Dents, the defendant is competent enough to stand trial because we believe that he is responsible for the murder of Uma Opee. The defendant has been keeping a journal all along until the day before the murder and it is believed that he kept the journal because he knew he would kill Opee at some time. When the time came for trial, he can use an insanity plea, and since there is not enough evidence against him then he might win the case (Caplan, 2009). The only thing he did was hit an officer in the face and called him an alien and claimed he was God.
Under the state of California, there is no clear distinction between temporary and permanent insanity and the prime issue in the state of California is the condition or status of the defendant at the time of the crime. The process of determining insanity in the state of California is the Pronged M'Naghten rule. Under this rule, two conditions must be met to prove sanity of the defendant.
These conditions are:
1. The requirement that the defendant understands the nature and quality of his or her act.
2. The need for the defendant to different between what is right and wrong.
Any defendant who claims to have committed any crime and cannot meet the two-pronged above is declared to be statutorily insane.
There were some changes in the state of the California concerning the testing of the insanity defense. The amendment passed in the year 1994, which is called Model Penal Code prohibits the California court from determining insanity by personality, adjustment disorder, addition, seizure disorder or abuse of drugs and substances. The amendment states that the person under the influence of any of the above-listed condition is not morally upright and thus it will cause confusion in differentiating between insanity or influence from any of the above conditions (Rogers, 2010). Any defendant who is found insane at the time of crime may be declared not guilty because of insanity and in other cases the defendant might be found guilty. The judgment will be less severe because of the mental impairment which influenced his or her actions at the time of the crime.

INTRODUCTION
For this graded project, you’ll be presented with a parental
custody case, a list of relevant facts, and the testimonies of
two expert witnesses. You’ll need to research the law in your
own jurisdiction regarding factors used to determine cus-
tody. Then, you’ll write two memorandums, one for each of
the opposing sides, applying the law you found to the facts
of the case.
THE CASE
You should know the following information about the case.
The Participants
Sally Bright asked her husband, John, to move out tem-
porarily due to marital difficulties. After a brief separation,
Sally filed for divorce and received temporary custody of
their 14-year-old daughter, Chastity. John’s response to
Sally’s divorce petition requested custody and the court
ordered that the child have visitation with John every
weekend.
Nine months later, the court conducted a final hearing in the

Although some critics have proposed curtailing or
eliminating oral argument in certain cases,
both judges and lawyers believe
it plays a vital role in the appellate
process, a recent survey shows.

~ne of the most traditional and im-
portant elements of deciding cases
on appeal is oral argument, an ele-
ment of advocacy older than writ-
lJ ten briefs in this country. Briefs originally were
not required in appeals, and oral argument
J1 continued without time limits even when
briefs were submitted. Eventually briefs did
begin to displace argument: the Supreme Court
first waived oral argument when written argu-
ments were submitted, then mandated briefs
prior to argument, and finally both reserved
argument for the most important cases and
reduced the time granted each party.t
Curtailment of oral argument in other appel-
late courts, partly the result of caseload pres-
sure, has attracted continued attention. Var-
ious sources have warned that eliminating oral
argument in all cases would harm the appel-
late process. 2 Most recently, the Devitt Com-
mittee (the Committee to Consider Standards
for Admission to Practice in the Federal Courts
of the Judicial Conference of the United States)
brought further attention to legal advocacy at
both trial and appellate levels. The "substan-
tially divided" committee, however, made no
recommendations concerning appellate advo-
cacy because it found "the problems presented
... not sufficiently serious to call for the recom-
mending of remedies" 3-at least by compari-
son with trial advocacy, to which the commit-
tee devoted the bulk of its attention. Despite the
Devitt Committee's view, appellate advocacy
remains of considerable importance.

How would your team argue during the appeal that the defendant's constitutional rights were violated?
What evidence would be required for your defendant to be considered mentally retarded under
Atkins v. Virginia

What evidence would be required for your defendant to be considered insane under
Ford v. Wainwright (1986)
? Assess whether or not that evidence can be presented in this case.
Do you believe that bringing up the defendant's diagnosis of autism could have aided in the defense in the sentencing phase? Would the contention that he was mentally slow have helped? Provide rationale for your answers.
Identify other aspects of the case not mentioned in the scenario that could benefit the defendant. For instance, consider whether the Supreme Court has found it unconstitutional to apply the death penalty in other circumstances.

