Ang Philippine Overseas Employment Administration
(POEA)ay isang attached agency ng Department of
Labor and Employment na nabuo sa pamamagitan ng
Presidential Decree (PD) 797 noong Mayo 2, 1982
para linangin at pangasiwaan ang overseas
employment at bigyan ng sapat na proteksyon ang
ating mga OFWs.

Ang POEA ang nagreregulate sa partisipasyon ng
pribadong sektor tulad ng Philippine Recruitment
Agencies sa employment program sa ibang bansa,
kabilang ang lahat ng mga proseso na may
kinalaman sa pangangalap at pag-deploy ng mga
Overseas Filipino Workers (OFWs).
Ang ahensyang ito ay nagdodokumento at
nagrerehistro ng lahat na Pilipino na umaalis sa
bansa upang magtrabaho sa ibang bansa .
Nagbibigay din ito ng placement facility para sa
government-to-government na kliyente at libreng
pagrerehistro ng lahat ng mga aplikante sa
manpower pool.

Ang POEA ay may Legal Assistance Division kung
saan maaring dumulog ang OFWs , mga aplikante na
nais mag abroad at mga naging biktima ng illegal
recuiter para sa kanilang legal na problema tungkol
overseas employment , lalo na kung may paglabag sa
regulasyon tungkol sa overseas employment. Ang
legal officers ay nagbibigay ng libreng legal na
serbisyo ng pagpapayo at mga referral sa naaangkop
na mga yunit ng POEA at iba pang mga ahensiya ng
pamahalaan para sa karagdagang tulong .
Kung ang reklamo ay tungkol sa illegal recruitment ,
lalo na kung ang inirereklamo ay walang lisensya o
awtoridad mag-recruit habang isinasagawa ang
aktibidad, ang bagay ay nirerefer sa Operations and
Surveillance Division para sa pagsubaybay,
entrapment at posibleng pagsasara ng
establisyemento.

Kung ang recruitment activity ay naisagawa na , ang
kaso ay nirerefer sa Prosecution Division para sa
paghahain ng mga angkop na kaso. Ang legal officers
ay tumutulong sa pamamagitan ng pagkuha ng
kanilang mga pahayag, pagkalap at pag-sasaayos ng
mga katibayan para sa pag-pafile ng kasong kriminal
sa Prosecution Office.
Nagbibigay din ng legal representation at
nakikipagtulungan sa mga public prosecutor sa
pagusig ng kaso ng illegal recruitment ang POEA.
Ang Repatriation Unit ng POEA naman ang
tumutulong sa pag-papauwi ng mga distressed OFWs
na napaalis ng mga lisensiyadong ahensiya.

ADMINISTRATIVE ACTION
Ang isang OFW na naagrabyado habang nag-aaplay
ng trabahosa ibang ay maaaring maghain ng isang
kasong administratibo laban sa isang recruitment
agency para sa ilang mga paglabag, tulad ng labis na
koleksyon ng mga bayarin , misrepresentation at
pagpapalit ng kontrata. Ang mga paglabag ay inuri sa
light, less serious and serious, na may karampatang
parusa mula Reprimand, Suspension of License
mula isang buwan hanggang isang taon, at
Cancellation of License para serious violation at
umuulit ng pagkakasala.
.Disciplinary Action Against employer / foreign principal o DAE ang maaaring i-file sa
mga kasong tulad ng default sa kontrata obligasyon sa manggagawa o sa kanyang
Philippine agent, gross violation of laws, rules and regulations on overseas

LABOR CLAIMS
Pagdating sa mga kaso ng unpaid salaries at iba
pang reklamo na may kaugnayan sa monetary
claims, maaring i-file ang kaso laban sa employer sa
National Labor Relations Commission (NLRC). At
dahil sa “JOINT AND SEVERAL LIABILITY”
policy,ang recruitment agency ay parehas may
pananagutan na maaring isama sa kaso.
Maari ding ang OFW ay sumailalim sa voluntary
conciliation, kung saan ang OFW at recruitment
agency ay gagawa ng kasunduan na siyang
pinakamabilis na paraan upang aregluhin ang di
pagkakaunawaan. Ang Voluntary conciliation cases
ay hawak ng DOLE at ng mga attached agencies
(kasama ang POEA) sa pamamagitan ng DOLE’s
Single Entry Approach (SeNA).

Maari ding magsampa ng kasong kriminal ang isang
OFW o isang aplikante na may kaugnayan sa overseas
employment ng illegal recruitment laban sa isang
lisensiyadong o isang unlicensed recruitment agency.
Ang iba pang kasong kriminal na tulad ng trafficking in
persons at estafa ay maaari ring isampa laban sa mga
responsible.
Ang mga kasong kriminal ay maaring i-file sa Philippine
National Police, the National Bureau of Investigation or
the POEA.
