1. Sand Mine lot 218 a Councilors Perspective
29th June 2006 an agreement was entered
between Bruce Mackenzie & Towers family
members, (access to lot 218 for a $1.00 per tonne
levee)
21 July 2008 Mackas Sand tabled a DA to the Minister
for Planning withdrawn then relodged 29 October 2008
20 September 2009 the minister conditionally granted
project under part 3a EPA 1 million t’s over 20 years.
2. December 2009 Mackenzie’s became the registered
proprietor of lot 2 DP 916061 and lot DP 753192
29 January 2010 Mackas Sand requested PSC resume
part of Towers land to deviate Stockton Bight Track .
April 2009 site visit by Councilors Dingle, Kafer and
Ward invited by the Towers property to inspect roads
plant and proposed route.
23 March 2010 minutes ordinary council – item no. 5
alterations to boundaries of public road known as
Stockton Bight Track at Williamtown.
3. 12th October 2010 confidential OC meeting: alterations
to Stockton Bight Track. Recommended deviation to
avoid existing structures on the reserve.
19th October 2010 OC – confidential item 1 alteration to
boundaries of Stockton Bight Track at Williamtown.
2011 following the compulsory acquisition, the Towers
claimed compensation re. Valuer Generals assessment.
Towers appealed to the L & E court seeking compensation
of $8.5million re loss of their agreement
4. 26th June 2012 OC – PSC recommendation: Make
application to the Minister re council be permitted to
rescind the compulsory acquisition notice.
GM admits he did not obtain any formal legal advice.
Est. costs over $500,000 in land acquisition & court costs.
21st November 2012 Public submission close S75W
modification change re road access onto Nelson Bay Rd.
left turn only intersection through Padmos land.
January 2013 currently waiting for the Minster to make
decision , court action still a possibility, case not closed.
