2018 Annual Traffic Contact Report

Texas Profiling Law /Sandra Bland Act
• The Texas Racial Profiling law came into effect in 2001 with the
passage of Senate Bill 1074.
• Beginning in 2002, all police departments that made motor vehicle
stops had to start collecting traffic related data and provide an
analysis report to their respective governing body by March 1 of
each year.
• In 2009, with the passage of H.B. 3389, the law was modified,
adding new requirements to include; re-defining of contact,
addition of “middle eastern” to ethnic categories, the
acknowledgement of whether the officer knew the race or ethnicity
of the violator prior to the stop and to also provide the required
analysis report to not only our governing body but also Texas
Commission on Law Enforcement (TCOLE).
Texas Profiling Law /Sandra Bland Act (cont.)
• In 2017, with the passage of H.B. 3051
– the ethnic categories were again modified, removed
“middle eastern”
– the Sandra Bland Act (S.B. 1849) was passed and
imposed additional requirements upon police
departments to include:
• De-escalation training
• Specific analysis of data to include searches and whether those
searches produced contraband.
• Periodic audits of data throughout the course of the year.
• Reports on instances when use of force was used and resulted in
bodily injury.
• Reviewing standards for body worn and in car videos.
Overall Requirements Checklist
 Department must have a racial profiling policy citing acts that
constitute racial profiling and prohibition from engaging in such
conduct.
 Racial profiling complaint process to include public education
related to the topic and complaint process.
 Disciplinary guidelines for officers found in violation.
 Collect, report and analyze enhanced Tier 2 data.
 Data audits and search analysis.
 Indication of the number of contacts where ethnicity is known or
not known by officer prior to the stop.
 Body worn and in-car video review standards.
 Report of instances when force is used and bodily injury is
sustained.
 Submission of report to governing body and TCOLE by March 1st.
Meeting the Requirements
• The College Station Police Department has
implemented a biased based profiling policy which
defines the prohibition, the data collection process,
training requirements, video review standards,
complaint process and public education requirements.
• Since the inception of the law, the College Station
Police Department has informed the public on the
compliant filing process.
• In 2018, the Department did not received a racial
profile complaint.
Meeting the Requirements
• College Station Police Department provides all officers
instruction on TCOLE certified Racial Profiling
curriculum.
• The department’s record supervisor has conducted
periodic audits of collected data through out the year.
• Supervisors have conducted video review of body worn
and in-car videos.
• We have commissioned an outside consultant to
analysis our annual traffic contact data.
Analysis of Data
• As stated by our consultant, It is very difficult to
detect specific “individual” behavior with
aggregate-level data.
• Three different types of analysis were conducted:
– First was the careful evaluation of 2018 motor vehicle
contact data.
• This particular analysis measured, the number and
percentage of Whites, Blacks, Hispanics, Asians and
American Indian, that came in contact with the police
involving a motor vehicle and were issued a citation or
arrested in 2018.

– The second type of analysis was based on a
comparison of 2018 contact data with a particular
baseline.
• Of all the baseline measures available, College Station
Police Department elected to use the Fair Roads
Standard as initially recommended by several civil
rights groups in Texas.
– The Fair Roads Standard is based on data obtained through
the U.S. Census Bureau (2010) relevant to the number of
households that have access to vehicles while controlling race
and ethnicity.
– The Fair Roads Standard data used is relevant to College
Station
Analysis of Data (cont.)
– The third type of analysis was conducted while
comparing the pattern on searches performed as
a result of a motor vehicle contact.
Tier 2 (2018) Traffic Contact Analysis
• The trends on contacts were as follows:
– Most contacts were made with males, who were mostly were white drivers,
followed by Black and Hispanic drivers
– In most instances, police officers reported that they did not know the race or
ethnicity of the individual prior to the stop.
– The primary reason for stops were for moving traffic violations followed by
vehicle traffic violations.
– Most contacts took place on City streets
– Most stops did not involve a search
– Of those searches made, most were made incident to arrest and the second
most were consent searches.
– Contraband was not found as a result of most searches.
– Of the contraband found, drugs were the most frequent followed by alcohol.
– Most stops resulted in written warnings, followed by citations.
– Most arrests were based on violation of the Penal Code followed by traffic law.
– Use of force that resulted in bodily injury was only found in two instances
Fair Roads Standard Analysis
• With respect to the Whites and Asians, a lower percentage
of contacts were detected than the White and Asian
households, in 2010 census, in College Station with access
to vehicles.
• The percentage of Blacks and Hispanics that came in
contact with the police was higher than the percentage of
Black and Hispanics households in College Station that
claimed, in the 2010 census, to have access to vehicles.
• It should be noted that in the case of Hispanics, the
percentage difference was within the margin of error and
considered statistically insignificant by the consultant.
Fair Roads Standard (cont.)
• Most searches in this analysis showed that
they did not produce contraband. This is
consistent with national law enforcement
trends.
• Of those searches that did produced
contraband, the majority involved White
contacts followed by Blacks.
Summary of Findings
• While annual variance can be expected due to
the ever changing environment, a historical
review of data reveals remarkable similarities
in data analysis across 10 years of data.
• Overall, the comprehensive analysis of data
demonstrates that the College Station Police
Department has complied with the Texas
Racial Profiling Law and all of its
requirements.