Over the decades, law enforcement leaders have been under
increasing pressure to answer the question, “What do I do
with a law enforcement employee who has been proven to
be untruthful in the workplace?”
Many departments have been confronted with significant and farreaching
court decisions that play prominent roles in this decisionmaking
process, as well as vigorous debates and lengthy court
battles with labor organizations around the issue of truthfulness
expectations in policy and disciplinary actions.
The U.S. Department of Justice has issued far-reaching
instructions on the conduct of federal law enforcement cases that
may involve local and state police employees who have histories
of being untruthful in the workplace. There have been articles
published in Police Chief magazine and other publications discussing
this issue. In light of these critical and evolving issues,
a recent decision from the Tennessee Court of Appeals analyzing
the procedures and practices of the Metropolitan Nashville
Police Department (MNPD), in Davidson County, Tennessee, can
be instructive.
Editor’s Note: When this article was originally written, Ronal Serpas
was the chief of police for Metropolitan Nashville, Tennessee.

In 1994, three teenage males were convicted for the crimes of murder in West Memphis, Arkansas. Jessie MisKelley Jr, Damien Echols, and Jason Baldwin were tried and convicted for the murder of three 8 year-old boys: Steven Branch, Michael Moore, and Christopher Byers. Jessie and Jason received life sentences while Damien, the suspected ring-leader, was sentenced to death.
In August of 2011, all three men made an Alford Plea and were released from jail as time served. An Alford plea is better known as the “I’m guilty but I didn’t do it” defense.
Under the Alford plea, the defendant admits that sufficient evidence exists with which the prosecution could likely convince a judge or jury to find the defendant guilty beyond a reasonable doubt. However, the defendant(s) cannot be charged with these crimes again (Double Jeopardy Law). All three are currently free men and trying to integrate back into society.
In 2013, we are still in search of answers as to what happened to the three 8 year-old boys and who is responsible for their death. Under the Alford plea, Damien, Jason, and Jessie are considered guilty of these crimes. Under our laws, they are considered ex-cons. The state of Arkansas has declared the murders of the three boys a cold case despite questions that have been raised regarding the possible involvement of two of the stepfathers, John Mark Byers and Terry Hobbs.
There are many speculations as to what might have happened if the three men would have chosen to wait for a re-trial.
For this paper, present an argument as to what you believe would have been the outcome of such a case. Would the three been found guilty or not guilty?
Additionally, this argument will be focused on a specific element of the case.
You may choose one of the following: police error/law enforcement mistakes (including false confession), Satanic Panic, or Media Involvement in case.
Whichever element you choose to write about will be the sole argument for the paper.
After reviewing all of the court testimonies, documents, evidence, and extra accounts that the real jury did not have access to, you will make a decision and support it with evidence as to the guilt or wrongful conviction of these three young men.
There are a lot of evidence, statements, etc to dig through for this case. However, as a jury member it is imperative that you look at all that is available to you in order to make a sound judgment. The job of a jury member is to: sort through conflicting claims; weigh all evidence as objectively as possible, without personal biases; and uncover the assumptions behind the messages you are hearing.

Learning Team C believes that Stu Dents, the defendant is competent enough to stand trial because we believe that he is responsible for the murder of Uma Opee. The primary goal for the team is to prove he was aware that his actions were wrong from the beginning, both morally and illegally and also understood the consequences that accompany such an act of violence. Learning Team C does not believe that voluntary use of drugs has an effect on the condition of the mind of Stu Dents and there is not enough evidence to prove whether the defendant had used any drugs on the night in which the murder took place.
The defendant has been keeping a journal all along until the day before the murder and it is believed that he kept the journal because he knew he would kill Opee at some time. When the time came for trial, he can use an insanity plea, and since there is not enough evidence against him then he might win the case (Caplan, 2009). The only thing he did was hit an officer in the face and called him an alien and claimed he was God.
Under the state of California, there is no clear distinction between temporary and permanent insanity and the prime issue in the state of California is the condition or status of the defendant at the time of the crime. The process of determining insanity in the state of California is the Pronged M'Naghten rule. Under this rule, two conditions must be met to prove sanity of the defendant.
These conditions are:
1. The requirement that the defendant understands the nature and quality of his or her act.
2. The need for the defendant to different between what is right and wrong.
Any defendant who claims to have committed any crime and cannot meet the two-pronged above is declared to be statutorily insane.
There were some changes in the state of the California concerning the testing of the insanity defense. The amendment passed in the year 1994, which is called Model Penal Code prohibits the California court from determining insanity by personality, adjustment disorder, addition, seizure disorder or abuse of drugs and substances. The amendment states that the person under the influence of any of the above-listed condition is not morally upright and thus it will cause confusion in differentiating between insanity or influence from any of the above conditions (Rogers, 2010). Any defendant who is found insane at the time of crime may be declared not guilty because of insanity and in other cases the defendant might be found guilty. The judgment will be less severe because of the mental impairment which influenced his or her actions at the time of the crime.
Various steps ought to be taken so as to prove insanity of the defendant in the criminal law.

