#31c3 net neutrality: days of future past

Talk at 31st Chaos Communication Congress at Hamburg 2014. see: https://events.ccc.de/congress/2014/Fahrplan/events/6170.html Our talk will highlight the current debates surrounding net neutrality in Europe, the United States and other parts of the world. We will look at the results of the SaveTheInternet.eu campaign which was lunched a year ago on 30c3. We will discuss various legal protections for net neutrality, look closer at the experience of the Netherlands and we will give an overview of all important open ends of the debate. Since two years net neutrality is on the agenda of politicians world wide. These are important debates, as net neutrality became one of the central questions about our freedom on the internet. With different faces around the globe we see a trend towards more violations of the neutrality principle which the internet was founded upon. The efforts of telecommunication companies to find new ways to monetize their networks and us users within them are countered in some countries with legislation preventing this new business models. In 2010, after two years of preparation and a fierce battle, the Dutch parliament accepted a change to the Telecommunications Act which made net neutrality a principle that was protected by law. In this talk we will take stock after two years of legal protection of net neutrality in The Netherlands. Did it work and do the Dutch now have undiscriminated access to all services on the internet? Has the doomsday scenario of the providers, that subscriptions would become outrageously expensive, become reality? In which cases was the Dutch law enforced? Are there any loopholes in the Dutch implementation? If others are to fight for net neutrality, what are the pitfalls to avoid? And, on a more meta-level, is it enough? Will net neutrality protect your freedom to access websites and services, or do we need a broader type neutrality?

A free and open internet is one where innovation can happen without the permission of a telecom company. The three biggest mobile operators in Portugal with a combined market share of 95% all violate this principle of net neutrality and thereby create a walled garden that kills off economic growth. The internet was far more successful than any previous communication network, because it allowed innovators to compete globally from day one and gave users the freedom to choose between the best products. These benefits are lost if telecom companies are allowed to pick winners and losers and undermine our freedom to choose and offer the services we want. The European Union established protections for net neutrality in 2016. If these rules would be properly enforced in Portugal, companies would not suffer a competitive disadvantage against Silicon Valley giants or applications owned by telecom companies. It is time to ask the tough questions to politicians and regulators why our freedoms online are not protected. This talk will give an overview about the situation in Europe and locate Portugal and its telecom market within it.

So intensiv wie 2017 wurde der Themenkomplex rund um Sicherheit und Überwachung in Österreich noch nie diskutiert. Das Thema ist in Hauptabendnachrichten und Leitartikeln angekommen. Die Diskussion rund um die geplante Einführung eines Sicherheitspakets, das sich bei näherer Betrachtung als ein reines Überwachungspaket entpuppt, bietet jede Menge Analysematerial: Öffentlich ausgetauschte (Schein-)Argumente, falsche Analogien und unpassende Sprachbilder haben die Debatte geprägt. In diesem Talk werden die Sprache der so genannten Sicherheitspolitiker (es sind in der Tat nur Männer) analysiert und ihre Argumente auf den Prüfstand gestellt.
Drei Sätze des österreichischen Innenministers Wolfgang Sobotka stehen exemplarisch für die Qualität der Sicherheitsdiskussion in Österreich. Zu Beginn des Jahres 2017 rechtfertigte er seine Pläne für die Ausweitung der Videoüberwachung mit folgendem Argument: "Ein Beispiel: Vor meiner Haustüre lag – vor vielen Jahren – immer wieder menschlicher Kot. Als ich eine Kamera aufgestellt habe, war das sofort vorbei." Mitte des Jahres sagte er in einem Interview: "Die Sicherheit steht über der Politik". Und als sein Überwachungspaket zu scheitern drohte, griff er in die unterste Schublade und holte diesen Satz hervor: „Alle innerhalb und außerhalb des Parlaments, die gegen diese gesetzlichen Anpassungen sind, planen einen Anschlag auf die Sicherheit der Österreicher.“ Zwischen diesen argumentativen Großtaten gab es noch jede Menge anderer Misstöne, die entkräftet, entschärft und gerade gerückt werden müssen, um die Diskussion auf eine tragfähige Basis zu stellen.

Im vergangenen Jahr hat sich viel im Thema Netzneutralität verändert. Die neuen EU Regeln werden inzwischen in Europa angewendet wobei das Pflichtbewusstsein von Regulierungsbehörden sehr abhängt von der Stärke der lokalen Telekomfirmen. Währenddessen versucht die Trump Regierung die Netzneutraltätsregeln der FCC aus 2015 zurück zu nehmen und stößt dabei auf massiven Widerstand von breiten Teilen der Gesellschaft. Das wirft die Frage auf wie stabil die europäischen Regeln sind und ob sich mit neuen technischen Standards wie 5G etwas darn ändern wird.

