• Advertising rules must still be followed
• Know your companies E-policy
• Electronic communication for advertising or
marketing, including but not limited to e-mail, e-mail
discussion groups, websites and bulletin boards, must
include on the first page of all communications the
following data:
– a. the licensee’s name;
– b. the name of the firm with which the licensee is affiliated
as that firm name is registered with the commission
– c. the city & state in which the licensee’s office is located
and in which the licensee hold a license

• This Standard of Practice acknowledges that
disclosing the name of the firm may not be
practical in electronic displays of limited
information (e.g. “thumbnails”, text
messages, “tweets”, etc.).
• Such displays are exempt from the disclosure
requirement established in this Standard of
Practice but only when linked to a display that
includes all required disclosures.

Advertising Rules & Regulations
REALTORS®’ obligation to present a true picture in their advertising and
representations to the public includes the URLs and domain names they
use, and prohibits REALTORS® from:
1) engaging in deceptive or unauthorized framing of real estate brokerage
websites;
2) manipulating (e.g., presenting content developed by others) listing and
other content in any way that produces a deceptive or misleading result;
3) deceptively using metatags, keywords or other devices/methods to
direct, drive, or divert Internet traffic;
4) presenting content developed by others without either attribution or
without permission; or
5) to otherwise mislead consumers.

work is created such as the first time it is written
• Secure proper approvals or legal owner of the
material
• It’s OK to link to other sites, just don’t copy from

• Fines & Penalties: Damages may include lost profits
from the infringing activity or statutory damages
ranging from $250 to $150,000 plus attorneys' fees, for
each infringing copy. Even higher damages may be
awarded if the court feels that the infringement was
committed "willfully."
• You may also be criminally liable if you willfully copy a
work for profit or financial gain, or if the copied work
has a value of more than $1,000. In these
cases, penalties can include a one-year jail sentence
plus fines.

professionals, competitors’ their businesses and competitors’
their business practices includes the duty to not knowingly or

person, in writing, by technological means (e.g., the
Internet), or by any other means.