2018 Traffic Contact Report

  • 1. College Station Police Department 2018 Annual Traffic Contact Report Scott McCollum, Chief of Police February 25th, 2019
  • 2. Texas Profiling Law /Sandra Bland Act • The Texas Racial Profiling law came into effect in 2001 with the passage of Senate Bill 1074. • Beginning in 2002, all police departments that made motor vehicle stops had to start collecting traffic related data and provide an analysis report to their respective governing body by March 1 of each year. • In 2009, with the passage of H.B. 3389, the law was modified, adding new requirements to include; re-defining of contact, addition of “middle eastern” to ethnic categories, the acknowledgement of whether the officer knew the race or ethnicity of the violator prior to the stop and to also provide the required analysis report to not only our governing body but also Texas Commission on Law Enforcement (TCOLE).
  • 3. Texas Profiling Law /Sandra Bland Act (cont.) • In 2017, with the passage of H.B. 3051 – the ethnic categories were again modified, removed “middle eastern” – the Sandra Bland Act (S.B. 1849) was passed and imposed additional requirements upon police departments to include: • De-escalation training • Specific analysis of data to include searches and whether those searches produced contraband. • Periodic audits of data throughout the course of the year. • Reports on instances when use of force was used and resulted in bodily injury. • Reviewing standards for body worn and in car videos.
  • 4. Overall Requirements Checklist  Department must have a racial profiling policy citing acts that constitute racial profiling and prohibition from engaging in such conduct.  Racial profiling complaint process to include public education related to the topic and complaint process.  Disciplinary guidelines for officers found in violation.  Collect, report and analyze enhanced Tier 2 data.  Data audits and search analysis.  Indication of the number of contacts where ethnicity is known or not known by officer prior to the stop.  Body worn and in-car video review standards.  Report of instances when force is used and bodily injury is sustained.  Submission of report to governing body and TCOLE by March 1st.
  • 5. Meeting the Requirements • The College Station Police Department has implemented a biased based profiling policy which defines the prohibition, the data collection process, training requirements, video review standards, complaint process and public education requirements. • Since the inception of the law, the College Station Police Department has informed the public on the compliant filing process. • In 2018, the Department did not received a racial profile complaint.
  • 6. Meeting the Requirements • College Station Police Department provides all officers instruction on TCOLE certified Racial Profiling curriculum. • The department’s record supervisor has conducted periodic audits of collected data through out the year. • Supervisors have conducted video review of body worn and in-car videos. • We have commissioned an outside consultant to analysis our annual traffic contact data.
  • 7. Analysis of Data • As stated by our consultant, It is very difficult to detect specific “individual” behavior with aggregate-level data. • Three different types of analysis were conducted: – First was the careful evaluation of 2018 motor vehicle contact data. • This particular analysis measured, the number and percentage of Whites, Blacks, Hispanics, Asians and American Indian, that came in contact with the police involving a motor vehicle and were issued a citation or arrested in 2018.
  • 8. Analysis of Data (cont.) – The second type of analysis was based on a comparison of 2018 contact data with a particular baseline. • Of all the baseline measures available, College Station Police Department elected to use the Fair Roads Standard as initially recommended by several civil rights groups in Texas. – The Fair Roads Standard is based on data obtained through the U.S. Census Bureau (2010) relevant to the number of households that have access to vehicles while controlling race and ethnicity. – The Fair Roads Standard data used is relevant to College Station
  • 9. Analysis of Data (cont.) – The third type of analysis was conducted while comparing the pattern on searches performed as a result of a motor vehicle contact.
  • 10. Tier 2 (2018) Traffic Contact Analysis • The trends on contacts were as follows: – Most contacts were made with males, who were mostly were white drivers, followed by Black and Hispanic drivers – In most instances, police officers reported that they did not know the race or ethnicity of the individual prior to the stop. – The primary reason for stops were for moving traffic violations followed by vehicle traffic violations. – Most contacts took place on City streets – Most stops did not involve a search – Of those searches made, most were made incident to arrest and the second most were consent searches. – Contraband was not found as a result of most searches. – Of the contraband found, drugs were the most frequent followed by alcohol. – Most stops resulted in written warnings, followed by citations. – Most arrests were based on violation of the Penal Code followed by traffic law. – Use of force that resulted in bodily injury was only found in two instances
  • 11. Fair Roads Standard Analysis • With respect to the Whites and Asians, a lower percentage of contacts were detected than the White and Asian households, in 2010 census, in College Station with access to vehicles. • The percentage of Blacks and Hispanics that came in contact with the police was higher than the percentage of Black and Hispanics households in College Station that claimed, in the 2010 census, to have access to vehicles. • It should be noted that in the case of Hispanics, the percentage difference was within the margin of error and considered statistically insignificant by the consultant.
  • 12. Fair Roads Standard (cont.) • Most searches in this analysis showed that they did not produce contraband. This is consistent with national law enforcement trends. • Of those searches that did produced contraband, the majority involved White contacts followed by Blacks.
  • 13. Summary of Findings • While annual variance can be expected due to the ever changing environment, a historical review of data reveals remarkable similarities in data analysis across 10 years of data. • Overall, the comprehensive analysis of data demonstrates that the College Station Police Department has complied with the Texas Racial Profiling Law and all of its requirements.
