L'obiettivo del documento Mobile è quello di evidenziare rischi, adempimenti formali e misure di protezione da tenere in considerazione nel trattamento di dati personali mediante dispositivi Mobile (ad esempio tablet e smartphone). Il documento indirizza i rischi e gli aspetti legali, procedurali, organizzativi e tecnologici che una società titolare di trattamenti di dati personali in ambito italiano, deve prendere in considerazione affinchè tali trattamenti siano svolti nella conformità alla normativa applicabile e garantendo un opportuno livello di sicurezza.
L'analisi del gruppo di lavoro, non limitata alle misure minime ma estesa a quelle idonee, ha permesso di determinare alcune osservazioni qui espresse in maniera sintetica:
# l'introduzione dei dispositivi mobili evoluti deve essere effettuata a fronte di un'attenta e strutturata analisi dei rischi, che tenga conto delle specifiche aree critiche nell'ambito dei trattamenti di dati personali effettuati, indirizzando, di conseguenza, le misure di sicurezza e di compliance normativa correlate;
# tali aree critiche sono principalmente correlabili ad aspetti di natura tecnologica, ma anche elementi quali comportamenti non idonei da parte delle persone, mancato rispetto degli adempimenti formali nel loro utilizzo, rappresentando degli elementi che devono essere tenuti in considerazione;
# un elemento di criticità è relativo alla mancanza di conformità in merito agli adempimenti della Privacy (informative, consensi, notificazioni…). Nonostante siano infatti state adottate opportune misure di protezione dei dati, è possibile che i trattamenti effettuati con tali strumenti non siano corretti rispetto al Codice Privacy e/o ai provvedimenti dell'Autorità Garante per la Privacy;
# allo stesso tempo è necessario che siano adottate soluzioni che soddisfino almeno le cosiddette misure minime, contenute nel disciplinare tecnico (Allegato B del Codice Privacy) e quelle obbligatorie (correlate ai provvedimenti dell'Autorità Garante). Le misure minime specificate dall'attuale normativa, sono state però definite per un contesto tecnologico generale e devono essere traguardate al contesto mobile;
# un'indicazione analoga riguarda anche specifici provvedimenti, quali quello degli amministratori di sistema (provv.Garante Privacy del 27.11.2008) e o della dismissione Raee (provv.Garante Privacy del 13.10.2008);
# infine, relativamente alle cosiddette misure idonee di sicurezza, si evidenzia che esse dovrebbero derivare da un'analisi di sicurezza correlata allo specifico ambito operativo. Tuttavia il gruppo di lavoro ritiene che alcune misure possano essere adottate, allo stato attuale, necessariamente / obbligatoriamente ai fini di una corretta protezione dei dati personali trattati.