Scenario:
You are the Refinery Emergency Response Coordinator for an incident at the SJV Refinery which has been in operation since 1966. The refinery processes 120,000 bbls of crude oil per day, which has a sulfur content of 2.5 percent. The refinery converts crude oil to naptha, light oil, and heavy oils using the Atmospheric/Vacuum Distillation Unit with key equipment such as the following:

naptha, kerosene, gasoline, and diesel hydrotreaters;
·
·
isomerization unit;
·
·
naptha reformer;
·
·
fluid catalytic cracker;
·
·
coker;
·
·
hydrocracker;
·
·
polymerization unit (petrochemical section of the refinery polymerizing olefin gases to produce polyethylene);
·
·
sulfur recovery Claus plant (catalytic reactors); and
·
·
distillate/gasoline blending tanks.
The refinery was initiating work on a major plant turnaround at the time of the incident to complete required maintenance repairs, mechanical integrity inspections, and modifications to existing equipment. Twenty contractor companies (approximately 150 employees) have been contracted to perform this work under the direction of refinery staff. All of the contractor workers completed the refinery orientation training.
Work for the contractor crews is assigned/scheduled each morning. On the day of the incident, the day-shift (6 am to 6 pm) crew had been tasked with isolating the acid gas feed stream for the Claus unit. Due to other work priorities, the crew did not isolate the line as planned. A shift turnover for the night contractor crew did not happen due to mandatory safety training that delayed their arrival at the worksite. Upon their arrival at the work site, the night crew held a job safety analysis (JSA) review of the scheduled task (line breaking of the acid gas feed line to replace a segment) to be performed and the hazards present. No pressure gauges or monitoring was present to indicate that the acid gas feed line was operational. The crew initiated the line breaking activity (open the line to the atmosphere) at approximately 7:45 pm under self-contained breathing apparatus (SCBA), which almost immediately resulted in the uncontrolled release of acid gas. A nearby ignition source from a welding operation ignited the flammable gas. The following actions were initially taken:

Specific types of CDHPs are health reimbursement accounts (HRA), flexible spending accounts (FSA), and health savings accounts (HSA).
However, there are concerns about CDHPs. The consumer may neither understand nor have the education and the tools to manage his or her own healthcare appropriately. This may have long-term ramifications on the whole healthcare system and whether CDHPs can be successful for the consumer, the employer, the physician, and the healthcare facilities, as well as the insurers. Answer the following questions in regard to this development:
Are CDHPs more geared toward the healthier and younger population?
Are they effective for patients with chronic illnesses?

A Strategic Approach: GenAI in Education
Artificial Intelligence (AI) technologies such as Generative AI, Image Generators and Large Language Models have had a dramatic impact on teaching, learning and assessment over the past 18 months. The most immediate threat AI posed was to Academic Integrity with Higher Education Institutes (HEIs) focusing their efforts on combating the use of GenAI in assessment. Guidelines were developed for staff and students, policies put in place too. Innovative educators have forged paths in the use of Generative AI for teaching, learning and assessments leading to pockets of transformation springing up across HEIs, often with little or no top-down guidance, support or direction.
This Gasta posits a strategic approach to integrating AI into HEIs to prepare staff, students and the curriculum for an evolving world and workplace. We will highlight the advantages of working with these technologies beyond the realm of teaching, learning and assessment by considering prompt engineering skills, industry impact, curriculum changes, and the need for staff upskilling. In contrast, not engaging strategically with Generative AI poses risks, including falling behind peers, missed opportunities and failing to ensure our graduates remain employable. The rapid evolution of AI technologies necessitates a proactive and strategic approach if we are to remain relevant.