After three years the EU has for the first time new Net Neutrality rules. What do they mean in practice? Which commercial practices by ISPs are allowed and which have to be punished by the telecom regulator. We give an overview about three years of campaign and where we go from here.
As part of the Savetheinternet.eu coalition, we fought hard over three years in all stages of the legislative and regulatory process to make the new Net Neutrality protections as strong as possible. We explain our tactics and goals for this campaign of 32 NGOs from 14 countries that managed to submit half a million comments to the European Regulators, BEREC.
This talk focusess on the pracitcal implications of the new rules and which types of potential network discrimination are prohibited, disputed or allowed. We explain how enforcement is working in different countries and what you can do to put these new rules into practice and extinguish Net Neutrality violations by your ISP.
A core component in this fight is the platform RespectMyNet.eu. Users can submit Net Neutrality violations on this website and thereby give them visibility and allow others to confirm, discuss and act upon them. As BEREC guidelines will be regurlaly reviewed this tool is of utmost importance to track the implementation of Net Neutrality rules as well as commercial practices by ISPs and mobile operators.
RespectMyNet lived different lives, one of our current tasks is to make the tool and the submissions fit the new BEREC Guidelines in order to provide an easy to use and efficient tool for net neutrality activists in Europe.

#33c3: Netzpolitik in Österreich Ein Jahresrückblick aus dem Land der Datenberge

Die Netzpolitik der österreichischen Bundesregierung hat sich im Jahr 2016 nicht besser dargestellt als die Jahre davor: Neue Überwachungsgesetze, (bislang erfolgreich verhinderte) Versuche eine staatliche Spionagesoftware (Bundestrojaner) einzuführen, der ewige Kampf um ein Transparenzgesetz, eine scheinheilige Simulation demokratischer Partizipation und das totglaubte E-Voting sind brennende Themen und bedürfen einer breiten gesellschaftlichen Diskussion. Der AKVorrat zeigt in einem netzpolitischen Jahresrückblick, was wir dagegen tun können und zeigt, dass Zivilgesellschaft wirkt.
Polizeiliches Staatsschutzgesetz beschlossen, Gesetzesvorlage für die Legalisierung einer Überwachungssoftware (Bundestrojaner) eingebracht, weitreichende Überwachungsmaßnahmen neuerdings schon bei Verwaltungsübertretungen möglich etc. – die Liste der datenschutzrechtlichen und netzpolitischen Problemfälle in Österreich ist lang. Das Arbeitspensum für Aktivistinnen und Aktivisten in Österreich steigt.
Auch für zivilgesellschaftliche Initiativen gilt, dass Politik das Bohren harter Bretter bedeutet. Mit einer wohldosierten Mischung aus juristischer und technischer Expertise sowie Aktionismus konnten 2016 ein paar sehr tiefe Löcher in die offizielle unausgewogene Netzpolitik Österreichs gebohrt werden.
Herzstück der Aktivitäten des abgelaufenen Jahres war HEAT, das Handbuch zur Evaluation der Anti-Terror-Gesetze in Österreich.
Das Ausmaß der staatlichen Eingriffe in unsere Privatsphäre und in die informationelle Selbstbestimmung lässt sich nur durch die Betrachtung der Summe aller Eingriffe richtig erfassen. Diese wichtige Erkenntnis der Notwendigkeit einer „Überwachungs-Gesamtrechnung“ wurde erstmals vom deutschen Bundesverfassungsgericht im Urteil zur Aufhebung der deutschen Vorratsdatenspeicherung im März 2010 formuliert. HEAT listet alle Überwachungsgesetze Österreichs auf, kombiniert dies mit einer Aufarbeitung der relevanten Judikatur, einer Erhebung der für Sicherheitsbehörden verfügbaren sowie der tatsächlich eingesetzten Technologien und schließlich einer ersten groben Technikfolgenabschätzung. In den Schlussfolgerungen wird daraus ein Kriterienkatalog für eine Evaluation aller Anti-Terror-Gesetze abgeleitet. Dieses „Pflichtenheft“ soll staatlichen und zivilen Organisationen helfen, überschießende und damit potentiell verfassungswidrige Überwachungsbefugnisse zu identifizieren. Mit HEAT liegt erstmals eine Anleitung vor, wie bestehende und zukünftige Gesetze mit allgemein anerkannten Grundrechten in Einklang gebracht werden können. Diese ist allgemein anwendbar und nicht nur für Österreich.
HEAT ist auch die Grundlage für eine sogenannte Drittelbeschwerde, die von einem Drittel der Abgeordneten zum österreichischen Nationalrat gegen das Polizeiliche Staatsschutzgesetz beim Österreichischen Verfassungsgerichtshof eingebracht wurde.

32c3: AKVorrat Österreich – Der Kampf gegen unkontrollierte Massenüberwachung
„Geheimdienste kontrolliert man am besten, indem man ihre Gründung verhindert“
Im April 2015 hat die österreichische Bundesregierung einen Entwurf für ein "Polizeiliches Staatsschutzgesetz" vorgelegt. Damit soll ein neuer Inlandsgeheimdienst mit weitreichenden Überwachungsbefugnissen geschaffen werden. Unabhängige Kontrolle durch Gerichte und das Parlament ist nicht vorgesehen. Bereits in der Begutachtungsphase wurde das Gesetz massiv kritisiert. Der AKVorrat gab mit einer umfassenden Stellungnahme die wichtigsten Argumente vor. Der Widerstand gegen das Gesetz und die Kampagne des AKVorrat haben zwar zu mehrfacher Verschiebung der Beschlussfassung geführt, aber die Geheimdienstpläne der Regierung sind trotz mehr als 22.000 Unterzeichnerinnen und Unterzeichnern der Petition auf www.staatsschutz.at nach wie vor nicht vom Tisch. Der Talk bietet Einblicke, wie Geheimdienste in der Post-Snowden-Ära öffentlich und nicht öffentlich diskutiert werden.
Wir zeigen die Geschichte von Österreich als Drehscheibe von internationalen Geheimdienstaktivitäten. Die aktuellen Pläne der Regierung zur Schaffung eines Inlandsgeheimdienstes sind in diesem Kontext zu sehen. Der aktuelle Gesetzesvorschlag stattet Polizeibehörden mit Geheimdienstbefugnissen aus, die einer unabhängigen Kontrolle weitestgehend entzogen sind. In unserer Analyse stellen wir unsere Kritikpunkte in einen größeren Kontext, der der Idee einer Überwachungsgesamtrechnung folgt.
Wir stellen unsere Kampagne vor, die auf zwei Säulen steht: Aktivismus und politisches Lobbying. Der Spagat zwischen beiden Polen ist nicht immer einfach, aber unbedingt nötig, um die Breite des Widerstandes gegen das Gesetz darzustellen. Der reicht von der Bischofskonferenz, über Amnesty International bis zu Arbeitnehmervertretungen. Die juristische Expertise des AKVorrat macht uns auch zu ernstzunehmenden Gesprächspartnern von Politikerinnen und Politikern.

In einem Paukenschlag hat die amerikanische Regulierungsbehörde FCC dieses Jahr einen starken Schutz der Netzneutralität in den USA beschlossen. In Kanada, den Niederlanden, Indien und Slovenien geraten Verletzungen der Netzneutralität zusehends unter Beschuss. In all diesen Fällen hat sich die Zivilgesellschaft gegen die Interessen der Industrie durchgesetzt. Vor diesem Hintergrund beginnt in Europa die finale Verhandlungsrunde über den EU-weiten Schutz der Netzneutralität und entgegen dem globalen Trend ist man in Europa versucht Netzneutralität endgültig abzuschaffen.

Dank der Beteiligung von tausenden Bürgern auf der SaveTheInternet.eu Kampagne hat das Europa Parlament am 3. April 2014 für einen starken Schutz der Netzneutralität gestimmt. Die EU-Mitgliedsstaaten haben inzwischen aber einen extrem industriefreundlichen Vorschlag vorgelegt, welcher alle Formen von Verletzungen der Netzneutralität und Netzsperren legalisiert. Der zuständige Kommissar Günther Oettinger argumentiert komplett jenseits aller Fakten und setzt die netzneutralitätsfeindliche Politik seiner Vorgängerin Neelie Kroes fort.
Dieser Vortrag gibt einen Einblick hinter die Kulissen der Verhandlungen zwischen den drei EU-Institutionen über das finale Gesetz zur Netzneutralität in Europa und vergleicht die Entwicklung mit dem globalen Trend.

Nach der erfolgreichen Abschaffung der Vorratsdatenspeicherung in Europa und Österreich hat der AKVorrat sich dazu entschlossen in die Offensive zu gehen. Seit letztem Dezember arbeiten wir daran die Idee einer Überwachungsstaat-Gesamtrechnung Umzusetzen. SCHROEDINGER’S NET NEUTRALITY
The fight for net neutrality in the EU is waging for many years. Since ex-commissioner Neelie Kroes presented her infamous proposal to allow all forms of network discrimination in 2013 the USA have changed their course twice and finally implemented legal safeguards for net neutrality to protect the innovative potential of their digital economy. Other countries have already applied their existing net neutrality laws and could prevent violations of the principle with good results. Meanwhile in the global south millions of people protest against plans of massively violating net neutrality and argue that internet.org and similar zero-rating projects are “economic racism”. The EU will have non of it.
In Europe all three institutions have agreed on a text for net neutrality that is a little bit like Schrodinger’s cat – it could allow protection against network discrimination or it could legalise it. So far we don’t know and even the politicians who will vote on it don’t. The text is written so badly, ambiguous and contradictory that only regulators and courts can give it real meaning in the future.
Next month the European Parliament will have to vote. This talks tries to give an understanding of where we are, how we got there and which path we have to go forward.

El Puerto de Algeciras continúa un año más como el más eficiente del continente europeo y vuelve a situarse en el “top ten” mundial, según el informe The Container Port Performance Index 2023 (CPPI), elaborado por el Banco Mundial y la consultora S&P Global.
El informe CPPI utiliza dos enfoques metodológicos diferentes para calcular la clasificación del índice: uno administrativo o técnico y otro estadístico, basado en análisis factorial (FA). Según los autores, esta dualidad pretende asegurar una clasificación que refleje con precisión el rendimiento real del puerto, a la vez que sea estadísticamente sólida. En esta edición del informe CPPI 2023, se han empleado los mismos enfoques metodológicos y se ha aplicado un método de agregación de clasificaciones para combinar los resultados de ambos enfoques y obtener una clasificación agregada.
